北京二中院判决丛李松诉慈铭公司潘家园门诊部产品销售者责任纠纷案

 ——消费动机不影响消费者依法维权

 裁判要旨
 生活消费区分于生产消费,是一种客观判断,法院不应将消费者在购物时的主观消费动机作为生活消费的考量因素。消费动机不影响消费者依法维权。
 案情
 原告丛李松于2012年6月在北京慈铭健康体检管理集团股份有限公司北京潘家园门诊部(以下简称潘家园门诊部)购买了“神麒口服液(消癌平口服液)”,潘家园门诊部在广告中夸大药品的适应症和功效,严重误导和欺骗消费者。故起诉要求被告潘家园门诊部退还货款450元,赔偿450元,并赔偿精神损失费1元。
 被告潘家园门诊部辩称,消癌平口服液是合法合格药品。丛李松不是消费者。
 北京市药品监督管理局于2012年3月发布的《违法药品广告公告》载明,神麒口服液含夸大药品适应症、有不科学地表示功效的保证等内容,严重误导和欺骗消费者。丛李松称其购买消癌平口服液的原因是其婶张春玲患有癌症,所购药品已被张春玲服用。
 裁判
 北京市朝阳区人民法院经审理,以无法确信丛李松消费者身份为由,判决驳回丛李松的全部诉讼请求。
 丛李松不服,提起上诉。北京市第二中级人民法院经审理后认为,丛李松属于消费者,判决撤销原判,判令潘家园门诊部退还丛李松货款450元,并赔偿丛李松450元。
