| To implement the principle of openness of enforcement, regulate the openness of the enforcement process of people's courts, further enhance the transparency of enforcement, and promote the building of the enforcement information disclosure platform, the Supreme People's Court has formulated the Several Opinions on the Openness of the Enforcement Process of People's Courts. These Opinions are hereby issued. To implement the principle of openness of enforcement, regulate the openness of the enforcement process of people's courts, allow parties to know the enforcement progress of cases in time, better protect the right to know, participation rights, expression rights, and supervision rights of parties and the public to the work of enforcement, further enhance the transparency of the work of enforcement, promote justice by openness and build public credibility by justice, these Opinions are formulated, in accordance with the provisions of the Several Provisions of the Supreme People's Court on Publicizing the Enforcement Work | | 为贯彻落实执行公开原则，规范人民法院执行流程公开工作，方便当事人及时了解案件执行进展情况，更好地保障当事人和社会公众对执行工作的知情权、参与权、表达权和监督权，进一步提高执行工作的透明度，以公开促公正、以公正立公信，根据《最高人民法院关于人民法院执行公开的若干规定》（法发〔2006〕35号）、《最高人民法院关于推进司法公开三大平台建设的若干意见》（法发〔2013〕13号）等规定，结合执行工作实际，制定本意见。 |

| Article 1 The principle of “regarding openness as a general rule and non-openness as an exception” shall be followed for the information on the enforcement process of people's courts. The enforcement process and the relevant information which shall or may be disclosed according to the law shall be disclosed. The entire case handling process shall be disclosed, all key points shall be notified, all procedures shall be connected, and all documents shall disclosed online, to provide all-around, diversified, and real-time enforcement openness services to parties and the public and comprehensively promote open enforcement. | | 第一条 人民法院执行流程信息以公开为原则、不公开为例外。对依法应当公开、可以公开的执行流程及其相关信息，一律予以公开，实现执行案件办理过程全公开、节点全告知、程序全对接、文书全上网，为当事人和社会公众提供全方位、多元化、实时性的执行公开服务，全面推进阳光执行。 |
| Article 2 The portal websites (websites of government affairs) of people's courts at all levels shall be the basic platforms and main channels for the openness of the enforcement process of people's courts. Short messages, voice telephone systems, electronic bulletin screens, touch screen, Clients of mobile apps, microblog of people's courts, public WeChat accounts of people's courts, and other platforms or channels shall be the supplementary platforms and channels. The information on the key points of the enforcement process, progresses of cases, and relevant materials shall be disclosed to the parties to cases and their authorized agents; and the enforcement services information, the enforcement announcement information, and other public information relevant to the enforcement of people's courts shall be disclosed to the public. | | 第二条 人民法院执行流程公开工作，以各级人民法院互联网门户网站（政务网）为基础平台和主要公开渠道，辅以手机短信、电话语音系统、电子公告屏和触摸屏、手机应用客户端、法院微博、法院微信公众号等其他平台或渠道，将执行案件流程节点信息、案件进展状态及有关材料向案件当事人及委托代理人公开，将与法院执行工作有关的执行服务信息、执行公告信息等公共信息向社会公众公开。 |
| People's courts at all levels shall establish function modules for the inquiry about the information on the enforcement process on the websites for the disclosure of information on adjudication process under their portal websites (government affairs websites). The Supreme People's Court shall establish “China's Enforcement Information Disclosure Website,” set up an entrance for “China's Judicial Process Information Disclosure Website (http://www.court.gov.cn/),” and provide the function of inquiry about information on the process of enforcement cases and the links of the platforms for the disclosure of the information on the enforcement process of people's court at all levels on the government affairs websites. People's courts at all levels shall establish voice telephone systems, and set up electronic touch screens in case filling halls or petition reception places, to allow parties to cases, their authorized agents, and the public to inquire about matters on disclosure of enforcement. Eligible courts shall establish electronic bulletin screens, increase 12368 Smart SMS service platforms, MicroBlog of people's courts, public WeChat accounts of people's courts, and other public channels in the building of command systems. | | 各级人民法院应当在本院门户网站（政务网）下设的审判流程信息公开网上建立查询执行流程信息的功能模块。最高人民法院在政务网上建立“中国执行信息公开网”，开设“中国审判流程信息公开网”的入口，提供查询执行案件流程信息的功能以及全国各级人民法院执行流程信息公开平台的链接。各级人民法院应当建立电话语音系统，在立案大厅或信访接待等场所设立电子触摸屏，供案件当事人和委托代理人以及社会公众查阅有关执行公开事项。具备条件的法院，应当建立电子公告屏、在执行指挥系统建设中增加12368智能短信服务平台、法院微博以及法院微信公众号等公开渠道。 |
