AGREEMENT BETWEEN THE GOVERNMENT oF THE PEoPLE'S REPUBLIC oF CHINA AND HIS MAJESTY'S GOVERNMENT OF NEPAL ON TRADE，INTERCOURSE AND RELATED QUESTIONS BETWEEN THE TIBET AUTONOMOUS REGION OF CHINA AND NEPAL | | 中华人民共和国政府和尼泊尔国王陛下政府关于中国 |
| The Government of the People's Republic of China and His Majesty's Government of Nepal， | | 西藏自治区和尼泊尔之间的通商、交通和其他有关问题的协定 |
Being desirous of further developing the friendly and good—neighbourly relations between the two countries，
Reaffirming the Five Principles，i．e．， | | 中华人民共和国政府和尼泊尔国王陛下政府，为进一步发展两国友好睦邻关系，重申以五项原则，即： |
| 1．Mutual respect for each other's sovereignty and territorial integrity， | | 一、互相尊重主权和领土完整， |
| 2．Mutual non—aggression， | | 二、互不侵犯， |
| 3．Non—interference in each other's internal affairs， | | 三、互不干涉内政， |
| 4．Equality and mutual benefit，and | | 四、平等互利， |
5．Peaceful co—existence，as the fundamental principles guiding the relations between the two countries，
Desiring to develop on the basis of these principles the traditional friendly relations between the peoples of the two countries，and particularly between the inhabitants of the Tibet Autonomous Region of China and the people of Nepal，
Have agreed to conclude the present Agreement on the basis of the Agreement Between the Government of the People's Republic of China and His Majesty's Government of Nepal on Trade，Intercourse and Related Questions Between the Tibet Autonomous Region of China and Nepal signed by the two Governments on 2 May 1966． | | 五、和平共处，为指导两国关系的基本原则，并在此基础上发展两国人民，特别是中国西藏自治区人民与尼泊尔人民之间的传统友好关系；一致同意在一九六六年五月二日双方政府签订的《中华人民共和国政府和尼泊尔国王陛下政府关于中国西藏自治区和尼泊尔之间的通商、交通和其他有关问题的协定》的基础上，缔结本协定。 |
| After friendly consultations，the two Governments have agreed upon the following： | | 双方政府经过友好商谈，议定下列各条： |
| Article 1 The two Governments agree that the movement of persons between the Tibet Autonomous Region of China and Nepal shall be governed by the following provisions： | | 第一条 双方政府同意，关于中国西藏自治区和尼泊尔之间的人员往来，按照以下各项规定办理： |
| 1．Diplomatic personnel，civil servants and other nationals（except those covered by paragraphs 2，3，5and 6 of this Article）of either country going to the other country shall hold valid passports issued by their own country and visaed by the other country．Nationals of either country entering the Tibet Autonomous Region of China or Nepal via a third country shall also hold valid passports issued by their own country and visaed by the other country． | | 一、两国外交人员、公务人员和除本条第二、三、五、六款规定以外的两国国民前往对方国家，须持本国有效护照，并且办妥对方签证。经由第三国进入中国西藏自治区或尼泊尔境内的两国国民，也须持有本国有效护照，并且办妥对方签证。 |
| 2．Traders of either country known to be customarily and specially engaged in trade between the Tibet Autonomous Region of China and Nepal（not being those persons covered by paragraph 3 of this Article），their wives and children dependent upon them for livelihood and their attendants shall hold valid passports issued by their own country and visaed by the other country or other certificates issued by their own Government or its duly authorized agency． | | 二、凡按习惯专门从事于中国西藏自治区和尼泊尔之间的贸易而不属于本条第三款所指的双方商人、他们的妻子和依靠他们生活的子女及随从人员，须持有本国有效护照并办妥对方签证，或本国政府或其授权机关发给的证明书。 |
| 3．Inhabitants of the border districts as specified by either side in future（hereinafter referred to as border inhabitants）who proceed to the border districts of the other country to carry on petty trade，to visit friends or relatives，or for seasonal change of residence shall hold border inhabitant certificates issued by concerned authority and register at the border checkpost or the first encountered duly authorizedgovernment agency of the other country before carrying out activities in the border districts，provided that existing practices may continue until such specification．However，they shall not be allowed to proceed to the interior of the other country． | | 三、将来由双方所指定的边境地区的居民（以下简称边境居民），凡因进行小额贸易、探望亲友或季节性迁居的原因前往对方边境地区，须持由有关当局颁发的边境居民证并在对方边境检查站或第一次遇到的对方政府授权机关进行登记后，在边境地区内活动（在边境地区被指定之前，可继续按现行做法办理），但不得进入内地。 |
| 4．Border inhabitants who travel beyond border districts of the other country and other nationals shall hold valid passports issued by their own country and visaed by the other country． | | 四、超出对方边境地区旅行的边民和其他国民须持由本国颁发的有效护照并办妥对方签证。 |
| 5．Among religious believers of either country who travel for the purpose of pilgrimage，those who are inhabitants of the border districts and travel within the border districts of the other country shall hold border inhabitant certificates：those who travel beyond border districts of the other country and those who are not inhabitants of the border districts shall hold valid passports issued by their own country and visaed by the other country or shall hold certificates for pilgrimage issued by local government of their own country．Religious believers of either country shall register at the border checkpost or the first encountered duly authorized government agency of the other country and obtain permits for pilgrimage． | | 五、双方香客为朝圣而旅行时，凡属边民且其旅行范围不超出对方边境地区的，须持边境居民证，超出边境地区的或不是边民的香客须持本国有效护照并且办妥对方签证，或持本国地方政府发给的朝圣证明文件。双方香客均须在对方边境检查站或第一次遇到的对方政府授权机关进行登记，并且领取朝圣许可证。 |
6．Porters，muleteers，drivers of motor vehicles and artisans of either country shall hold border inhabitant certificates or certificates valid for a period of not more than one year issued by the local government of their own country or by its duly authorized agency and register at the border checkpost of the other country．After obtaining permission，they may conduct activities within designated areas．Motor vehicles of either country may，after obtaining permission of the other country，enter into appropriate places of the other country．
