In the trial of a case concerning compulsory medical treatment, whether respondent or defendant “is possible to continue to endanger the society” shall be comprehensively determined based on the type and symptom of mental disorder of respondent or defendant, whether respondent or defendant has recovered at the time of trial of the case, and whether family members or guardians of respondent or defendant have the intention and capabilities of strictly guarding and voluntarily sending respondent or defendant for medical treatment. When necessary, the relevant institution or expert may be authorized to conduct the evaluation. 审理强制医疗案件,对被申请人或者被告人是否“有继续危害社会可能”,应当综合被申请人或者被告人所患精神病的种类、症状,案件审理时其病情是否已经好转,以及其家属或者监护人有无严加看管和自行送医治疗的意愿和能力等情况予以判定。必要时,可以委托相关机构或者专家进行评估。

Basic Facts 基本案情
In the second half of 2007, respondent Xu Jiafu started to suffer from mental disorder with such symptoms as hearing sounds out of the void, believing that others were discussing about him and someone intended to kill him, being sleepless at night for tension and fear, carrying knives at any time for self-defense, and eluding in other places. Since Xu Jiafu did not receive medical treatment, his conditions got worsened. Around 4:00 a.m. on November 18, 2012, respondent “heard” that someone came to kill him by driving in the habitual residence and thus he carried a knife and a hammer to go outside with the intention of collision and suicide. After knowing that respondent was to go outside to collide with a car and commit suicide, the gatekeeper in the residence, Zhang Youfa did not open the gate for him. Seeing that the victim had one mobile phone in hand, respondent believed that the victim intended to call others to harm him. Respondent at once stabbed the victim's body with the knife he carried and beat the victim's head with the hammer, causing the victim's death on the spot. It was found upon forensic identification that there was a blunt attack on the head of the victim, causing his death due to serious craniocerebral injury.

 被申请人徐加富在2007年下半年开始出现精神异常,表现为凭空闻声,认为别人在议论他,有人要杀他,紧张害怕,夜晚不睡,随时携带刀自卫,外出躲避。因未接受治疗,病情加重。2012年11月18日4时许,被申请人在其经常居住地听到有人开车来杀他,遂携带刀和榔头欲外出撞车自杀。其居住地的门卫张友发得知其出去要撞车自杀,未给其开门。被申请人见被害人手持一部手机,便认为被害人要叫人来对其加害。被申请人当即用携带的刀刺杀被害人身体,用榔头击打其的头部,致其当场死亡。经法医学鉴定,被害人系头部受到钝器打击,造成严重颅脑损伤死亡。
