| [Basic Facts] The People's Government of Dingqi Township used the mountainous lot with the surface area of about 5 mu behind the land occupied by the former Longyan aircraft factory located in the junction of Zhenning Buyi and Miao Autonomous County (hereinafter referred to as “Zhenning County”) and Liuzhi Special District of Liupanshui City as the temporary yard for dumping household garbage of Dingqi Township. The Villagers' Committee of Longtan Village within the jurisdiction also organized the centralized dumping of household garbage of this Village near the yard. In November 2015, the People's Procuratorate of Liuzhi Special District of Liupanshui City issued a written procuratorial proposal to the People's Government of Dingqi Township and proposed that the People's Government of Dingqi Township should clear all dumped garbage within one month and restore the lot to its original state, and the Villagers' Committee of Longtan Village should cease the dumping of garbage. Since the People's Government of Dingqi Township failed to make a reply within the prescribed time limit, as the public interest litigant, the People's Procuratorate of Liuzhi Special District filed an administrative public interest litigation and requested the People's Court of Qingzhen City, Guizhou Province to confirm that defendant's administrative act of failing to select a site for the garbage yard in accordance with the legal provisions was illegal; order that defendant should perform its statutory duties and the Villagers' Committee of Longtan Village within its jurisdiction should cease the dumping of garbage to this lot; and order that defendant should take remedial measures, clear garbage in this lot, and restore the lot to the original state. In February 2016, the People's Government of Dingqi Township issued a notice to the Villagers' Committee of Longtan Village to prohibit Longtan Village from dumping garbage and the Villagers' Committee of Longtan Village should organize personnel and vehicles to complete the garbage clearance in the temporary yard. | | 【基本案情】丁旗镇政府将位于贵州省镇宁县与六枝特区交界处的原龙岩飞机制造厂用地后山地块约5亩场地作为丁旗镇生活垃圾临时堆放场，其辖区内的龙滩村村委会也组织将该村生活垃圾集中倾倒至垃圾堆放场附近。2015年11月，六盘水市六枝特区人民检察院向丁旗镇政府发出检察建议书，建议丁旗镇政府在一个月内将倾倒的垃圾清理完毕，并恢复地块原状，责令龙滩村村委会停止垃圾倾倒。因丁旗镇政府未按期进行回复，六枝特区人民检察院作为公益诉讼人提起行政公益诉讼，请求确认被告未依照法律规定选址垃圾堆放场的行政行为违法；判令被告履行法定职责，责令其辖区内的龙滩村村委会停止在该地块倾倒垃圾；判令被告采取补救措施，将该地块的垃圾清除，恢复该地块原状。2016年2月，丁旗镇政府向龙滩村村委会发出通知，禁止该村倾倒垃圾，并组织人员、车辆将临时堆放场的垃圾清运完毕。 |
| ．．．．．． | | 【裁判结果】清镇市人民法院一审认为，丁旗镇政府选址堆放该镇生活垃圾的行为，是其实施社会管理和公共服务职能的行为，但其选址未经环境卫生行政主管部门指定，垃圾堆放场亦未采取防扬散、防渗漏、防流失、防雨等防治措施，造成较严重的环境污染。公益诉讼人在发现违法行为后，向丁旗镇政府发出检察建议，但丁旗镇政府并未积极进行整改，在本案审理过程中，丁旗镇政府才履行其管理职能将垃圾清运，但还未达到使生态环境明显改善的效果。由于本案受理后，丁旗镇政府已向其辖区内的龙滩村村委会下达通知，禁止该村在该地块倾倒垃圾并将原有垃圾清理覆土，一审法院遂判决确认丁旗镇政府选址垃圾堆放场的行政行为违法；限丁旗镇政府按照专家意见及建议继续采取补救措施，确保该区域生态环境明显改善；驳回公益诉讼人的其他诉讼请求。宣判后，双方当事人均未上诉，一审判决已生效。 |
