In order to effectively implement the spirit of the Several Opinions of the State Council on Encouraging and Guiding the Healthy Development of Private Investment (No. 13 [2010] of the State Council), and encourage and guide the entry of private capitals in the fields of science, technology and industry for national defense, the following implementation opinions are formulated in light of actual circumstances in science, technology and industry for national defense: | |
为贯彻落实《国务院关于鼓励和引导民间投资健康发展的若干意见》（国发〔2010〕13号）精神，鼓励和引导民间资本进入国防科技工业领域，结合国防科技工业实际，制定以下实施意见： |

| I. The principles and fields for encouraging and guiding the entry of private capitals in science, technology and industry for national defense | | 一、鼓励和引导民间资本进入国防科技工业的原则和领域 |

| 1. In accordance with the requirements of the path of development in the form of civil-military integration with Chinese characteristics, the fields and scope for the entry of private capitals in science, technology and industry for national defense shall be further enlarged, the policies and measures of encouragement and guidance shall be perfected, and the development of weapons and equipment and the fields of science technology and industry for national defense shall be promoted. The principles of active encouragement, correct guidance, equal treatment and ensuring safety shall be adhered to, private capitals shall be attracted and encouraged to enter the fields of science, technology and industry for national defense, the equal treatment shall be implemented for private investors and state-owned military industrial enterprises in the access with permission, task competition, tax incentives and other aspects, the security, confidentiality and supervision management shall be strengthened, and the security of state secrets shall be ensured. | | （一）要按照走中国特色军民融合式发展路子的要求，进一步扩大民间资本进入国防科技工业的领域和范围，完善鼓励和引导的政策措施，促进武器装备和国防科技工业发展。坚持积极鼓励、正确引导、同等对待、确保安全的原则，吸引和鼓励民间资本进入国防科技工业领域，在许可进入、任务竞争、税收优惠等方面对民间投资主体与国有军工企业实行同等待遇，加强安全保密和监督管理，确保国家秘密安全。 |

| 2. The fields of science, technology and industry for national defense, as being entered by private capitals, include: the scientific research and production of weapons and equipment, the investment and construction of science, technology and industry for national defense, the restructuring and reorganization of the military industrial enterprises, and the development of technologies for both military and civil uses. | | （二）民间资本进入国防科技工业的领域包括：武器装备科研生产、国防科技工业投资建设、军工企业改组改制、军民两用技术开发。 |

| II. Private enterprises are permitted to participate in assuming the scientific research and production tasks of weapons and equipment in accordance with the relevant provisions | | |

| 3. The procurement of competitive equipment shall be promoted by efforts, and qualified private enterprises shall be introduced to assume the scientific research and production tasks of weapons and equipment. The access conditions of equipment market shall be set scientifically, the revision for the licensing catalogue of the scientific research and production of weapons and equipment shall be accelerated, and the scope of license management shall be optimized and issued to the public. The licensing system of scientific research and production of weapons and equipment, the qualification examination system for equipment manufacturing units, and the examination and accreditation system for the confidentiality qualification in scientific research and production units of weapons and equipment shall be strengthened in the coordination and connection of such systems, a coordinated mechanism for examination and accreditation management shall be established, and the period of examination and accreditation shall be shortened. | | （三）大力推行竞争性装备采购，吸纳符合条件的民营企业承担武器装备科研生产任务。科学设置装备市场准入条件，加快武器装备科研生产许可目录修订工作，优化许可管理范围并向社会发布。加强武器装备科研生产许可制度、装备承制单位资格审查制度和武器装备科研生产单位保密资格审查认证制度协调衔接，建立相互协调的审查认证管理机制，缩短审查认证周期。 |

4. Private enterprises may assume the scientific research and production tasks of weapons and equipment through cooperating with military industrial units, or independently assume the scientific research and production tasks of weapons and equipment. An equipment procurement project or supporting task, which is not directly related to the secrets of national security and army, and has small investment, strong popularity and more qualified manufacturing units, shall adopt the method of open tender and other methods to encourage the participation of private enterprises in the competition.
