| | 2013年4月16日，鼎峰公司因铁路修建合同纠纷将中铁十局公司诉至太原铁路运输中级法院(以下简称太原铁路中院)，请求：一、判令中铁十局公司偿还鼎峰公司多支付的工程款64 800 276．86元；二、判令中铁十局公司支付鼎峰公司违约金18 000 000．00元；三、判令中铁十局公司支付逾期付款违约金；四、判令中铁十局公司开具1600万元的工程发票；五、判令中铁十局公司承担本案全部诉讼费用。中铁十局公司在超过答辩期后向一审法院提出管辖权异议，认为：一、本案诉讼标的额在8000万元以上，且中铁十局公司住所地不在山西省辖区，依法属于山西省高级人民法院管辖的第一审民事案件，太原铁路中院对本案没有管辖权。二、依据涉案《建设施工合同》的管辖约定，无法确定唯一的管辖法院，故该管辖约定不明确，无效。本案应当按照一般地域管辖原则，由被告住所地或者合同履行地法院管辖，请求将本案移送至被告住所地的山东省高级人民法院管辖。 |
| | 太原铁路中院一审认为：中铁十局公司在法律规定的期间内没有向该院提出管辖权异议，并申请该院调查取证、延期举证，应视为其承认该院有管辖权。本案所涉工程是国家铁路朔准线的附属设施，根据最高人民法院《关于铁路运输法院案件管辖范围的若干规定》第三条第六项的规定，本案应由铁路运输法院专门管辖。本案工程施工现场(合同履行地)在太原铁路局业务管辖范围，双方均在施工现场设立了办事机构，且中铁十局公司准格尔旗煤炭集运站铁路专用线工程项目经理部在当地准旗铁路项目管理办公室作过备案，应视为原、被告所处铁路法院同一辖区。根据山西省高级人民法院晋高法[2008]5号文件规定，该院可受理1亿元以下一审案件，故太原铁路中院对该案有管辖权且并不违反级别管辖和地域管辖。中铁十局公司认为其住所地、合同履行地不在太原铁路中院管辖区认识有误，该院不予支持。裁定：驳回中铁十局公司对本案管辖权提出的异议。 |
