The Decision of the Standing Committee of the National People's Congress on Amending the Cultural Relics Protection Law of the People's Republic of China and Other Eleven Laws as adopted at the 3rd Session of the Standing Committee of the Twelfth National People's Congress of the People's Republic of China on June 29, 2013, is hereby issued and shall come into force on the date of issuance.
 
《全国人民代表大会常务委员会关于修改〈中华人民共和国文物保护法〉等十二部法律的决定》已由中华人民共和国第十二届全国人民代表大会常务委员会第三次会议于2013年6月29日通过,现予公布,自公布之日起施行。

全国人民代表大会常务委员会关于修改《中华人民共和国文物保护法》等十二部法律的决定

At its 3rd session, the Standing Committee of the Twelfth National People's Congress of the People's Republic of China has decided that:

I. The Cultural Relics Protection Law of the People's Republic of China shall be amended as follows:   一、对《中华人民共和国文物保护法》作出修改

 
1. Paragraph 2 of Article 25 is amended to read: “Where any non-state-owned unmovable cultural relics are transferred, mortgaged, or the use thereof is changed, the matter shall be submitted to the corresponding department of cultural relics administration for record according to the protection level thereof.” (一)将第二十五条第二款修改为:“非国有不可移动文物转让、抵押或者改变用途的,应当根据其级别报相应的文物行政部门备案。”

 
2. Paragraph 2 of Article 56 is amended to read: “Cultural relics for auction by auction enterprises shall be examined before auction by the departments of cultural relics administration of the people's governments of the provinces, autonomous regions, and municipalities directly under the Central Government, and reported to the department of cultural relics administration under the State Council for record.” (二)将第五十六条第二款修改为:“拍卖企业拍卖的文物,在拍卖前应当经省、自治区、直辖市人民政府文物行政部门审核,并报国务院文物行政部门备案。”

 
II. The Grassland Law of the People's Republic of China shall be amended as follows:   二、对《中华人民共和国草原法》作出修改

 
1. Article 55 is amended to read: “With the exception of the motor vehicles used for emergencies, disaster relief or herdsmen's relocation, no motor vehicles are allowed to leave the roads to drive on grasslands to damage the vegetation; where it is necessary to leave the roads to drive on grasslands for activities such as geological exploration and scientific survey, the driving areas and routes of the vehicles shall be reported in advance to the competent administrative department for grasslands under the local people's government at the county level, and the driving on grasslands shall be abiding by the reported driving areas and routes of the vehicles.” (一)将第五十五条修改为:“除抢险救灾和牧民搬迁的机动车辆外,禁止机动车辆离开道路在草原上行驶,破坏草原植被;因从事地质勘探、科学考察等活动确需离开道路在草原上行驶的,应当事先向所在地县级人民政府草原行政主管部门报告行驶区域和行驶路线,并按照报告的行驶区域和行驶路线在草原上行驶。”

 
2. Article 70 is amended to read: “Anyone who drives a motor vehicle, other than one used for emergencies and disaster relief or herdsmen's relocation, and leaves the roads to drive on grasslands, or for the purpose of geological exploration and scientific survey, leaves the roads to drive on the grasslands without making a report in advance to the competent administrative department for grasslands under the local people's government at the county level or drives on grasslands not according to the reported driving area and routes, and thus causing damage to grassland vegetation, shall be ordered by the competent administrative department for grasslands under the local people's government at the county level to cease the violation and restore the grassland vegetation within a time limit, and in addition, be imposed upon a fine not less than three times but not more than nine times the average output value of the grasslands in the three years before they are damaged; and if losses are caused to the grassland owner or user, the violator shall bear compensation liability in accordance with law.” (二)将第七十条修改为:“非抢险救灾和牧民搬迁的机动车辆离开道路在草原上行驶,或者从事地质勘探、科学考察等活动,未事先向所在地县级人民政府草原行政主管部门报告或者未按照报告的行驶区域和行驶路线在草原上行驶,破坏草原植被的,由县级人民政府草原行政主管部门责令停止违法行为,限期恢复植被,可以并处草原被破坏前三年平均产值三倍以上九倍以下的罚款;给草原所有者或者使用者造成损失的,依法承担赔偿责任。”

 
III. The Customs Law of the People's Republic of China shall be amended as follows:   三、对《中华人民共和国海关法》作出修改

Paragraph 2 of Article 28 is amended to read: “The Customs, under particular circumstances, can grant that the import and export commodities be exempted from inspection. The specific measures therefor shall be formulated by the General Administration of Customs. ”
 
将第二十八条第二款修改为:“海关在特殊情况下对进出口货物予以免验,具体办法由海关总署制定。”

 
IV. The Law of the People's Republic of China on Import and Export Commodity Inspection shall be amended as follows:   四、对《中华人民共和国进出口商品检验法》作出修改

 Article 21 is amended to read: “The agent handling the procedures for application for inspection on behalf of the consignee or the consignor of the import and export commodities shall submit the power of attorney to the commodity inspection authorities when handling the procedures.”
 
将第二十一条修改为:“为进出口货物的收发货人办理报检手续的代理人办理报检手续时应当向商检机构提交授权委托书。”

 
V. The Law of the People's Republic of China on the Administration of Tax Collection shall be amended as follows:   五、对《中华人民共和国税收征收管理法》作出修改

Paragraph 1 of Article 15 is amended to read: “Enterprises, branches in other localities established by such enterprises, sites engaged in production or business operations, individual businesses as well as public institutions engaged in production or business operations (hereinafter referred to as "taxpayers engaged in production or business operations" collectively) shall, within 30 days after receipt of the business license, apply for the tax registration with the tax authority by producing the relevant documents. The tax authority shall conduct registration formalities and issue tax registration certificates on the same day of receipt of the application.”

将第十五条第一款修改为:“企业,企业在外地设立的分支机构和从事生产、经营的场所,个体工商户和从事生产、经营的事业单位(以下统称从事生产、经营的纳税人)自领取营业执照之日起三十日内,持有关证件,向税务机关申报办理税务登记。税务机关应当于收到申报的当日办理登记并发给税务登记证件。”
