For purposes of punishing criminal activities of obstructing border (frontier) control according to law and maintaining the order of border (frontier) control, in accordance with the relevant provisions of the Criminal Law of the People's Republic of China and the Criminal Procedure Law of the People's Republic of China, several issues concerning the application of laws in the handling of such cases are hereby interpreted as follows: | |
为依法惩处妨害国（边）境管理犯罪活动，维护国（边）境管理秩序，根据《中华人民共和国刑法》《中华人民共和国刑事诉讼法》的有关规定，现就办理这类案件应用法律的若干问题解释如下： |

| Article 1 The act of whoever leads, plots, or directs other persons to illegally cross the border (frontier), or whoever under the direction of a ringleader commits such acts as roping in, enticing, or introducing other persons to illegally cross the border (frontier) shall be determined as the act of “organizing other persons to illegally cross the border (frontier)” as prescribed in Article 318 of the Criminal Law. | | 第一条 领导、策划、指挥他人偷越国（边）境或者在首要分子指挥下，实施拉拢、引诱、介绍他人偷越国（边）境等行为的，应当认定为刑法第三百一十八条规定的“组织他人偷越国（边）境”。 |
Where the number of persons that are organized to illegally cross the border (frontier) is ten or more, it shall be determined as "a large number of persons" as prescribed in Article 318, Section 1, Subsection 2 of the Criminal Law; and where the amount of illegal gains is 200,000 yuan or more, it shall be determined as “a large amount of illegal gains” as prescribed in Article 318, Section 1, Subsection 6 of the Criminal Law. | |
组织他人偷越国（边）境人数在十人以上的，应当认定为刑法第三百一十八条第一款第（二）项规定的“人数众多”；违法所得数额在二十万元以上的，应当认定为刑法第三百一十八条第一款第（六）项规定的“违法所得数额巨大”。 |
Whoever, for the purpose of organizing other persons to illegally cross the border (frontier), recruits, ropes in, entices, introduces, or trains the persons that are to illegally cross the border (frontier), plots and arranges the illegal crossing of the border (frontier), and is investigated and seized before other persons illegally cross the border (frontier) or in the course of illegally crossing the border (frontier) shall be punished for committing the (attempted) crime of organizing other persons to illegally cross the border (frontier); and where the act falls under any of circumstances as prescribed in Article 318, Section 1 of the Criminal Law, the sentencing shall be made on the basis of the corresponding statutory penalty ranges and in light of the punishment principles for a person who attempts to commit a crime. | |
以组织他人偷越国（边）境为目的，招募、拉拢、引诱、介绍、培训偷越国（边）境人员，策划、安排偷越国（边）境行为，在他人偷越国（边）境之前或者偷越国（边）境过程中被查获的，应当以组织他人偷越国（边）境罪（未遂）论处；具有刑法第三百一十八条第一款规定的情形之一的，应当在相应的法定刑幅度基础上，结合未遂犯的处罚原则量刑。 |

Article 2 The act of whoever, for the purpose of organizing other persons to illegally cross the border (frontier), fabricates reasons for exit from the country, identity information, or relevant overseas relationship certificates shall be determined as an act of “practicing frauds” as prescribed in Article 319, Section 1 of the Criminal Law.
