1. Basic Facts 基本案情
The land under dispute in this case was originally owned by Wuhan Hanqiao Zhongxing Group Co., Ltd. (hereinafter referred to as “Hanqiao Zhongxing Group”). In 1996, Hanqiao Zhongxing Group leased the buildings on the land under dispute to Wuhan Huazhen Pharmaceutical Co., Ltd. (hereinafter referred to as “Huazhen Company”). After having gone through the relevant formalities, Huazhen Company obtained a License for State-owned Land Use (No. 2732 [2004], Land and Resources Bureau, Wuhan). On November 21, 2004, Hanqiao Zhongxing Group, in the name of Huazhen Company, entered into a Land Transfer Agreement with Wuhan Jinfu Properties Co., Ltd. (hereinafter referred to as “Jinfu Company”). On December 29, 2004, the People's Government of Wuhan City revoked the License for State-owned Land Use (No. 2732 [2004], Land and Resources Bureau, Wuhan) and issued a License for State-owned Land Use (No. 2910 [2004], Land and Resources Bureau, Wuhan) to Jinfu Company on December 30. It was identified afterwards that both the seal of Huazhen Company and the signature of "Qian Weiguo," legal representative of Huazhen Company, submitted by Jinfu Company for the issuance of a license upon application were inconsistent with those as kept by the administrative department of industry and commerce. On February 1, 2007, upon application of Jinfu Company, the People's Government of Wuhan City changed the use purpose of the land under dispute and registered it as urban mixed residential land from the original industrial land. Upon announcement on land-use change by the land and resources department on February 10, the People's Government issued a License for State-owned Land Use (No. 162 [2007], Land and Resources Bureau, Wuhan) to Jinfu Company on March 12, 2007. Against the revocation of the License for State-owned Land Use (No. 2732 [2004], Land and Resources Bureau, Wuhan) and the issuance of the License for State-owned Land Use (No. 2910 [2004], Land and Resources Bureau, Wuhan) and the License for State-owned Land Use (No. 162 [2007], Land and Resources Bureau, Wuhan) by the People's Government of Wuhan City and the Land and Resources Bureau of Wuhan City, Huazhen Company filed an administrative action on January 2, 2008.

 本案争议土地原系武汉市汉桥中兴集团所有,1996年其将土地上所建房屋出租给华珍公司使用。华珍公司补办相关手续后,取得武国用(2004)2732号《国有土地使用证》。2004年l1月21日,汉桥中兴集团又以华珍公司的名义与金福公司签订了《土地转让协议书》。武汉市人民政府于2004年12月29日注销了武国用(2004)2732号《国有土地使用证》,并于同月30日向金福公司颁发了武国用(2004)第2910号《国有土地使用证》。 事后经鉴定证明金福公司申请颁证时提交华珍公司的印章及其法定代表人“钱卫国”的签名均与在工商管理部门留存的不同。2007年2月1日,经金福公司申请,武汉市人民政府将争议土地用途由原来的工业用地变更登记为城镇混合住宅用地。2月10日,经国土部门公告后,武汉市人民政府于2007年3月12日向金福公司颁发武国用(2007)第162号《国有土地使用证》。华珍公司对武汉市政府、武汉市国土局注销武国用(2004)2732号《国有土地使用证》及颁发武国用(2004)第2910号《国有土地使用证》和武国用(2007)第162号《国有土地使用证》的行为不服,于2008年1月2日提起行政诉讼。
