The Guiding Opinions of the Supreme People's Procuratorate on the Application of the Provisions on Several Issues concerning the Examination and Judgment of Evidence in Death Penalty Cases and the Provisions on Several Issues concerning the Exclusion of Illegal Evidence in Criminal Cases (hereinafter referred to as the “Guiding Opinions”) were issued on December 30, 2010. The Guiding Opinions reinforce the legal supervision exercised by the procuratorial organs over the gathering of evidence in criminal investigation, the burden to prove the legality of evidence and the comprehensive examination and application of evidence, and may be regarded as the basis for the people's courts and the people's procuratorates to jointly implement the Provisions on Several Issues concerning the Examination and Judgment of Evidence in Death Penalty Cases and the Provisions on Several Issues concerning the Exclusion of Illegal Evidence in Criminal Cases and examine and judge evidence. The Guiding Opinions are hereby forwarded to you. Please effectively implement the Provisions on Several Issues concerning the Examination and Judgment of Evidence in Death Penalty Cases
