| For the purpose of facilitating the parties' resolution of disputes through the China International Commercial Court of the Supreme People's Court CICC (hereinafter referred to as the “CICC”), these Rules are developed in accordance with the Civil Procedure Law of the People's Republic of China, the Provisions of the Supreme People's Court on Several Issues concerning the Establishment of China International Commercial Court (hereinafter referred to as the “Provisions”), and other laws and judicial interpretations. | | 为方便当事人通过最高人民法院国际商事法庭（以下简称国际商事法庭）解决纠纷，根据《中华人民共和国民事诉讼法》《最高人民法院关于设立国际商事法庭若干问题的规定》（以下简称《规定》）等法律和司法解释的规定，制定本规则。 |
| I. General Provisions | | 第一章 一般规定 |
| Article 1 The CICC shall provide the parties with an international commercial dispute resolution mechanism with organic connection between litigation, mediation, and arbitration so as to resolve disputes in an impartial, efficient, convenient, and cost-effective manner. | | 第一条 国际商事法庭为当事人提供诉讼、调解、仲裁有机衔接的国际商事纠纷解决机制，公正、高效、便捷、低成本地解决纠纷。 |
| Article 2 The CICC shall respect the parties' autonomy of will according to law and fully respect the parties' selection of methods for resolving their disputes. | | 第二条 国际商事法庭依法尊重当事人意思自治，充分尊重当事人解决纠纷方式的选择。 |
| Article 3 The CICC shall equally safeguard the lawful rights and interests of Chinese and foreign parties and ensure that Chinese and foreign parties have full access to their litigation rights. | | 第三条 国际商事法庭平等保护中外当事人的合法权益，保障中外当事人充分行使诉讼权利。 |
| Article 4 The CICC shall support acceptance, payment of costs, service, mediation, reviewing case files, evidence exchange, pretrial preparation, and court session via the Internet, so as to facilitate litigation participants in the litigation process. | | 第四条 国际商事法庭支持通过网络方式受理、缴费、送达、调解、阅卷、证据交换、庭前准备、开庭等，为诉讼参加人提供便利。 |
| Article 5 The parties may, through the litigation platform on the official website of the CICC (cicc.court.gov.cn), submit materials to the CICC. If there are any difficulties, a party may submit materials by taking the following methods: | | 第五条 当事人可以通过国际商事法庭官方网站（cicc.court.gov.cn）上的诉讼平台向国际商事法庭提交材料。如确有困难，当事人可以采取以下方式提交材料： |
| (1) by e-mails; | | （一）电子邮件； |
| (2) by mails; | | （二）邮寄； |
| (3) by submission in person; and | | （三）现场提交； |
| (4) by other means as recognized by the CICC. | | （四）国际商事法庭许可的其他方式。 |
| Where a party submits materials by means as prescribed in items (2) and (3) of the preceding paragraph, he or it shall provide as many copies of paper documents and duplicates as there are opposing parties, affixed with CDs or other portable storage devices. | | 通过前款第二项、第三项方式提交的，应提供纸质文件并按对方当事人人数提供副本，附光盘或其他可携带的储存设备。 |
| Article 6 The CICC shall, according to the application of a party, provide him or it with translation and interpretation services, with the costs borne by the party. | | 第六条 国际商事法庭根据当事人的申请，为当事人提供翻译服务，费用由当事人负担。 |
| Article 7 The CICC shall establish a case management office, which is responsible for receiving the parties, accepting and managing cases, coordinating connection between litigation and non-litigation dispute resolution methods such as mediation and arbitration, and managing translation and interpretation, researching extraterritorial laws, and other matters in an overall manner. | | 第七条 国际商事法庭设立案件管理办公室，负责接待当事人，受理和管理案件，协调诉讼与调解、仲裁等诉讼外纠纷解决方式的衔接，统筹管理翻译、域外法律查明等事务。 |
| Chapter II Acceptance | | 第二章 受理 |
| Article 8 Where a plaintiff files a lawsuit with the CICC in accordance with item (1) of Article 2 of the Provisions, he or it shall submit the following materials: | | 第八条 原告根据《规定》第二条第一项向国际商事法庭提起诉讼，应当提交以下材料： |
| (1) a bill of complaint; | | （一）起诉状； |
| (2) the written agreement attorning to the jurisdiction of the Supreme People's Court, the First International Commercial Court, or the Second International Commercial Court; and | | （二）选择最高人民法院或第一国际商事法庭、第二国际商事法庭管辖的书面协议； |
| (3) the identity certificate where the plaintiff is a natural person. Where the plaintiff is a legal person or an unincorporated organization, it shall submit its business license, other registration certificate, or the identity certificate of the legal representative or the person in charge. | | （三）原告是自然人的，应当提交身份证明。原告是法人或者非法人组织的，应当提交营业执照或者其他登记证明、法定代表人或者负责人身份证明； |
| (4) the power of attorney and the identity certificate of the litigation representative where a lawyer or other person is entrusted with serving as a litigation representative; | | （四）委托律师或者其他人代理诉讼的，应当提交授权委托书、代理人身份证明； |
| (5) the relevant evidentiary materials supporting the claims; | | （五）支持诉讼请求的相关证据材料； |
| (6) the Letter of Confirmation of the Service Address that has been filled in; and | | （六）填妥的《送达地址确认书》； |
| (7) the Form of Seeking Comments on Pretrial Diversion Procedures that has been filled in. | | （七）填妥的《审前分流程序征询意见表》。 |
| The certificates as prescribed in items (3) and (4) of the preceding paragraph formed outside the territory of the People's Republic of China shall be notarized or authenticated. | | 前款第三项、第四项规定的证明文件，在中华人民共和国领域外形成的，应当办理公证、认证等证明手续。 |
| Article 9 Upon receipt of the materials submitted by a plaintiff in accordance with Article 8, the CICC shall issue an electronic or paper certificate, where the date of receipt is indicated. | | 第九条 国际商事法庭在接收原告根据第八条提交的材料后，出具电子或纸质凭证，并注明收到日期。 |
| Article 10 Where a higher people's court reports to the Supreme People's Court for trial in accordance with item (2) of Article 2 of the Provisions, it shall state the specific grounds and affix the corresponding documents in the report. Where the Supreme People's Court approves the report, it shall be accepted by the CICC. | | 第十条 高级人民法院根据《规定》第二条第二项报请最高人民法院审理的，在报请时，应当说明具体理由并附有关材料。最高人民法院批准的，由国际商事法庭受理。 |
| Article 11 For a case that is decided by the Supreme People's Court to be tried by the CICC in accordance with items (3) and (5) of Article 2 of the Provisions, the CICC shall accept it. | | 第十一条 最高人民法院根据《规定》第二条第三项、第五项决定由国际商事法庭审理的案件，国际商事法庭应予受理。 |
Article 12 Where a lawsuit meets the requirements as prescribed in Article 119 of the Civil Procedure Law and the plaintiff consents to pretrial mediation in the Form of Seeking Comments on the Pretrial Diversion Procedures that has been filled out, the CICC shall register and number the lawsuit and not charge the case acceptance fee for the time being; if the plaintiff does not consent to pretrial mediation, the case shall be formally docketed.
