| The higher people's courts and people's procuratorates of all provinces, autonomous regions, and municipalities directly under the Central Government; the Military Court of the People's Liberation Army and the Military Procuratorate of the People's Liberation Army; the Production and Construction Corps Branch of the Higher People's Court of Xinjiang Uygur Autonomous Region and the Production and Construction Corps Branch of the Higher People's Procuratorate of Xinjiang Uygur Autonomous Region; all branches and coast guards directly under the China Coast Guard; and coast guards of coastal provinces, autonomous regions, and municipalities directly under the Central Government: | | 各省、自治区、直辖市高级人民法院、人民检察院，解放军军事法院、军事检察院，新疆维吾尔自治区高级人民法院生产建设兵团分院、新疆生产建设兵团人民检察院，中国海警局各分局、直属局，沿海省、自治区、直辖市海警局： |
| For the purposes of punishing maritime crimes according to the law and protecting the state sovereignty, security, maritime rights and interests, and maritime order, in accordance with the Criminal Procedure Law of the People's Republic of China, the Decision of the Standing Committee of the National People's Congress on the Exercise of the Maritime Rights Protection and Law Enforcement Functions and Powers by the China Coast Guard, and other relevant laws, you are hereby notified of the relevant issues concerning jurisdiction of maritime criminal cases as follows: | | 为依法惩治海上犯罪，维护国家主权、安全、海洋权益和海上秩序，根据《中华人民共和国刑事诉讼法》《全国人民代表大会常务委员会关于中国海警局行使海上维权执法职权的决定》以及其他相关法律，现就海上刑事案件管辖等有关问题通知如下： |
| I. The jurisdiction of a criminal case that occurs at sea shall be determined according to the following principles: | | 一、 |
| (1) For a crime committed in the inland waters or territorial waters of the People's Republic of China, the people's court at the place of crime or the place where the defendant lands in China shall have jurisdiction. If it is more appropriate for the people's court at the place where the defendant resides to try the case, the people's court at the place where the defendant resides shall have jurisdiction. | | （一）在中华人民共和国内水、领海发生的犯罪，由犯罪地或者被告人登陆地的人民法院管辖，如果由被告人居住地的人民法院审判更为适宜的，可以由被告人居住地的人民法院管辖； |
| (2) For a crime committed in a Chinese ship not within the territory of the People's Republic of China, the people's court at the place of the Chinese port where the ship is first berthed or the place where the defendant lands in or enters the territory of China shall have jurisdiction. | | （二）在中华人民共和国领域外的中国船舶内的犯罪，由该船舶最初停泊的中国口岸所在地或者被告人登陆地、入境地的人民法院管辖； |
| (3) Where a Chinese citizen commits a crime in the sea areas beyond the territorial waters of the People's Republic of China, the people's court at the place where he lands in, enters the territory of China, resided before leaving China, or currently resides shall have jurisdiction; if the victim is a Chinese citizen, the people's court at the place where the victim resided before leaving China or where he currently resides may have jurisdiction. | | （三）中国公民在中华人民共和国领海以外的海域犯罪，由其登陆地、入境地、离境前居住地或者现居住地的人民法院管辖；被害人是中国公民的，也可以由被害人离境前居住地或者现居住地的人民法院管辖； |
(4) Where a foreigner commits a crime against the People's Republic of China or a Chinese citizen in the sea areas outside the territorial waters of the People's Republic of China and he should be punished in accordance with the Criminal Law of the People's Republic of China, the people's court at the place where such foreigner lands in or enters the territory of China, or resides after his entry shall having jurisdiction or the people's court at the place where the victim resided before leaving China or currently resides shall have jurisdiction.
