The Provisions of the Supreme People's Court on Several Issues Concerning the Application of Law to the Cases That Are Pending when the Civil Procedure Law, As Amended, Takes Effect, as adopted at the 1564th Session of the Judicial Committee of the Supreme People's Court on December 24, 2012, are hereby issued and shall come into force on January 1, 2013.
 
《最高人民法院关于修改后的民事诉讼法施行时未结案件适用法律若干问题的规定》已于2012年12月24日由最高人民法院审判委员会第1564次会议通过,现予公布,自2013年1月1日起施行。

最高人民法院关于修改后的民事诉讼法施行时未结案件适用法律若干问题的规定

(Interpretation No. 23 [2012], adopted at the 1564th Session of the Judicial Committee of the Supreme People's Court on December 24, 2012)

In order to correctly apply the Decision of the Standing Committee of the National People's Congress on Amending the Civil Procedure Law of the People's Republic of China (hereinafter referred to as the Decision), which was adopted at the 28th Session of the Standing Committee of the Eleventh National People's Congress on August 31, 2012 and shall come into force on January 1, 2013, some issues concerning the application of laws for cases that have been accepted prior to effectiveness of the Amended Civil Procedure Law but have not been closed or enforced when the amended Civil Procedure Law comes into force (hereinafter referred to as “cases pending on January 1, 2013”) are hereby provided as follows:
 
为正确适用《全国人民代表大会常务委员会关于修改〈中华人民共和国民事诉讼法〉的决定》(2012年8月31日第十一届全国人民代表大会常务委员会第二十八次会议通过,2013年1月1日起施行)(以下简称《决定》),现就修改后的民事诉讼法施行前已经受理、施行时尚未审结和执结的案件(以下简称2013年1月1日未结案件)具体适用法律的若干问题规定如下:

 
Article 1 The Civil Procedure Law, as amended, shall apply to cases pending on January 1, 2013, unless it is otherwise provided in these Provisions.   第一条 2013年1月1日未结案件适用修改后的民事诉讼法,但本规定另有规定的除外。

In cases prescribed in the proceeding paragraph, procedural matters that have been completed in accordance with the provisions of the pre-amendment Civil Procedure Law and relevant judicial interpretations prior to January 1, 2013 shall still be valid.
 
前款规定的案件,2013年1月1日前依照修改前的民事诉讼法和有关司法解释的规定已经完成的程序事项,仍然有效。

 
Article 2 The people's courts shall continue to hear cases pending on January 1, 2013 that comply with the provisions of the pre-amendment Civil Procedure Law or the amended Civil Procedure Law.   第二条 2013年1月1日未结案件符合修改前的民事诉讼法或者修改后的民事诉讼法管辖规定的,人民法院对该案件继续审理。

 
Article 3 Where cases pending on January 1, 2013 comply with the provisions of the pre-amendment Civil Procedure Law or the amended Civil Procedure Law concerning the service of process, the service of process that has been completed by the people's court shall still be valid.

   第三条 2013年1月1日未结案件符合修改前的民事诉讼法或者修改后的民事诉讼法送达规定的,人民法院已经完成的送达,仍然有效。
