| Chapter I General Provisions | | 第一章 总则 |
| Article 1 To strengthen the administration of crop seed quality laboratories, regulate the assessment of laboratories, and guarantee the testing capacity, these Measures are developed in accordance with the Seed Law of the People's Republic of China. | | 第一条 为了加强农作物种子质量检验机构管理，规范检验机构考核工作，保证检验能力，根据《中华人民共和国种子法》，制定本办法。 |
| Article 2 The crop seed quality laboratories (hereinafter referred to as “laboratories”) which externally provide crop seed testing services and issue the testing data and results with the function of certification shall pass the assessment of agriculture administrative departments of local people's governments at or above the provincial level. | | 第二条 对外开展农作物种子检验服务，出具有证明作用的检验数据和结果的农作物种子质量检验机构（以下简称检验机构），应当经省级以上人民政府农业行政主管部门考核合格。 |
| The Ministry of Agriculture and the agriculture administrative departments of people's governments of all provinces, autonomous regions, and municipalities directly under the Central Government are the assessment authorities for laboratories. The laboratories established by therelevant competent departments of the people's governments at or above the provincial level in accordance with the law shall be assessed by the Ministry of Agriculture; and other laboratories shall be assessed by the local agriculture administrative departments of local provincial people's governments. | | 农业部和省、自治区、直辖市人民政府农业行政主管部门是检验机构的考核机关。省级以上人民政府有关主管部门依法设置的检验机构由农业部考核；其他检验机构由所在地省级人民政府农业行政主管部门考核。 |
| Article 3 The assessment of laboratories shall be conducted by combined means of document review, on-site evaluationand proficiency testing, and be subject to the system whereby assessment requirements, assessment procedures, certificate symbol, and supervision and administration are unified. | | 第三条 检验机构考核采取文件审查、现场评审和能力验证相结合的方式，实行考核要求、考核程序、证书标志、监督管理统一的制度。 |
| Article 4 An assessment authority shall form an assessment team which takes charge of document review and on-site evaluation. | | 第四条 考核机关成立考评小组，负责文件审查和现场评审工作。 |
| An assessment team shall consist of three or five assessors who shall hold seniorprofessional and technical positions in relevant fields and have engaged in seed testing for five years or more. | | 考评小组由3名或者5名考评员组成。考评员应当具有相关专业的高级专业技术职务、从事种子检验工作5年以上。 |
| Article 5 The National Crop Seed Quality Testing Center under the Ministry of Agriculture shall take charge of the proficiency testing of laboratories. | | 第五条 农业部的国家农作物种子质量检验中心，负责检验机构能力验证工作。 |

| Chapter II Application and Acceptance | | 第二章 申请与受理 |
| Article 6 A laboratory which applies for assessment shall meet the requirements of the Rules of the Ministry of Agriculture for the Assessment of Crop Seed Quality Laboratories (hereinafter referred to as “Assessment Rules”) and satisfy the following conditions: | | 第六条 申请考核的检验机构应当符合农业部《农作物种子质量检验机构考核准则》（以下简称《考核准则》）的要求，并具备下列条件： |
| (1) Having eligible persons in charge of technologies and persons in charge of quality. | | （一）有符合要求的技术负责人和质量负责人； |
| (2) Having five or more seed inspectors who comply with the provisions of the Measures for the Administration of the Assessment of Crop Seed Inspectors, at a minimum three of whom are indoor inspectors. | | （二）有5名以上符合《农作物种子检验员考核管理办法》规定的种子检验员，其中至少3名为室内检验员； |
| (3) Having corresponding fixed testing places and the instrument and equipment that meet the requirement of the Rules for Crop Seed Testing. | | （三）有相应的固定检验场所和符合《农作物种子检验规程》要求的仪器设备； |
| (4) Having sound and effective administration norms. | | （四）有健全有效的管理工作规范。 |
| Article 7 An applicant for laboratory assessment shall submit to the assessment authority the following materials: | | 第七条 申请检验机构考核的，应当向考核机关提交下列材料： |
| (1) An application form. | | （一）申请书； |
| (2) A certificate on legal person status or the certification document onlegal person authorization. | | （二）法人资格证明或者法人授权证明文件； |
| (3) The certification document ofthe relevant authority on approving the formation of the laboratory. | | （三）有关部门批准机构设置的证明文件； |
| (4) Qualification certificates of seed inspectors. | | （四）种子检验员资格证明； |
| (5) Explanations on the scope of test items. | | （五）检验项目范围说明； |
| (6) Quality manual. | | （六）质量手册； |
| (7) Test report in duplicate. | | （七）检验报告2份。 |
| Article 8 An assessment authority shall, within five daysof receipt of the materials, conduct a preliminary review on the integrity, authenticity and standardization of the application materials. Where the application materials satisfy the requirements, the application shall be accepted, and a notice of acceptance shall be issued; otherwise, the application shall not be accepted, the applicant shall be notified in writing and the reasons therefor shall be given. | | 第八条 考核机关自收到材料之日起5日内对申请材料的完整性、真实性、规范性进行初步审查，符合要求的，予以受理，并出具受理通知书；不符合要求的，不予受理，书面通知申请人并说明理由。 |
| After the acceptance of the application, the assessment authority shall consult with the applicant to determine the time of on-site evaluation, notify theNational Crop Seed Quality Testing Center to prepare proficiency testing samples, and transfer the quality manual and relevant materials to the assessment team for document review. | | 受理申请后，考核机关应当与申请人商定现场评审时间，通知国家农作物种子质量检验中心准备能力验证样品，并将质量手册和相关材料转交考评小组进行文件审查。 |

| Chapter III Capacity Assessment | | 第三章 能力考评 |
| Article 9 An assessment team shall conduct document review in accordance with the requirements of the Assessment Rules, and put focus on examining the integrity, authenticity, effectiveness and appropriateness of the quality manual and relevant materials. Thosefailing to meet the requirements shall be reported to the assessment authority which shall notify the applicant to make modifications within a prescribed time limit. | | 第九条 考评小组依据《考核准则》的要求进行文件审查，主要审查质量手册和相关材料的完整性、真实性、有效性和适宜性。对不符合要求的，报经考核机关通知申请人在规定期限内修改。 |
Article 10 An assessment team shall conduct on-site evaluation in accordance with the requirements of the Assessment Rules, focusing on conformity assessment of the technical capacity, instrument and equipment, quality management and other conditions of the laboratory.