| II. Channels and contents to be disclosed | | 二、公开的渠道和内容 |
| Article 3 The following information on enforcement of cases shall be disclosed to parties and their authorized agents: | | 第三条 下列执行案件信息应当向当事人及委托代理人公开： |
| 1. The names of parties, case numbers, causes of action, case filing dates, and other filing information. | | （一）当事人名称、案号、案由、立案日期等立案信息； |
| 2. The names and office telephone numbers of the enforcement judges and court clerks. | | （二）执行法官以及书记员的姓名和办公电话； |
| 3. Information on enforcement measures adopted, including information on inquiry about, sealing up, freezing, deduction, seizure, and other information of property of persons subject to enforcement. | | （三）采取执行措施信息，包括被执行人财产查询、查封、冻结、扣划、扣押等信息； |
| 4. Information on compulsory measures adopted, including information on judicial detention, fines, summon by warrant, search and restricted departure, restrictions on high consumption, list of dishonest persons subject to enforcement, and other items. | | （四）采取强制措施信息，包括司法拘留、罚款、拘传、搜查以及限制出境、限制高消费、纳入失信被执行人名单库等信息； |
| 5. Information on disposal of property subject to enforcement, including information on entrusted assessment, auction, selling off, offsetting debts with property and other items. | | （五）执行财产处置信息，包括委托评估、拍卖、变卖、以物抵债等信息； |
| 6. Information on distribution of creditor's rights and receipt and payment of funds subject to enforcement, including information on plans for distribution of creditor's rights, objection to plans for distribution of creditor's rights, modifications to plans for distribution of creditor's rights, remittance of funds subject to enforcement to the specialized accounts of people's courts for enforcement, transfer of funds subject to enforcement, and other items. | | （六）债权分配和执行款收付信息，包括债权分配方案、债权分配方案异议、债权分配方案修改、执行款进入法院执行专用账户、执行款划付等信息； |
| 7. Information on postponement of enforcement, suspension of enforcement, entrusted enforcement, designated enforcement, enforcement by a court at a higher level, and other items. | | （七）暂缓执行、中止执行、委托执行、指定执行、提级执行等信息； |
| 8. Information on agreement on conciliation of enforcement. | | （八）执行和解协议信息； |
| 9. Information on settling enforcement cases, including information on date of settling enforcement cases, readiness of enforcement subject matters, case settling ways, soliciting for opinions of enforcement applicant for conclusion of this enforcement process, and other items. | | （九）执行实施案件结案信息，包括执行结案日期、执行标的到位情况、结案方式、终结本次执行程序征求申请执行人意见等信息； |
| 10. Information on the filing time, names and office telephone numbers of the judges handling the case, other members of the collegiate bench, and court clerks, ruling for enforcement, time for settling cases, and other items of cases of objection to enforcement, reconsideration of enforcement, objection of a person who is not a party to a case, changing and adding enforcement subject, and so on. | | （十）执行异议、执行复议、案外人异议、执行主体变更和追加等案件的立案时间、案件承办法官和合议庭其他组成人员以及书记员的姓名和办公电话、执行裁决、结案时间等信息； |
| 11. Information on the filing time, names and office telephone numbers of the judges handling the case, other members of the collegiate bench, and court clerks, opinions on handling of a case, time for settling cases, and other items of cases of complaints and petitions on enforcement, enforcement urging, enforcement supervision, and so on. | | （十一）执行申诉信访、执行督促、执行监督等案件的立案时间、案件承办法官和合议庭其他组成人员以及书记员的姓名和办公电话、案件处理意见、结案时间等信息； |
| 12. Information on time and place of hearing and inquiry of enforcement. | | （十二）执行听证、询问的时间、地点等信息； |
| 13. The enforcement period or review period, as well as the deduction, extension and other changes in the enforcement period or review period. | | （十三）案件的执行期限或审查期限，以及执行期限或审查期限扣除、延长等变更情况； |
14. Notice on acceptance of an enforcement case, notice on enforcement, notice on property declaration, inquiry notice, notice on hearing, summons and records of question, records of investigation and evidence collection, records of enforcement hearing, and other materials.
