| Chapter I General Provisions | | 第一章 总则 |
| |
|
| Article 1 These Measures are formulated in accordance with the Provisions on The Administration of Marks of Origin. | | 第一条 根据《原产地标记管理规定》，制定本办法。 |
| |
|
| Article 2 The State Administration for Entry-Exit Inspection and Quarantine (hereinafter referred to as the SAEEIQ) shall establish an Origin Mark Working Group and its Office, the responsibilities are: | | 第二条 国家出入境检验检疫局（以下简称国家检验检疫局）设立原产地标记工作小组及其办公室，主要职责是： |

|
| (1) to formulate and revise relevant measures for the administration of marks of origin; | | （一）原产地标记的有关管理办法的制、修订； |
| |
|
| (2) to handle the applications for marks of origin for entry goods, examine and approve the registration of marks of origin; | | （二）受理入境原产地标记申请，办理原产地标记的注册审批； |
| |
|
| (3) to issue the types and forms of origin mark certification uniformly; | | （三）统一发布原产地标记认证的种类和形式； |
| |
|
| (4) to coordinate, and supervise and administrate the management of marks of origin. | | （四）原产地标记管理工作的协调和监督管理。 |
| |
|
| Article 3 Each local administration for entry-exit inspection and quarantine (hereinafter referred to as AEEIQ) shall, according to corresponding mode, and within their respective jurisdiction, be responsible for handling applications for, examination and appraisal of, registration, supervision and administration of, marks of origin. | | 第三条 各地出入境检验检疫局（以下简称检验检疫机构）按照相应的模式，负责其辖区内的原产地标记的申请受理、评审、报送注册和监督管理。 |

| Article 4 The SAEEIQ shall issue a Catalogue of Protected Products of Marks of Origin once every six months for those origin marks that have already been approved for registration. | | 第四条 对已取得国家检验检疫局批准注册的原产地标记，由国家检验检疫局每半年一次公开发布《受保护的原产地标记产品目录》。 |

|
| Chapter II Using Sphere of Marks of Origin | | 第二章 原产地标记的使用范围 |
| |
|
| Article 5 Products using marks of origin include: | | 第五条 使用原产国标记的产品包括： |
| |
|
| (1) products wholly obtained in the production country; | | （一）在生产国获得的完全原产品； |
| |
|
| (2) products containing certain imported composition but still qualified as an original product; | | （二）含有进口成份，并获得原产资格的产品； |
| |
|
| (3) imported products with country of origin mark and involving security, hygiene and environment protection; | | （三）标有原产国标记的涉及安全、卫生及环境保护的进口产品； |
| |
|
| (4) commodities for which the foreign manufacturer applies for marks of origin protection; | | （四）国外生产商申请原产地标记保护的商品； |
| |
|
| (5) products involving anti-dumping or anti-subsidy; | | （五）涉及反倾销、反补贴的产品； |
| |
|
| (6) products of marks of origin in service trade and government procurement. | | （六）服务贸易和政府采购中的原产地标记的产品。 |
| |
|
| Article 6 Products using a geographical indication include: | | 第六条 使用地理标志的产品包括： |
| |
|
| (1) Products named after a specific area, the whole or part of or the principal raw materials are from this area or from other specific area, their special qualities, characteristics and good reputations depend on the natural environment and human culture of this area, and they are produced in this area by adopting traditional production technology. | | （一）用特定地区命名的产品，其原材料全部、部分或主要来自该地区，或来自其它特定地区，其产品的特殊品质、特色和声誉取决于当地的自然环境和人文因素，并在该地采用传统工艺生产。 |
| |
|
| (2) Products not named after a specific area, the principal raw materials are from this area or from other specific area, but the quality, taste and features depend on the natural environment and human culture of this area, and they are produced, processed, manufactured or formed by adopting traditional technology, they shall also be considered as products of geographical indication. | | （二）以非特定地区命名的产品，其主要原材料来自该地区或其它特定地区，但该产品的品质、品味、特征取决于该地的自然环境和人文因素以及采用传统工艺生产、加工、制造或形成的产品，也视为地理标志产品。 |

Chapter III Application, Examination and Appraisal,
and Registration of Marks of Origin | | 第三章 原产地标记的申请、评审和注册 |
| |
|
| Article 7 When applying for registration of a geographical indication, the applicant must fill in the Application for Registration of Marks of Origin, and provide the following information: | | 第七条 申请地理标志注册的，申请人须填写《原产地标记注册申请书》，并提供以下资料： |
| |
|
| (1) the scope of the area of origin; | | （一）所适用的产地范围； |
| |
|
| (2) raw materials, production techniques and technological processes used when the products are produced or formed, as well as the principal quality features of the products; | | （二）生产或形成时所用的原材料、生产工艺、流程、主要质量特性； |
| |
|
| (3) information concerning the quality and geographical environment (natural factors, human culture or their combination) of the products; | | （三）生产产品的质量情况与地理环境（自然因素、人文因素或者结合）的相关资料； |
| |
|
| (4) other relevant information that may be required by the AEEIQ. | | （四）检验检疫机构要求的其它相关资料。 |
| |
|
| Article 8 After the receipt of an application for geographical indication, the AEEIQ shall make an examination and appraisal according to the following principles: | | 第八条 检验检疫机构受理地理标志申请后，依据如下原则进行评审： |
| |
|
(1) the name of the product shall be composed of the geographical name and general name of the product that reflects the real nature of the product;
