Defendant: Yu Xikuan, male, 32 years old, from Taishan County, Guangdong Province, dwelling at 17 of Chung Kin Building, Chung Wui Street, Kowloon, Hong Kong, arrested on August 25, 1986.@#
The People's Procuratorate of Kunming City, Yunnan Province instituted a public prosecution in the Intermediate People's Court of Kunming City against the defendants, Wen Yuanhe, Dai Wenxuan and Yu Xikuan, on charges of drug trafficking. The Intermediate People's Court of Kunming City examined this case according to Article 108 of the Criminal Procedure Law of the People's Republic of China. After examination, the court considered that: among the three defendants in this case, Wen Yuanhe was a citizen of Thailand, and according to the provisions of Article 3 (1) and (3) of the Criminal Law of the People's Republic of China that “This Law shall be applicable to anyone who commits a crime within the territory of the People's Republic of China, except as specially provided for by law” and “as long as the criminal conduct or consequence takes place within the territory of the People's Republic of China, the crime shall be deemed to have been committed within the territory of the People's Republic of China,” the People's Republic of China had jurisdiction over the whole case. The Intermediate People's Court of Kunming City legally formed a collegiate bench and held an open trial of this case.@#

被告人：温源和，又名勇·占达拉功，男，６１岁，泰国籍，住泰国清迈市昌康区西兵街６３－３号。１９８６年８月２７日被逮捕。@#
被告人：戴文煊，又名戴永存，男，３５岁，广东省广州市人，住香港九龙深水步元洲街３９６号。１９８６年８月２５日被逮捕。@#
被告人：余锡宽，男，３２岁，广东省台山县人，住香港九龙中汇街中坚楼１７号。１９８６年８月２５日被逮捕。@#
被告人温源和、戴文煊、余锡宽，因贩运毒品案，由云南省昆明市人民检察院向昆明市中级人民法院提起公诉。昆明市中级人民法院依照《中华人民共和国刑事诉讼法》第１０８条的规定，对该案进行了审查。经审查认为：本案３名被告人，其中温源和系泰国公民，依照《中华人民共和国刑法》第３条第１款、第３款的规定：“凡在中华人民共和国领域内犯罪的，除法律有特别规定的以外，都适用本法。”“犯罪的行为或者结果有一项发生在中华人民共和国领域内的，就认为是在中华人民共和国领域内犯罪。”据此，中华人民共和国对此案全案享有管辖权。故昆明市中级人民法院依法组成合议庭，对该案公开进行审理。@#
经审理查明：被告人温源和、戴文煊于１９８６年初在泰国曼谷市与当地贩毒分子勾结，共同策划贩卖毒品海洛英。温源和负责与国外的贩毒分子联系成交，并监督接运毒品；戴文煊负责接运毒品，经我国昆明、广州至深圳出境。１９８６年４月１８日，戴文煊与同案被告人余锡宽，进入昆明市与从泰国到达的温源和会面后，共同约见了潜入昆明市的国外贩毒分子，商定了在昆明市交接毒品的时间和地点。１９８６年８月１６日下午６时许，戴文煊和余锡宽在昆明市火车站外水果摊处接收毒品时，被我公安人员当场抓获，缴获海洛英２２７６８克。温源和于当晚亦被抓获归案。@#
上述事实，有缴获的海洛英、刑事技术鉴定书和同案被告人的供词证实，事实清楚，证据确实、充分，足资认定。@#

昆明市中级人民法院审理认为：被告人温源和、戴文煊、余锡宽共同实施犯罪行为，属刑法第２２条第１款规定的共同故意犯罪。温源和、戴文煊在共同犯罪中是组织、策划和联系接运毒品人，依照刑法第２３条的规定，系本案主犯，应当从重处罚。余锡宽在戴文煊的引诱下，参与接运毒品，依照刑法第２４条的规定，系本案从犯，应比照主犯从轻处罚。温源和、戴文煊、余锡宽共同贩运毒品，其行为均构成刑法第１７１条规定的贩毒罪。上列被告人贩运毒品数量巨大，情节特别严重，根据全国人大常委会《关于严惩严重破坏经济的罪犯的决定》第１条第（一）项的规定，应予严惩。据此，１９８７年１月６日昆明市中级人民法院以贩毒罪，分别判处温源和、戴文煊死刑；以贩毒罪，判处余锡宽死刑，缓期二年执行。依照刑法第５３条第１款的规定，分别剥夺戴文煊、余锡宽政治权利终身。查获的４号海洛英２２７６８克、运输毒品用的自行车２辆、装毒品的旅行包２个，依照刑法第６０条的规定予以没收。@#
