| In order to regulate people's courts' inquiry and freeze of the deposits and other properties of the persons subject to enforcement through the Internet in the process of handling enforcement cases, and further improve the efficiency of enforcement, these Provisions are formulated in accordance with the provisions of the Civil Procedure Law of the People's Republic of China and in light of the actual work circumstances of the people's courts. | | 为规范人民法院办理执行案件过程中通过网络查询、冻结被执行人存款及其他财产的行为，进一步提高执行效率，根据《中华人民共和国民事诉讼法》的规定，结合人民法院工作实际，制定本规定。 |
| Article 1 The people's courts which have established a network enforcement inquiry and control mechanism with a financial institution may inquire or freeze the deposits of the persons subject to enforcement through the Internet. | | 第一条 人民法院与金融机构已建立网络执行查控机制的，可以通过网络实施查询、冻结被执行人存款等措施。 |
| The establishment and operation of network enforcement inquiry and control mechanism shall meet the following conditions: | | 网络执行查控机制的建立和运行应当具备以下条件： |
| (1) Having established a network enforcement inquiry and control system, and having the functions of delivering, transmitting and giving feedback of the inquiry and control information through the network enforcement inquiry and control system. | | （一）已建立网络执行查控系统，具有通过网络执行查控系统发送、传输、反馈查控信息的功能； |
| (2) Having authorized specific personnel to handle the network enforcement inquiry and control business. | | （二）授权特定的人员办理网络执行查控业务； |
| (3) Having an electronic seal system which conforms to the security specifications. | | （三）具有符合安全规范的电子印章系统； |
| (4) Having taken measures sufficient to guarantee the security of inquiry and control system and information. | | （四）已采取足以保障查控系统和信息安全的措施。 |
Article 2 People's courts shall, when implementing network enforcement inquiry and control measures, undergo beforehand in a unified manner the procedures for recordation of the relevant official certificates of the specific enforcement personnel who are eligible to take the enforcement inquiry and control measures through the Internet with the corresponding financial institutions. When handling the specific business, they do not need to separately offer the relevant official certificates of the enforcement personnel to the corresponding financial institutions.
