Several Opinions of the General Office of the State Council on Accelerating the Cultivation and Development of the Residential Rental Property Market

The people's governments of provinces, autonomous regions, and municipalities directly under the Central Government; the ministries and commissions of the State Council; and the institutions directly under the State Council: 各省、自治区、直辖市人民政府,国务院各部委、各直属机构:
Focusing on both purchase and rental of residential properties and cultivating and developing the residential rental property market are an integral part of deepening the reform of the housing system and an important avenue to achieve the objective that every urban resident has a home to live in. Since China's reform and opening up, the residential rental property market in China has continued developing, and played an important role in improving the housing conditions of urban residents and promoting the new-type urbanization, but there are still prominent problems, for instance, the market suppliers are not fully developed, the market order is not well regulated, and the relevant legislation is not complete. With the consent of the State Council, the following opinions are hereby offered for the purpose of accelerating the cultivation and development of the residential rental property market: 实行购租并举,培育和发展住房租赁市场,是深化住房制度改革的重要内容,是实现城镇居民住有所居目标的重要途径。改革开放以来,我国住房租赁市场不断发展,对加快改善城镇居民住房条件、推动新型城镇化进程等发挥了重要作用,但市场供应主体发育不充分、市场秩序不规范、法规制度不完善等问题仍较为突出。为加快培育和发展住房租赁市场,经国务院同意,现提出以下意见。
I. General requirements   一、总体要求
1. Guiding thought. The spirit of the 18th National Congress of the Communist Party of China (”CPC”), the Third, Fourth, and Fifth Plenary Sessions of the 18th CPC Central Committee, the Central Urbanization Work Conference, and the Central City Work Conference shall be comprehensively implemented, and the decisions and arrangements of the State Council shall be conscientiously carried out. According to the overall layout of “economic, political, cultural, social, and ecological advancement as a whole” and the strategic layout of “Four Comprehensives,” the development conception of innovation, coordination, green, openness, and sharing shall be firmly established and implemented. The main direction is the formation of a housing system focusing on both purchase and rental, and the residential rental property system in which the market plays a primary role in allocation and the government provides basic security shall be improved. Residential rental property consumption is supported, to promote the sound development of the residential rental property market. (一)指导思想。全面贯彻党的十八大和十八届三中、四中、五中全会以及中央城镇化工作会议、中央城市工作会议精神,认真落实国务院决策部署,按照“五位一体”总体布局和“四个全面”战略布局,牢固树立和贯彻落实创新、协调、绿色、开放、共享的发展理念,以建立购租并举的住房制度为主要方向,健全以市场配置为主、政府提供基本保障的住房租赁体系。支持住房租赁消费,促进住房租赁市场健康发展。
2. Development targets. By 2020, a residential rental property market system with diversified suppliers, well-regulated operation and services, and stable rental relationships will have been basically formed, a sustainable public rental housing security system that guarantees the basic needs and promoting fairness will have been basically formed, and a residential rental property legislation system with clear market rules, strong governmental regulation, and sufficient protection of rights and interests will have been basically formed, to promote the accomplishment of the objective that every urban resident has a home to live in. (二)发展目标。到2020年,基本形成供应主体多元、经营服务规范、租赁关系稳定的住房租赁市场体系,基本形成保基本、促公平、可持续的公共租赁住房保障体系,基本形成市场规则明晰、政府监管有力、权益保障充分的住房租赁法规制度体系,推动实现城镇居民住有所居的目标。
II. Cultivating market suppliers   二、培育市场供应主体
3. Developing residential rental property enterprises. The role of the market shall be maximized, enterprises shall be motivated to explore sources of properties through multiple channels such as rental and purchase, the size, intensification and specialization of residential rental property enterprises shall be heightened, and a pattern of coordinated development of small, medium-sized, and large residential rental property enterprises shall be formed, to meet the increasing demand for residential rental properties. According to the relevant provisions of the Guiding Opinions of the General Office of the State Council on Accelerating the Development of the Consumer Service Industry and Promoting the Upgrade of Consumption Structure (No. 85 [2015], General Office of the State Council), residential rental property enterprises enjoy the relevant supporting policies for the consumer service industry. (三)发展住房租赁企业。充分发挥市场作用,调动企业积极性,通过租赁、购买等方式多渠道筹集房源,提高住房租赁企业规模化、集约化、专业化水平,形成大、中、小住房租赁企业协同发展的格局,满足不断增长的住房租赁需求。按照《国务院办公厅关于加快发展生活性服务业促进消费结构升级的指导意见》(国办发〔2015〕85号)有关规定,住房租赁企业享受生活性服务业的相关支持政策。
4. Encouraging real estate development enterprises to provide residential rental property services. Real estate development enterprises are supported in expanding their business scopes and making use of existing or newly built residential properties to provide rental services. Real estate development enterprises are encouraged to rent out commodity residential properties in stock. Real estate development enterprises shall be directed to cooperate with residential rental property enterprises in the development of residential rental properties. (四)鼓励房地产开发企业开展住房租赁业务。支持房地产开发企业拓展业务范围,利用已建成住房或新建住房开展租赁业务;鼓励房地产开发企业出租库存商品住房;引导房地产开发企业与住房租赁企业合作,发展租赁地产。
5. Regulating residential rental property intermediaries. The role of intermediaries shall be maximized, and they shall provide intermediary services in a well-regulated manner. They shall strive to improve their service quality, and continuously improve the quality of their practitioners. Lawful operation, good faith, and fair deal on the part of intermediaries shall be promoted. (五)规范住房租赁中介机构。充分发挥中介机构作用,提供规范的居间服务。努力提高中介服务质量,不断提升从业人员素质,促进中介机构依法经营、诚实守信、公平交易。
6. Supporting and regulating residential properties rented out by individuals. Preferential policies that encourage individuals to rent out their residential properties shall be implemented, and individuals are encouraged to lawfully rent out residential properties owned by them. Renting out residential properties by individuals shall be regulated, and individuals are supported in renting out their residential properties through residential rental property enterprises or intermediaries.

 (六)支持和规范个人出租住房。落实鼓励个人出租住房的优惠政策,鼓励个人依法出租自有住房。规范个人出租住房行为,支持个人委托住房租赁企业和中介机构出租住房。
