| Where an employee of an enterprise with early retirement who is not over the statutory age of retirement works with another employer and accepts management of the employer on the premise that he still maintains labor relation with the former employer, the employment relation of the employee and the new employer is labor relation. Where the employee has a work-related injury accident when he works with the new employer, the new employer is the subject of compensation for work-related insurance liability and it should assume various obligations of compensation for work-related injury benefits. | | 未达到法定退休年龄的企业内退人员，在与原用人单位保留劳动关系的前提下，到另一单位从事劳动、接受管理的，劳动者与新用人单位之间的用工关系为劳动关系。劳动者在新用人单位工作期间发生工伤事故的，新用人单位是工伤保险责任的赔偿主体，应由其承担工伤待遇赔偿的各项义务。 |

| | 原告伏恒生、张正花、伏彩军诉称：三原告亲属伏运山于2006年8月份至被告处从事环卫保洁，2008年12月14日，伏运山在打扫卫生时遭受交通事故受伤。2011年8月30日连云港市人力资源和社会保障局作出了连人社工伤开认字[2011]第98号工伤认定书，认定伏运山受伤部位及伤情为工伤。2012年3月27日，连云港市劳动能力鉴定委员会评定伏运山工伤伤残等级为五级。原告于2013年3月向连云港经济技术开发区劳动争议仲裁委员会提出仲裁申请，仲裁委于2014年9月28日作出第2013-027号终止审理确认书。请求判决被告支付三原告医疗费、住院伙食补助费、护理费等费用及伤残补助金、伤残津贴、工资、一次性医疗补助金、一次性就业补助金合计161 365元，庭审中原告变更要求赔偿项目要求被告赔偿：停工留薪期工资43 700元、一次性伤残补助金24 642元、一次性工伤医疗补助金69119．4元、一次性伤残就业补助金14109元，合计151 570．4元。 |
| | 被告华源公司辩称：伏运山是盐场工人，享有社保，内退期间至被告处工作，被告无法为其交纳社保，原、被告间应属雇佣关系。本起案件已过诉讼时效。 |

| | 连云港市连云区人民法院一审查明： |
| | 2008年12月14日三原告的亲属伏运山在被告华源公司从事工作期间发生交通事故受伤。2009年12月15日，伏运山向连云港经济技术开发区劳动争议仲裁委员会申请劳动仲裁要求确认其与被告间存在劳动关系，该委以2010-023号案件终止审理确认书确认终止该案审理。伏运山不服向法院提起诉讼，连云港市连云区人民法院以(2011)港民初字引104号民事判决书判决伏运山与被告间自2006年8月起至2010年6月止存在劳动关系。且该判决书已经二审维持原判。伏运山于2011年8月30日被连云港市人力资源和社会保障局确认系工伤并经连云港市劳动能力鉴定委员会鉴定为工伤五级。伏运山于2013年3月22日向连云港经济技术开发区劳动争议仲裁委员会申请仲裁要求工伤赔偿，该委于2014年9月28日以第2013-027号案件终止审理确认书终止对该案件审理工作。2013年12月9日伏运山因病死亡。本案在审理过程中，三原告申请变更诉讼主体作为原告参加诉讼。同时查明，伏运山1955年6月23日出生，原告伏恒山系其父亲，原告张正花系其妻子，原告伏彩军系其之子。伏运山因同一起交通事故向侵权人提起民事赔偿，于2009年6月24日评残。连云港市连云区人民法院以(2009)港民一初字第0845号民事判决书确认原告误工期自伤起至评残前一日。 |
