To accurately apply the Amendment (VIII) to the Criminal Law of the People's Republic of China and guarantee the effective implementation of public surveillance and probation, in accordance with the relevant provisions of the Criminal Law and the Criminal Procedure Law, you are hereby notified of the relevant issues concerning the application of injunctions to convicts sentenced to public surveillance or probation as follows: | |
为正确适用《中华人民共和国刑法修正案（八）》，确保管制和缓刑的执行效果，根据刑法和刑事诉讼法的有关规定，现就判处管制、宣告缓刑的犯罪分子适用禁止令的有关问题规定如下： |

| Article 1 Where the people's court deems it necessary to prohibit a convict sentenced to public surveillance or probation from engaging in a certain activity, entering a certain area or place or contacting a certain person during the period of public surveillance or probation according to the crime committed as required by promoting the education and correction of the convict and effectively maintaining the social order, it may announce an injunction at the same time according to paragraph 2 of Article 38 and paragraph 2 of Article 72 of the Criminal Law. | | 第一条 对判处管制、宣告缓刑的犯罪分子，人民法院根据犯罪情况，认为从促进犯罪分子教育矫正、有效维护社会秩序的需要出发，确有必要禁止其在管制执行期间、缓刑考验期限内从事特定活动，进入特定区域、场所，接触特定人的，可以根据刑法第三十八条第二款、第七十二条第二款的规定，同时宣告禁止令。 |

Article 2 To announce an injunction, the people's court shall, according to the cause and nature of the crime committed, the criminal means, the convict's repentance, the usual performance of the convict and other factors, fully consider the extent of relevance of such factors to the convict's guilt, make a pertinent decision on imposing one or more parts of the prohibition of “engaging in a certain activity, entering a certain area or place or contacting a certain person” during the period of public surveillance or probation.
