The Interpretation of the Supreme People's Court and the Supreme People's Procuratorate on Several Issues Concerning the Specific Application of Law in the Trial of Criminal Cases on Swindling, which was adopted at the 1512th meeting of the Judicial Committee of the Supreme People's Court on February 21, 2011 and the 49th meeting of the 11th Procuratorial Committee of the Supreme People's Procuratorate, is hereby promulgated, and shall come into force on April 8, 2011. | |
最高人民法院、最高人民检察院《关于办理诈骗刑事案件具体应用法律若干问题的解释》已于2011年2月21日由最高人民法院审判委员会第1512次会议、2010年11月24日由最高人民检察院第十一届检察委员会第49次会议通过，现予公布，自2011年4月8日起施行。 |

To punish the criminal activities on swindling and protect the public and private property ownerships, according to the relevant provisions of the Criminal Law and the Criminal Procedure Law and in light of the needs for judicial practice, we hereby make the following interpretation on several issues concerning the specific application of law in the trial of criminal cases on swindling: | |
为依法惩治诈骗犯罪活动，保护公私财产所有权，根据刑法、刑事诉讼法有关规定，结合司法实践的需要，现就办理诈骗刑事案件具体应用法律的若干问题解释如下： |

| Article 1 If the value of the public or private property involved in a swindling case is 3,000 yuan to 10,000 yuan and more, 30,000 yuan to 100,000 yuan and more or 500,000 yuan and more, it shall be deemed a “relatively large amount”, “large amount” or “particularly large amount” as mentioned in Article 266 of the Criminal Law. | | 第一条 诈骗公私财物价值三千元至一万元以上、三万元至十万元以上、五十万元以上的，应当分别认定为刑法第二百六十六条规定的“数额较大”、“数额巨大”、“数额特别巨大”。 |
The higher people's courts and the higher people's procuratorates of all provinces, autonomous regions and municipalities directly under the Central Government may, in light of the local economic and social development level, determine the specific amounts applicable in their respective regions within the ranges mentioned in the preceding paragraph and report them to the Supreme People's Court and the Supreme People's Procuratorate for archival purposes. | |
各省、自治区、直辖市高级人民法院、人民检察院可以结合本地区经济社会发展状况，在前款规定的数额幅度内，共同研究确定本地区执行的具体数额标准，报最高人民法院、最高人民检察院备案。 |

| Article 2 Anyone who swindles public or private property at an amount mentioned in Article 1 of this Interpretation under any of the following circumstances shall be given a discretionary severe punishment under Article 266 of the Criminal Law: | | 第二条 诈骗公私财物达到本解释第一条规定的数额标准，具有下列情形之一的，可以依照刑法第二百六十六条的规定酌情从严惩处： |

| 1. Defrauding an unspecific majority of people by sending text messages, making phone calls or releasing false information on internet, radio, TV, newspapers, periodicals, etc.; | | （一）通过发送短信、拨打电话或者利用互联网、广播电视、报刊杂志等发布虚假信息，对不特定多数人实施诈骗的； |

| 2. Swindling funds used for disaster relief, emergency rescue, flood prevention, special care, poverty relief, migration, salvation or medical treatment; | | （二）诈骗救灾、抢险、防汛、优抚、扶贫、移民、救济、医疗款物的； |
| |
|
| 3. Swindling money in the name of collecting donations to relieve the people in disaster; | | （三）以赈灾募捐名义实施诈骗的； |
| |

4. Swindling the money or goods of the disabled, the aged or the incapacitated; or
