[Judgment Abstract] [裁判摘要]
In accordance with the provisions of the Property Law of the People's Republic of China, in principle, any alteration of a real property right shall be based on the validity requirement of registration. The agreement of both spouses on the ownership of a real estate in the Divorce Agreement concluded by and between them does not directly have the effect of property right alteration. Based on the right of obligatory claim, one party may claim that the other party should perform the contractual obligation of registering the altered house ownership. Under the circumstance where the owner of a real estate fails to make alteration according to the law, the provisions on the ownership of the real estate in the Divorce Agreement do not have the legal effect against the creditor's right of a third party. 根据我国《物权法》规定,不动产物权变动原则上以登记完成为生效要件。夫妻双方签订的离婚协议中对不动产归属的约定并不直接发生物权变动的效果,一方仅可基于债权请求权向对方主张履行房屋产权变更登记的契约义务。在不动产产权人未依法变更的情况下,离婚协议中关于不动产归属的约定不具有对抗外部第三人债权的法律效力。

BASIC FACTS

 原告付金华与被告吕秋白、第三人刘剑锋发生案外人执行异议纠纷,向上海市第一中级人民法院提起诉讼。
 原告付金华诉称:原告与第三人刘剑锋于1989年10月登记结婚,婚后于2000年购买了本市松江区中山二路X弄X号X室房屋(以下简称中山二路房屋)、于2003年购买了本市松江区北翠路X弄X号房屋(以下简称北翠路房屋)。双方于2007年10月29日登记离婚,在离婚协议中约定,该二处房屋的所有权均归原告所有。但两人为减少按揭贷款转贷手续费和缓缴交易契税,暂未办理不动产变更过户手续。原告离婚后一直居住于上述中山二路房屋中。因第三人与被告吕秋白于2012年发生股权转让纠纷并诉至法院,被告依据生效的法律文书(2012)沪一中民四(商)初字第S51号民事判决向法院申请执行,法院查封了登记于该案被执行人刘剑锋名下的中山二路房屋及登记于原告和第三人名下的北翠路房屋。原告就此查封向该案执行部门提出执行异议,被裁定驳回。原告认为,尽管上述房屋的所有权尚未变更登记至原告一人名下,但已有充分证据证明原告对上述二处房产有合法物权。第三人对被告的债务是其与原告离婚后所发生的个人债务,原告仅是该执行案件的案外人。故请求法院判令:一、确认上海市松江区中山二路房屋、上海市松江区北翠路房屋的所有权属于原告;二、解除对前述两房地产的司法查封,停止对该房地产的执行。
 被告吕秋白辩称:原告付金华和第三人刘剑锋在离婚协议中的约定不能对抗物权法9条和14条的规定。房产权利人要以登记为准,不能因当事人的私自约定而改变。故不同意原告的诉讼请求。
