关于办理职务犯罪案件严格适用缓刑、免予刑事处罚若干问题的意见 |
In order to further regulate the application of probation or exemption from criminal punishment in the handing of the cases about embezzlement or bribery, malfeasance and other duty-related crimes, and ensure the legal effects and social effects of the handling of the cases about duty-related crimes, in accordance with the relevant provisions of the Criminal Law of the People's Republic of China and in light of the judicial practices, the following opinions on the issues concerning the specific application of probation or exemption from criminal punishment in the handling of the cases about duty-related crimes are hereby put forward: | |
为进一步规范贪污贿赂、渎职等职务犯罪案件缓刑、免予刑事处罚的适用，确保办理职务犯罪案件的法律效果和社会效果，根据刑法有关规定并结合司法工作实际，就职务犯罪案件缓刑、免予刑事处罚的具体适用问题，提出以下意见： |

I. Strictly grasping the application of probation or exemption from criminal punishment in the handling of the cases about duty-related crimes. The application of criminal punishment in the handling of the cases about duty-related crimes is directly related to the actual effects of the anti-corruption work. People's courts and people's procuratorates shall get an in-depth understanding of the serious social harm of duty-related crimes, correctly implement the criminal policy of tempering strict justice with mercy, and give full play to the role of criminal penalties in punishing and preventing crimes. They shall, on the basis of getting a comprehensive understanding of the criminal facts of the whole cases and the circumstances of sentencing, apply probation or exemption from criminal punishment in strict accordance with the conditions as provided by the Criminal Law of the People's Republic of China, consider circumstances for both liberal punishment and severe punishment, and apply proper sentencing and appropriate execution modes of criminal punishment to the crimes, so as to effectively avoid the negative impacts caused by improper application of probation or exemption from criminal punishment.
．．．．．． | | 一、严格掌握职务犯罪案件缓刑、免予刑事处罚的适用。职务犯罪案件的刑罚适用直接关系反腐败工作的实际效果。人民法院、人民检察院要深刻认识职务犯罪的严重社会危害性，正确贯彻宽严相济刑事政策，充分发挥刑罚的惩治和预防功能。要在全面把握犯罪事实和量刑情节的基础上严格依照刑法规定的条件适用缓刑、免予刑事处罚，既要考虑从宽情节，又要考虑从严情节；既要做到刑罚与犯罪相当，又要做到刑罚执行方式与犯罪相当，切实避免缓刑、免予刑事处罚不当适用造成的消极影响。
