The Interpretation of the Supreme People's Court on Several Issues Concerning the Application of Law in Trying Criminal Cases of Damaging Grassland Resources, as adopted at the 1558th Session of the Judicial Committee of the Supreme People's Court on October 22, 2012, are hereby issued and shall come into force on November 22, 2012.
 
《最高人民法院关于审理破坏草原资源刑事案件应用法律若干问题的解释》已于2012年10月22日由最高人民法院审判委员会第1558次会议通过,现予公布,自2012年11月22日起施行。

最高人民法院关于审理破坏草原资源刑事案件应用法律若干问题的解释

In order to leally punish criminal activities of damaging grassland resources, in accordance with the relevant provisions of the Criminal Law of the People's Republic of China, the interpretation on the several issues concerning the application of law in trying such criminal cases is hereby issued as follows:
 
为依法惩处破坏草原资源犯罪活动,依照《中华人民共和国刑法》的有关规定,现就审理此类刑事案件应用法律的若干问题解释如下:

 
Article 1 Where anyone, in violation of any regulation on land administration, such as the Grassland Law, illegally occupies any grassland, and changes the use of the occupied land in large size, causes great damage to the grassland, the person shall be convicted and punished for the crime of illegally occupying agricultural land according to Article 342 of the Criminal Law.   第一条 违反草原法等土地管理法规,非法占用草原,改变被占用草原用途,数量较大,造成草原大量毁坏的,依照刑法三百四十二条的规定,以非法占用农用地罪定罪处罚。

 
Article 2 Where anyone illegally occupies any grassland, and changes the use of the occupied grassland, with the size of grassland being greater than 20 mu, or anyone who was once subject to administrative penalty for illegally occupying grassland illegally occupies grassland again within three years, and changes the use of such occupied grassland, with the size of grassland being greater than 10 mu, it shall be determined as "large amount" as prescribed in Article 342 of the Criminal Law.   第二条 非法占用草原,改变被占用草原用途,数量在二十亩以上的,或者曾因非法占用草原受过行政处罚,在三年内又非法占用草原,改变被占用草原用途,数量在十亩以上的,应当认定为刑法三百四十二条规定的“数量较大”。

Where anyone illegally occupies the grassland and changes the use of such occupied grassland in large size, any of the following circumstances shall be deemed as "great damage to such agricultural lands as arable land and forest land":

非法占用草原,改变被占用草原用途,数量较大,具有下列情形之一的,应当认定为刑法三百四十二条规定的“造成耕地、林地等农用地大量毁坏”:
......
