| Chapter I General Provisions | | 第一章 总 则 |
| Article 1 To promote the healthy and prosperous development of the film industry, carry forward the core values of socialism, regulate the new business forms of the film industry, and enrich the spiritual and cultural life of the people, these Provisions are developed in accordance with the Film Industry Promotion Law of the People's Republic of China and the Regulation on the Administration of Films. | | 第一条 为促进电影产业健康繁荣发展，弘扬社会主义核心价值观，规范电影产业新业态，丰富人民群众精神文化生活，根据《中华人民共和国电影产业促进法》和《电影管理条例》，制定本规定。 |
| Article 2 These Provisions shall apply to those engaging in the film projection and distribution activities of on-demand cinemas and on-demand cinema chains. | | 第二条 从事点播影院、点播院线电影放映、发行活动，适用本规定。 |
| For the purpose of these Provisions, “on-demand cinemas” means the cultural and entertainment venues other than cinemas and places for mobile projection activities, which provide projection service business activities for the audience to watch films-on-demand. | | 本规定所称点播影院，是指在电影院和流动放映活动场所之外，为观众观看自选影片提供放映服务经营活动的文化娱乐场所。 |
| For the purpose of these Provisions, “on-demand cinema chains” means the distribution enterprises that are composed of a certain number of on-demand cinemas, have the rights to distribute a certain number of films, and provide films for and conduct the operation management of the film projection activities of the on-demand cinemas under their jurisdictions. | | 本规定所称点播院线，是指由一定数量的点播影院组成，拥有一定数量影片的发行权，并对所辖点播影院的电影放映活动提供影片、实施运营管理的发行企业。 |
| Article 3 Whoever engages in the film projection and distribution activities of on-demand cinemas and on-demand cinema chains shall abide by the Constitution and relevant laws and regulations, adhere to serving the people and the socialism, insist on giving priority to social benefits, and realize the unity of social and economic benefits. | | 第三条 从事点播影院、点播院线电影放映、发行活动，应当遵守宪法和有关法律、法规，坚持为人民服务、为社会主义服务，坚持社会效益优先，实现社会效益与经济效益相统一。 |
| Article 4 The competent film department of the State Council shall take charge of the supervision and administration of the film projection and distribution activities of on-demand cinemas and on-demand cinema chains nationwide. | | 第四条 国务院电影主管部门负责全国点播影院、点播院线电影放映、发行活动的监督管理工作。 |
| The competent film departments of the local people's governments at or above the county level shall take charge of the supervision and administration of the film projection and distribution activities of on-demand cinemas and on-demand cinema chains within their respective administrative regions. | | 县级以上地方人民政府电影主管部门负责本行政区域内点播影院、点播院线电影放映、发行活动的监督管理工作。 |
| Chapter II Business Licensing | | 第二章 业务许可 |
| Article 5 An enterprise or individual industrial and commercial household that intends to establish an on-demand cinema shall file an application with the competent film department of the people's government at the county level at the place where it is located, and meet the following conditions: | | 第五条 企业、个体工商户设立点播影院，应当向所在地县级人民政府电影主管部门提出申请，并应当符合以下条件： |
| (1) The projection equipment, projection quality, and billing system comply with the technical specifications as prescribed by the competent film department of the State Council. | | （一）放映设备、放映质量和计费系统符合国务院电影主管部门规定的技术规范； |
| (2) The width of the screen of a single cinema hall set up does not exceed six meters, and the number of available audience seats do not exceed 20. | | （二）所设单个影厅的银幕宽度不超过6米，观众有效座位数不超过20个； |
| (3) There is an on-demand cinema chain or an on-demand cinema chain under the establishment preparation period which it is to join. | | （三）有拟加入的点播院线或者处于筹建期的点播院线； |
| (4) The legal representative or principal person in charge is not during the period of prohibition from engaging in the film industry. | | （四）法定代表人或者主要负责人未处于电影从业禁止期间。 |
| Article 6 An enterprise that intends to set up an on-demand cinema chain within a province shall file an application with the competent film department of the people's government of the province, autonomous region or municipality directly under the Central Government at the place where it is located; and an enterprise that intends to set up a cross-provincial on-demand cinema chain shall file an application with the competent film department of the State Council, and meet the following conditions: | | 第六条 企业设立省内点播院线，应当向所在地省、自治区、直辖市人民政府电影主管部门提出申请；设立跨省点播院线，应当向国务院电影主管部门提出申请；并应当符合以下条件： |
| (1) It has the sources of films that are suitable for its business. | | （一）有与其业务相适应的影片来源； |
| (2) The billing system complies with the technical specifications as prescribed by the competent film department of the State Council. | | （二）计费系统符合国务院电影主管部门规定的技术规范； |
| (3) The legal representative or principal person in charge is not during the period of prohibition from engaging in the film industry. | | （三）法定代表人或者主要负责人未处于电影从业禁止期间； |
| (4) There are not less than 30 on-demand cinemas under its jurisdiction if it is an on-demand cinema chain within a province, and not less than 60 on-demand cinemas under its jurisdiction if it is a cross-provincial on-demand cinema chain. | | （四）省内点播院线所辖点播影院数量不少于30家，跨省点播院线所辖点播影院数量不少于60家。 |
| Where the enterprise only meets the conditions as specified in items (1) to (3) of the preceding paragraph, the relevant competent film department shall issue a certificate on approving the preparation for the establishment thereof which is valid for three months. It may not apply to the relevant competent film department for a permit unless it has met the conditions as specified in item (4) of the preceding paragraph during the period of establishment preparation. | | 只符合前款第一项至第三项条件的，由有关电影主管部门发给有效期为三个月的同意筹建证明文件。筹建期间内达到前款第四项条件的，方可向有关电影主管部门申请颁发许可证件。 |
| Article 7 The competent film departments shall, in accordance with the provisions of Article 25 of the Film Industry Promotion Law of the People's Republic of China, issue the permits for film projection business for eligible on-demand cinemas, and issue the permits for film distribution business to eligible on-demand cinema chains. | | 第七条 电影主管部门应当依照《中华人民共和国电影产业促进法》第二十五条的规定，对符合条件的点播影院，颁发电影放映经营许可证；对符合条件的点播院线，颁发电影发行经营许可证。 |
| Article 8 Where an on-demand cinema is to change the on-demand cinema chain or the on-demand cinema chain under the establishment preparation period it joins, it shall re-apply to the original permit-issuing authority for issuing a permit for film projection business. | | 第八条 点播影院变更其所加入的点播院线或者处于筹建期的点播院线的，应当向原发证机关重新申请核发电影放映经营许可证。 |
| Article 9 A permit for film projection business of an on-demand cinema and a permit for film distribution business of an on-demand cinema chain shall be valid for two years. | | 第九条 点播影院的电影放映经营许可证和点播院线的电影发行经营许可证的有效期为两年。 |
| Chapter III Operating Rules | | 第三章 经营规范 |
Article 10 The competent film department of the State Council shall establish the information system for the business management of on-demand cinemas nationwide and the film copyright authorization information publicity and inquiry system.
