| On September 27, 2011, Qi Laifa and Jinan Long Distance Coach Transport Co., Ltd. signed an agreement on the contracted operation of Coach No. Lu A48307 from Jinan to Jiaoyu. On November 9, 2012, Qi Laifa mailed an application to the Road Transport Bureau of the Transport Department of Shandong Province (hereinafter referred to as the “Bureau”), in which he requested, because he believed that Coach No. Lu S30886 (hereinafter referred to as the “Coach”) operated additional routes without authorization and infringed upon his business route, that the act of operating additional routes without authorization be investigated and punished in accordance with the law, the Coach's occupation of his route be prohibited, and the road transport business permit of the Coach's operator be revoked. The Bureau did not reply after it received the application. | | 2011年9月27日，齐来发与济南长途汽车运输有限责任公司签订协议，承包鲁A48307号客车，营运路线为济南至角峪。2012年11月9日，齐来发向山东省交通运输厅道路运输局邮寄申请，认为鲁S30886号客车超线路经营，侵占了其营运路线，要求：依法查处该车超线路经营行为；禁止该车侵占其路线营运；吊销客运经营者的道路运输经营许可证。该局收到申请后，一直未作出答复。 |

| | 济南市市中区人民法院一审认为，根据道路运输管理条例有关规定，客运经营者不按规定路线行驶的，由县级以上道路运输管理机构进行查处，情节严重的，由原许可机关吊销道路运输经营许可证。本案中，山东省交通厅道路运输局是鲁S30886客车道路运输经营许可证的发证机关，齐来发认为上述客车不按规定路线行驶，应当向县级道路运输管理机构投诉举报，县级道路运输管理机构认定违法情节严重的，才转交山东省交通厅道路运输局处理。齐来发以自我认定鲁S30886客车违法情节严重，要求省级道路运输主管部门处理，不符合上述级别管辖规定，应予驳回。 |
