《烈士安葬办法》已经2013年4月2日民政部部务会议通过，现予公布，自公布之日起施行。

烈士安葬办法
　　第一条　为了褒扬烈士，做好烈士安葬工作，根据《烈士褒扬条例》，制定本办法。
　　第二条　烈士在烈士陵园或者烈士集中安葬墓区安葬。
烈士陵园、烈士集中安葬墓区是国家建立的专门安葬、纪念、宣传烈士的重要场所。
　　第三条　确定烈士安葬地和安排烈士安葬活动，应当征求烈士遗属意见。
烈士可以在牺牲地、生前户口所在地、遗属户口所在地或者生前工作单位所在地安葬。烈士安葬地确定后，就近在烈士陵园或者烈士集中安葬墓区安葬烈士。
　　第四条　运送烈士骨灰或者遗体（骸），由烈士牺牲地、烈士安葬地人民政府负责安排，并举行必要的送迎仪式。
烈士骨灰盒或者灵柩应当覆盖中华人民共和国国旗。需要覆盖中国共产党党旗或者中国人民解放军军旗的，按照有关规定执行。国旗、党旗、军旗不同时覆盖，安葬后由烈士纪念设施保护单位保存。
　　第五条　烈士安葬地县级以上地方人民政府应当举行烈士安葬仪式。烈士安葬仪式应当庄严、肃穆、文明、节俭。
