Where vessels involved failed to intersect according to the rules as set forth in the International Regulations for Preventing Collisions at Sea, 1972 during voyage, after a collision accident occurred, the content agreed upon by both parties and the circumstances where vessels involved violated the agreement when such collision accident occurred should not serve as major basis for the people's court to determine liabilities of both parties. The people's court shall determine the accident liabilities according to the said Regulations and on the basis of comprehensive analysis on reasons for forming such close-quarters situation, faults of both vessels involved, and appropriateness of disposal measures.         航行过程中,当事船舶协商不以《1972年国际海上避碰规则》确立的规则交会,发生碰撞事故后,双方约定的内容以及当事船舶在发生碰撞事故时违反约定的情形,不应作为人民法院判定双方责任的主要依据,仍应当以前述规则为准据,在综合分析紧迫局面形成原因、当事船舶双方过错程度及处置措施恰当与否的基础上,对事故责任作出认定。

 基本案情
 2008年6月3日晚,原告江苏炜伦航运股份有限公司所有的“炜伦06”轮与被告米拉达玫瑰公司所有的“MIRANDA ROSE”轮(以下简称“玫瑰”轮)在各自航次的航程中,在上海港圆圆沙警戒区相遇。当日23时27分,由外高桥集装箱码头开出的另一艘外轮“里约热内卢快航”轮与“玫瑰”轮联系后开始实施追越。23时32分,“里约热内卢快航”轮引航员呼叫“炜伦06”轮和位于“炜伦06”轮左前方约0.2海里的“正安8”轮,要求两轮与其绿灯交会。“正安8”轮予以拒绝并大角度向右调整航向,快速穿越到警戒区北侧驶离。“炜伦06”轮则在“里约热内卢快航”轮引航员执意要求下,同意绿灯交会。“玫瑰”轮随即与“炜伦06”轮联系,也要求绿灯交会,“炜伦06”轮也回复同意。23时38分,当“炜伦06”轮行至“玫瑰”轮船艏偏左方向,发现“玫瑰”轮显示红灯,立即联系“玫瑰”轮,要求其尽快向左调整航行。“炜伦06”轮随后开始减速,但“玫瑰”轮因“里约热内卢快航”轮追越尚未驶过让清,距离较近,无法向左调整航向。23时41分,“炜伦06”轮与“里约热内卢快航”轮近距离交会,位于“玫瑰”轮左前方、距离仅0.2海里。此时,“炜伦06”轮、“玫瑰”轮均觉察危险,同时大角度向左转向。23时42分“炜伦06”轮右后部与“玫瑰”轮船艏右侧发生碰撞。事故造成原告遭受救助费、清污费、货物减损费、修理费等各项损失共计人民币4504605.75元。
