 ——产品理念性广告用语不构成虚假宣传

 裁判要旨
 我国相关法律仅对产品本身的宣传有法律界定,但对产品理念性宣传却没有统一规范,健康理念性宣传用语也不构成虚假宣传。
 案情
 2012年8月6日,河南省南阳市的燕丽女士在南阳市禄康源百货有限公司(以下简称禄康源公司)购买了由农夫山泉股份有限公司(以下简称农夫山泉公司)生产的“东方树叶”茉莉花茶原味茶饮料8瓶,货款共计28元。该产品外包装上标注有“上品饮茶 极品饮花”一词,作为产品宣传用语。燕丽和朋友饮用后,未见任何明显效果,认为“东方树叶”茉莉花茶所宣称的“上品饮茶 极品饮花”是农夫山泉的虚假宣传,给自己的消费造成了误导,从而导致自己购买了该产品,造成损失。燕丽遂向南阳市宛城区人民法院提起诉讼,请求法院判令二被告停止虚假宣传,向消费者公开赔礼道歉;判令被告禄康源公司退还货款28元;判令被告农夫山泉公司赔偿原告28元;诉讼费用由二被告承担。
 裁判
 宛城法院经审理认为,原告购买被告方生产经营的“东方树叶”茉莉花茶原味茶饮料8瓶,属正常的商品买卖合同行为。原告没有证据证明二被告生产、销售的“东方树叶”茉莉花茶原味茶饮料有产品质量问题和保管、销售的过错,其要求退回货款和赔偿损失无事实和法律依据,该项请求不予支持。所谓“上品饮茶 极品饮花”是人类对于健康生活的主观追求和向往,该词句没有绝对性、特定性、唯一性、排他性,不属于有关法律所禁止的绝对化用语,被告方在产品包装上使用该词句并无不当,不构成引人误解的虚假宣传。原告和朋友已经饮用、消费该产品,没有任何客观的违法后果,原告的赔偿请求也没有事实及法律依据,法院不予支持。
