1. Where an operator fails to specify restrictive conditions for certain product or service in a standard contract and fails to prove that it has expressly informed a consumer of such restrictive conditions at the time of concluding the contract and has obtained consent of the consumer, such restrictive conditions are not binding upon the consumer. 1.经营者在格式合同中未明确规定对某项商品或服务的限制条件,且未能证明在订立合同时已将该限制条件明确告知消费者并获得消费者同意的,该限制条件对消费者不产生效力。
2. Where, at the time of concluding a contract, a telecommunications service enterprise fails to notify a consumer that restriction of validity term is set on certain service and in the performance of the contract, the telecommunications service enterprise restricts or terminates the service for the consumer on the ground that the service exceeds the validity term, such act constitutes breach of contract and the telecommunications service enterprise shall assume liability for breach of contract. 2.电信服务企业在订立合同时未向消费者告知某项服务设定了有效期限限制,在合同履行中又以该项服务超过有效期限为由限制或停止对消费者服务的,构成违约,应当承担违约责任。

Basic Facts 基本案情
On November 24, 2009, plaintiff Liu Chaojie applied for handling an “Easyown Standard Card” at the business hall of defendant, Xuzhou Branch of CMCC Jiangsu Co., Ltd. (hereinafter referred to as "Xuzhou Branch”), with the mobile phone number of 1590520xxxx and the payment method of prepayment. Plaintiff prepaid 50 yuan for call charges on the spot and participated in the activity of “Charge 50 yuan and You Will Get 100 yuan” organized by Xuzhou Branch. In the Subscription Service Agreement between CMCC and Customers annexed to the business acceptance form, both parties set forth their rights and obligations. In particular, Article 1 in partIV Assumption of Liabilities under Special Circumstances provides that “Under any of the following circumstances, Party B shall have the right to suspend or restrict mobile communication services for Party A and Party B shall assume no liability for losses caused to Party A: (1) The bank account of Party A is sealed up or frozen, or the deduction is unsuccessful at the time of settlement due to such non-Party B's reasons as the sealing-up, freezing, and insufficient balance of Party A's bank account; (2) The call charges prepaid by Party A are used up and Party A fails to supplement call charges (including that the balance in the prepayment account is insufficient to deduct the subsequent pre-paid call charges) in a timely manner.

 2009年11月24日,原告刘超捷在被告中国移动通信集团江苏有限公司徐州分公司(以下简称移动徐州分公司)营业厅申请办理“神州行标准卡”,手机号码为1590520xxxx,付费方式为预付费。原告当场预付话费50元,并参与移动徐州分公司充50元送50元的活动。在业务受理单所附《中国移动通信客户入网服务协议》中,双方对各自的权利和义务进行了约定,其中第四项特殊情况的承担中的第1条为:在下列情况下,乙方有权暂停或限制甲方的移动通信服务,由此给甲方造成的损失,乙方不承担责任:(1)甲方银行账户被查封、冻结或余额不足等非乙方原因造成的结算时扣划不成功的;(2)甲方预付费使用完毕而未及时补交款项(包括预付费账户余额不足以扣划下一笔预付费用)的。
