1. In an application for the establishment of the fund for limitation of liability for maritime claims, a people's court shall conduct a procedural review only on the qualification of the applicant, the nature of claims involved in the accident, and the amount of that fund to be established. Such problems as whether the applicant in substantiality shall enjoy the limitation of liability for maritime claims and whether there are other claims not subject to limitation co-existing with the claims subject to limitation involved in the accident do not affect the court's ruling on approving the establishment of the fund for limitation of liability for maritime claims. ⒈ 对于申请设立海事赔偿责任限制基金的,法院仅就申请人主体资格、事故所涉及的债权性质和申请设立基金的数额进行程序性审查。有关申请人实体上应否享有海事赔偿责任限制,以及事故所涉债权除限制性债权外是否同时存在其他非限制性债权等问题,不影响法院依法作出准予设立海事赔偿责任限制基金的裁定。
2. The “ship engaging in shipping between ports of the People's Republic of China” as mentioned in paragraph 2, Article 210 of the Maritime Law of the People's Republic of China shall be interpreted as a ship that is engaging in shipping between ports of the People's Republic of China in the voyage in which an accident occurs. ⒉《中华人民共和国海商法》第二百一十条第二款规定的“从事中华人民共和国港口之间的运输的船舶”,应理解为发生海事事故航次正在从事中华人民共和国港口之间运输的船舶。

Basic Facts 基本案情
On May 23, 2008, “Ning'an 11” owned by China Shipping Development Co., Ltd. Freighter Company (hereinafter referred to as “Freighter Company”) left Qinhuangdao for Shanghai Waigaoqiao port by carrying power generation coal, and on May 26, it collided with No. 2 ship unloader of the port during its mooring, which caused damage to both the port and machines. Then on March 9, 2009, Freighter Company filed an application with the Shanghai Maritime Court for the establishment of the fund for limitation of liability for maritime claims. Freighter Company applied for the establishment of the fund for limitation of liability for maritime claims other than those for loss of life or personal injury, whose amount was 2,242,643 calculation units (converted to 25,442,784.84 yuan) and the interest accrued from the date of the accident and the date of the establishment of the fund. 中海发展股份有限公司货轮公司(以下简称货轮公司)所属的“宁安11”轮,于2008年5月23日从秦皇岛运载电煤前往上海外高桥码头,5月26日在靠泊码头过程中触碰码头的2号卸船机,造成码头和机器受损。货轮公司遂于2009年3月9日向上海海事法院申请设立海事赔偿责任限制基金。货轮公司申请设立非人身伤亡海事赔偿责任限制基金,数额为2242643计算单位(折合人民币25442784.84元)和自事故发生之日起至基金设立之日止的利息。
Shanghai Waigaoqiao Power Generation Co., Ltd. and Shanghai Waigaoqiao No. 2 Power Generation Co., Ltd., as primary opponents, and seven opponents including PICC Property & Casualty Co., Ltd. (PICCP&C) Shanghai Branch, China Continent Property & Casualty Insurance Company Ltd. Shanghai Branch, Ping An Property & Casualty Insurance Company of China,Ltd. Shanghai Branch, Ancheng Property & Casualty Insurance Co., Ltd. Shanghai Branch, China Pacific Property & Casualty Insurance Co., Ltd. Shanghai Branch, Business Department of China Continent Property & Casualty Insurance Company, and Yongcheng Property & Casualty Insurance Co., Ltd. Shanghai Branch, as secondary opponents, filed written objections to the aforesaid application of Freighter Company with the Shanghai Maritime Court, respectively. On May 27, 2009, the Shanghai Maritime Court convened a public hearing for this application and objections. 上海外高桥发电有限责任公司、上海外高桥第二发电有限责任公司作为第一异议人,中国人民财产保险股份有限公司上海市分公司、中国大地财产保险股份有限公司上海分公司、中国平安财产保险股份有限公司上海分公司、安诚财产保险股份有限公司上海分公司、中国太平洋财产保险股份有限公司上海分公司、中国大地财产保险股份有限公司营业部、永诚财产保险股份有限公司上海分公司等7位异议人作为第二异议人,分别针对货轮公司的上述申请,向上海海事法院提出了书面异议。上海海事法院于2009年5月27日就此项申请和异议召开了听证会。
The primary opponents argued that: “Ning'an 11” should take full responsibility for the accident because the accident occurred due to improper operations of the vessel's captain; therefore, the applicant had no right to enjoy the limitation of liability for maritime claims. “Ning'an 11” was a vessel capable of engaging in international ocean shipping other than a vessel engaging in cargo shipping between Chinese ports. The limitation as provided in item (2), paragraph 1, Article 210 of the Maritime Law of the People's Republic of China (hereinafter referred to as the “Maritime Law”) other than that as specified in Article 4 of the Provisions Concerning the Limitation of Liability for Maritime Claims for Ships With a Gross Tonnage Not Exceeding 300 Tons and Those Engaging in Coastal Transport Services As Well As Those for Other Coastal Operations (hereinafter referred to as the "the Provisions on the Limitation of Vessel Claims") should apply.

 第一异议人称:“宁安11”轮系因船长的错误操作行为导致了事故发生,应对本次事故负全部责任,故申请人无权享受海事赔偿责任限制。“宁安11”轮是一艘可以从事国际远洋运输的船舶,不属于从事中国港口之间货物运输的船舶,不适用交通部《关于不满300总吨船舶及沿海运输、沿海作业船舶海事赔偿限额的规定》(以下简称《船舶赔偿限额规定》)第四条规定的限额,而应适用《中华人民共和国海商法》(以下简称《海商法》)第二百一十条第一款第(二)项规定的限额。
