The plaintiff Diantou Longsheng Basalt Processing Plant (hereafter referred to as Longsheng Plant) filed a lawsuit at the People's Court of Fuding City of Fujian Province for its refusal to accept the Document No. 14 (2001) (Opinions Concerning Supporting Some Basalt Processing Plants in 2001) issued by the defendant, the People's Government of Fuding City of Fujian Province on March 13, 2002.
 
原告福建省福鼎市点头隆胜石材厂不服被告福建省福鼎市人民政府于2001年3月13日以鼎政办(2001)14号文件下发的《关于2001年玄武岩石板材加工企业扶优扶强的意见》,向福建省福鼎市人民法院提起诉讼。

The plaintiff claimed that:
The mine could only be exploited 90,000 cubic meters of basalt material per year and it was through the third party - Fujian Xuanwu Basalt Materials Co. Ltd., who supplied basalt materials to more than 920 basalt processing plants, each of which could only get an average of no more than 98 cubic meters. In 2000, by way of issuing No. 59 document and No 60 document, the defendant retained 8,000 cubic meters of basalt materials from the total for the purpose of providing these basalt materials to its designated 22 so-called “plants-to-be-supported”. On March 3, 2001 the defendant issued the No. 14 document, providing that 31 plants shall be supported through supplying more basalt materials. Counting in this way, this year it will retain 11,300 cubic meters from the total basalt materials for those plants to be supported, each of the other plants will be retained an average of 12.28 cubic meters. Moreover, among the 31 plants that the defendant specified to be supported, 26 plants' production value were lower than 5 million yuan, they didn't meet the defendant's requirement at all. The defendant's increasing the retainment of basalt materials year by year forced the plaintiff to reduce its production year by year. The plaintiff held that: A strong and preponderant enterprise could only appear through fair competition, it ought not depend on administrative support. The defendant's act caused unfairness, undermined the social economic order under fair competition and resulted in the prevailing of corruption. It violated the Administrative Law. Thus plead the court to invalidate the Document No. 14 (2001) issued by the defendant.
 
原告诉称:矿山每年开采的玄武岩荒料仅有9万立方米,都由第三人福建玄武石材有限公司负责给本市的920余家石材加工企业供应,平均每个加工企业只能得到不足98方。2000年,被告曾通过下达鼎政办(2000)59号和60号文件,从全市玄武岩荒料总量中提留8000方,指定供应给22家所谓的扶优企业。2001年3月3日,被告又下达鼎政办(2001)14号文件,规定对31家企业要用倾斜增加供应荒料的办法扶优扶强。照这样计算,今年需要从玄武岩荒料总量中提留11300方去供应那些所谓的扶优扶强企业。平均到每家企业头上,就要被提留12.28方荒料。而且被告确定的这31家所谓的扶优扶强企业,就有26家产值低于500万元,根本达不到被告自己制定的扶优扶强条件。被告这种逐年提高扶优荒料提留量的做法,迫使原告逐年减产。原告认为,强劲、优势的企业只能通过公平竞争显露出来,不能通过行政手段扶持起来。被告的这种做法制造了不平等,破坏了公平竞争的社会经济秩序,使拉关系、走后门的腐败之风盛行,是违法行政。请求撤销被告的鼎政办(2001)14号文件。

The defendant defended that:
Having been consented by the object of administration, Fujian Basalt Materials Co. Ltd., - the third party of this case, this government issued the Document No.14 (2001), which made non-mandatory administrative instructions on the company's operation. These instructions wouldn't produce direct legal consequences. As to the plaintiff, this document neither entitled it rights, nor did it define its obligations, it hadn't direct relationship to the interests of the plaintiff. Thus its act didn't attribute to any one of the concrete administrative acts as Article 2 of Administrative Procedure Law of People's Republic of China provides, it was not an actionable party in this administrative action. As a result, the plaintiff had no right to bring this administrative action against it on the ground of this document.

被告辩称:鼎政办(2001)14号文件,只是在取得行政相对方、本案第三人福建玄武石材有限公司同意后,对其业务所作的非强制性、不直接产生法律后果的行政指导性文件。对原告来说,该文件既没有给他设定权利,也没有对他科以义务,与他的利益没有直接的关系,不属于《中华人民共和国行政诉讼法》第二条规定的具体行政行为,不是行政诉讼可诉的对象。原告无权就该文件向人民法院提起行政诉讼。
