On June 5,2003,Suqian Municipal Construction Bureau made the decision (Letter of Decision No. 26 [2003] of Suqian Municipal Construction Bureau)on the housing demolishment dispute, the main contents of which were: 1. The dismantlee Song Lili shall complete the demolishment within 15 days from the day when the letter of decision took effect; 2. The compensations for resettlement (including compensation for demolishment, expenses for removal, fees for the auxiliary facilities and decoration and upholstery, subsidies for temporary resettlement, and fees for the loss from stopping business operations) totaled to 685651.88 Yuan; 3. Wanxing Company shall, after completing the construction of the project of China Trade Shopping Mall, provide a house situated in the shopping mall project (the area shall equal to that of the dismantled house), if the dismantler exchanges the house, the price shall be based on the market evaluation price; and 4. Wanxing Company shall arrange a set of transition house for the temporary residence of the dismantlee. Song was not satisfied with the decision, and brought an administrative action. On September 4, 2003, she brought a lawsuit to People's Court of Sucheng District, Suqian City, Jiangsu Province, requesting to revoke the decision.@#

2003年6月5日,宿迁市建设局作出宿建裁字[2003]26号房屋拆迁纠纷裁决,主要内容是:(一)被拆迁人宋莉莉应在裁决书生效之日起15日内拆迁完毕;(二)房屋安置补偿费(包括房屋补偿费、搬家费、附属设施及装饰装潢费、临时安置补助费及停业损失费)共计为685651.88元;(三)万兴公司在中贸百货商城项目完工后提供一处位于该商城项目的房屋(面积与被拆房屋面积相当),拆迁人调换房屋价格以市场评估价为准;(四)万兴公司安排过渡房一套供被拆迁人临时居住。宋莉莉对该裁决不服,提起行政诉讼,于2003年9月4日向江苏省宿迁市宿城区人民法院提起诉讼,请求撤销该裁决。@#
原告诉称:被告以方元房地产评估咨询有限公司(以下简称方元公司)的估价作为被拆房屋补偿价是错误的,拆迁人委托方元公司评估时违反了公平、公正、公开的原则,被告以此评估报告直接作为裁决的依据,剥夺了被拆迁人选择评估机构的权利,且评估结果未经双方质证,对房屋的估价不准,被告行政裁决中有关被拆迁房屋置换的内容也不明确,缺乏可操作性。此外,被拆迁房屋在拆迁前一直由他人承租,而对承租人的安置至今未达成任何协议。请求依法撤销被诉行政裁决。@#

1.宋莉莉与高虹、于桂军签订的承包经营合同,用以证明原告房屋已租赁给他人,房屋被拆迁时拆迁人对承租人未做任何安置。@#
2.宋莉莉名下位于宿迁市幸福中路房产情况的录像带,以证明房屋拆迁前的坐落及出租他人等情况。@#
被告辩称:方元公司评估原告房产的程序及结果没有不妥之处,我局根据方元公司的评估报告进行裁决是合法的。原告以拆迁人万兴公司未与被拆迁房屋的租赁人签订协议为由,认为有关行政裁决违法,没有法律依据。拆迁人开发的房屋属期房,我局行政裁决时尚无法确定该项目房屋的具体数量、排列序号、房屋朝向等,裁决没有涉及有关内容并无不当,请求维持该裁决。@#

1.宿迁市发展计划委员会(批复)宿计发(2002)72号关于宿迁市中贸百货商城有限公司(以下简称百货公司)中贸百货商城项目立项的批复,用以证明该公司的中贸百货商城项目已经依法得到批准立项。@#
2.宿迁市规划局宿规用(2002)107号建设用地规划许可证及红线图、宿迁市国土局(2002)国土建字第126号建设用地批准书及拆许字(2003)第3号房屋拆迁许可证和房屋拆迁公告,用以证明建设局已依法取得了建设用地规划许可证、建设用地批准书、房屋拆迁许可证且原告的房屋在规定的拆迁红线图范围内,并依法发布了拆迁公告。@#
3.方元公司企业法人营业执照,证明该单位是具备法人资格的房地产评估咨询有限公司。@#
4.方元公司房地产价格评估机构资格证书,用以证明该单位是具有法定资格的房地产价格评估机构。@#
5.江苏省建设厅房地产业处的证明,用以证实评估人胡中东、孙权为注册房地产估价师。@#
6.方元公司的房地产评估报告,用以证明宿迁市建设局是依据法定机构的评估报告作出的裁决。@#
7.宋莉莉的房屋产权证,用以证明被拆迁房屋属宋莉莉所有。@#
第三人辩称,我公司作为拆迁人,实施的全部拆迁活动均是依法进行的。宿迁市建设局关于拆迁争议的行政裁决合法,应予维持。@#
