The Provisions
of the People's Procuratorates on the Work of Case Process Monitoring (for
Trial Implementation), as deliberated and adopted at the 53rd meeting of the
12th Procuratorial Committee of the Supreme People's Procuratorate on July 14,
2016, are hereby issued to you for your conscious implementation in light of actual
circumstances. Any problem arising during the trial implementation shall be
reported to the case administration office of the Supreme People's

| Article 1 For the purposes of strengthening the supervision and administration of people's procuratorates' handling of cases, further regulating the acts of handling of cases, and promoting impartial and efficient judicial services, these Provisions are developed, in accordance with the relevant legal provisions and in light of the actual procuratorial work. | | 第一条 为加强对人民检察院司法办案工作的监督管理，进一步规范司法办案行为，促进公正、高效司法，根据有关法律规定，结合检察工作实际，制定本规定。 |
| Article 2 For the purpose of these Provisions, “case process monitoring” means the real-time and dynamic supervision, reminding, and prevention and control carried out to check whether the handling procedures of cases that are to be accepted or being handled by people's procuratorates (including the activities of handling accusation, tipoffs, complaints, and application materials for state compensation) are lawful, standardized, timely, and complete, in accordance with the legal provisions, relevant judicial interpretations, and regulatory documents, among others. | | 第二条 本规定所称案件流程监控，是指对人民检察院正在受理或者办理的案件（包括对控告、举报、申诉、国家赔偿申请材料的处理活动），依照法律规定和相关司法解释、规范性文件等，对办理程序是否合法、规范、及时、完备，进行实时、动态的监督、提示、防控。 |
| Article 3 The work of case process monitoring shall be completed under the principles of combining the strengthening of supervision and administration and serving case handling , combining overall management and key monitoring, and combining labor management and relying on information technology. | | 第三条 案件流程监控工作应当坚持加强监督管理与服务司法办案相结合、全程管理与重点监控相结合、人工管理与依托信息技术相结合的原则。 |
| Article 4 The case management departments shall be responsible for the organization, coordination, and specific implementation of the work of case process monitoring. | | 第四条 案件管理部门负责案件流程监控工作的组织协调和具体实施。 |
| The case handling departments shall assist and coordinate with the case management departments in carrying out the work of case process monitoring, verify the information in a timely manner, report the opinions, correct the problems, and strengthen administration. | | 办案部门应当协助、配合案件管理部门开展案件流程监控工作，及时核实情况、反馈意见、纠正问题、加强管理。 |
| Departments fulfilling the responsibilities of litigation supervision and discipline inspection and supervision organs shall strengthen the coordination and cooperation with the case management departments, and investigate and handle the problems in violation of disciplines and laws found in case process monitoring in a timely manner. | | 履行诉讼监督职责的部门和纪检监察机构应当加强与案件管理部门的协作配合，及时查处案件流程监控中发现的违纪违法问题。 |
| Technology information departments shall, according to the needs of the work of case process monitoring, provide technical guarantee. | | 技术信息部门应当根据案件流程监控工作需要提供技术保障。 |
| Article 5 For a case to be accepted, the case management department shall focus on the examination of the following contents: | | 第五条 对正在受理的案件，案件管理部门应当重点审查下列内容： |
| (1) Whether the case is under the jurisdiction of this court. | | （一）是否属于本院管辖； |
| (2) Whether the case file materials are complete and standard. | | （二）案卷材料是否齐备、规范； |
| (3) Whether the funds or articles transferred are consistent with the list of transfer. | | （三）移送的款项或者物品与移送清单是否相符； |
| (4) Whether there is any other circumstance that fails to satisfy the requirements for acceptance. | | （四）是否存在其他不符合受理要求的情形。 |
| Article 6 For compulsory measures, the following contents shall be subject to focus supervision and examination: | | 第六条 在强制措施方面，应当重点监督、审查下列内容： |
| (1) Whether the approval formalities have been undergone according to the law for the application, modification, or cancellation of compulsory measures, and whether the legal documents are complete. | | （一）适用、变更、解除强制措施是否依法办理审批手续、法律文书是否齐全； |
| (2) Whether the family members of a person under residential surveillance, a detainee, or an arrestee are notified in a timely manner according to the law. | | （二）是否依法及时通知被监视居住人、被拘留人、被逮捕人的家属； |
| (3) Whether compulsory measures are modified or cancelled upon expiry in a timely manner according to the law. | | （三）强制措施期满是否依法及时变更或者解除； |
| (4) Where residential surveillance and release on bail shall be re-handled according to the law for examination for prosecution, whether it is handled according to the law. | | （四）审查起诉依法应当重新办理监视居住、取保候审的，是否依法办理； |
| (5) Whether there are any other circumstances in violation of the law and relevant provisions. | | （五）是否存在其他违反法律和有关规定的情形。 |
| Article 7 For sealing up, seizing, freezing, safekeeping, handling, and other work of the property in dispute, the following contents shall be subject to focus supervision and examination: | | |
| (1) Whether measures of seal up, seizing, or freezing are taken when no case is docketed. | | （一）是否未立案即采取查封、扣押、冻结措施； |
| (2) Whether measures of sealing up, seizing, or freezing are taken when no legal document is issued. | | （二）是否未开具法律文书即采取查封、扣押、冻结措施； |
| (3) Whether the property in dispute subject to sealing up, seizing, or freezing is consistent with the list. | | （三）查封、扣押、冻结的涉案财物与清单是否一致； |
| (4) Where the property in dispute is subject to sealing up, seizing, or freezing, whether the formalities of sealing, signature, or stamping have been undergone under relevant provisions. | | （四）查封、扣押、冻结涉案财物时，是否依照有关规定进行密封、签名或者盖章； |
| (5) After sealing up, seizing, or freezing the property in dispute, whether the property in dispute is deposited in a compliant account, whether the formalities of warehousing and storage are undergone, and whether it is registered with the case management department in a timely manner. | | （五）查封、扣押、冻结涉案财物后，是否及时存入合规账户、办理入库保管手续，是否及时向案件管理部门登记； |
| (6) Before the judicial proceeding ends according to the law, whether the property in dispute is turned over to the state treasury or other formalities are undergone therefor. | | （六）是否在诉讼程序依法终结之前将涉案财物上缴国库或者作其他处理； |
| (7) Whether the property in dispute is handled in a timely manner according to the law after the judicial proceeding ends according to the law. | | （七）是否在诉讼程序依法终结之后依法及时处理涉案财物； |
| (8) Whether the property in dispute sealed up, seized, or frozen is missing, damaged, corrupted, embezzled, withheld, divided privately, exchanged, or used in violation of the provisions since the relevant person is irresponsible. | | （八）是否存在因不负责任造成查封、扣押、冻结的涉案财物丢失、损毁，贪污、挪用、截留、私分、调换、违反规定使用查封、扣押、冻结涉案财物的情形； |
| (9) Whether there are any other circumstances in violation of the law and relevant provisions. | | （九）是否存在其他违反法律和有关规定的情形。 |
| Article 8 For the making or use of documents, the following contents shall be subject to focus supervision and examination: | | 第八条 在文书制作、使用方面，应当重点监督、审查下列内容： |
