Under Article 286 of the Criminal Law ofthe People's Republic of China, where anyone, in violation of national laws and regulations, deletes, alters, adds or interferes with the functioning of a computer information system, or who deletes, alters or adds to the data stored,processed or transmitted by or applications of the computer information system,or who intentionally produces or transmits a computer virus or other destructive programs, causing the the computer information system to be unable to function normally, and the consequences are serious, it constitutes the crime of sabotaging a computer information system. | |
根据《中华人民共和国刑法》第二百八十六条的规定，违反国家规定，对计算机信息系统功能进行删除、修改、增加、干扰或者对计算机信息系统中存储、处理或者传输的数据和应用程序进行删除、修改、增加的操作或者故意制作、传播计算机病毒等破坏性程序，造成计算机信息系统不能正常运行，后果严重的，构成破坏计算机信息系统罪。 |
The offenders, in violation of national regulations, used disruptive technology to attack and hijack the public domain name servers of internet operators, added instructions to the domain nameservers, embedded Trojan viruses into a large number of computer information systems of individuals and caused the computer information system to be unable to function normally, with the circumstances being serious, thus the offenders shall be convicted and punished for the crime of sabotaging a computer information system. | |

江苏省无锡市滨湖区人民检察院以被告人马志松、彭旭、唐嵩钧、马志强、柳绪刚、补勇犯破坏计算机信息系统罪，向江苏省无锡市滨湖区人民法院提起公诉。 |
The bill of indictment said that: From the end of September to mid November 2007, the defendants, Ma Zhisong, Peng Xu, Ma Zhiqiang, Liu Xugang, Tang Songjun and Bu Yong conspired to steal the information of online game accounts of internet users, used the domain name server hijacking programs to attack and hijacked a total of 27 domain name servers in more than 10 provinces and cities, including Shanghai, Chongqing and Yanzhou, which caused the internet user' wrongly redirected to the servers infected with 17 online game Trojan viruses preset by Ma Zhisong, et al in Wuxi when internet users visited the homepage of the mini-network of Tencent Company, and resulted in their computers being affected with Trojan viruses. Due to the hijacking attacks of Ma Zhisong, et al, Tencent Company was forced to temporarily close the homepage of its mini-network, the computer information system of the mini-network and the QQ terminus of Tencent Company were thus unable to operate normally, and a direct economic loss incurred to Tencent Company was RMB 100,800 yuan. Such conduct of Ma Zhisong, et al had constituted the crime of sabotaging computer information system and they should be punished in accordance with law. | |

The public domain name servers of internet operators are an important infrastructure facility of China's internet. The role of a domain name server is to match the websites and the corresponding IP addresses so as to enable internet users visit a corresponding website through inputting the address thereof, that is, the work of the domain name server is a necessary step for internet users to visit websites. | |
互联网运营商的公共域名服务器是我国互联网的重要基础设施。域名服务器的作用是对网站和其对应的IP地址进行解析，使互联网用户通过输入网址访问到相应的网站，即域名服务器的解析是互联网用户访问网站的必要步骤。 |
In July 2007, Ma Zhisong, the defendant, learned from somebody else that the information of online game accounts of other people may be stolen through hijacking domain name servers. Having mastered the principles of domain name server hijacking, Ma Zhisong, together with Peng Xu, a co-defendant, studied the specific methods for hijacking domain name servers. In August the same year, Peng Xu worked out hijacking programs of domain name servers according to the requirements and ideas of Ma Zhisong. Ma decided to deceive internet users through hijacking domain name servers, misguide the domain name servers to redirect website visitors to servers he set up carrying a lot of online game Trojan viruses (Trojan is a remote monitoring program which is used to collect the internet information and keyboard operation of users and transmit them remotely) so as to steal the information of online game accounts of visitors. In September the same year, Ma Zhisong told Bu Yong, Ma Zhiqiang, Liu Xugang and others of such intention of his and Bu Yong contributed RMB 4,000 yuan, Ma Zhiqiang and Liu Xugang contributed RMB 18,000 yuan each for renting office space, computers, servers, etc. for committing the crime. Ma Zhiqiang rented 8 servers from the Wuxi Telecom Dafu IDC Computer Room by means of webhosting the mini-network of Tencent Company passed off by Ma Zhisong and 17 kinds of Trojan viruses collected by Ma Zhiqiang and Liu Xugang for stealing domestic online game accounts. At the beginning of October 2007, Ma Zhisong approached Tang Songjun, another co-defendant, through internet, and had him work out programs for collecting domain name server addresses in all localities, optimize and revise the Trojan programs he had downloaded and work out the kill-free programs for the Trojan viruses in web page, for the purpose of hijacking domain name servers. | |
2007年7月，被告人马志松获悉可以通过劫持域名服务器的方法盗取他人的网络游戏账号信息并掌握了劫持域名服务器的原理，随后，马志松与被告人彭旭一起研究、学习劫持域名服务器的具体方法。同年 8月，彭旭按照马志松的要求和思路编写出域名服务器的劫持程序，马志松遂准备采用劫持域名服务器的方法欺骗互联网用户，使域名服务器错误解析从而指向到其设置的携带多种网络游戏木马(一种远程监控软件，用于搜集用户的上网信息及键盘操作，并进行远程传送)的服务器上，以达到盗取用户网络游戏账号信息的目的。同年9月，马志松将上述意图告知被告人补勇、马志强、柳绪刚等人，并由补勇出资人民币4000元，马志强、柳绪刚各出资人民币18 000元，用于租用作案用的出租房、电脑以及服务器等。马志强还通过互联网租用了无锡电信大浮IDC机房8台服务器，用于存放由马志松伪造的腾讯公司迷你网首页和由马志强、柳绪刚收集到的 17种用于盗取国内网络游戏账号的木马。 2007年10月初，马志松通过网络联系了被告人唐嵩钧，让唐嵩钧为其编写了收集各地域名服务器地址的程序以及优化修改下载的木马程序和编写网页木马的免杀程序，用于劫持域名服务器。 |
From the end of September to mid November 2007, Ma Zhisong, et al attacked and hijacked in Chengdu a total of 27 domain name servers in more than 10 provinces and cities, including Shanghai, Chongqing and Yangzhou, with the hijacking programs, resulting in directing visitors to the homepage of the mini-network of Tencent Company to the servers carrying 17 Trojan viruses that had been set up in Wuxi city by Ma Zhisong, et al in advance, and resulting in their computers' affection with the Trojan viruses.
