The Auction Law of the People's Republic of China, adopted at the 20th Meeting of the Standing Committee of the Eighth National People's Congress of the People's Republic of China on July 5, 1996, is hereby promulgated and shall enter into force as of January 1, 1997.

CHAPTER I GENERAL PROVISIONS 

第一章 总则


 
Article 1 This Law is enacted for the purpose of standardizing acts of auction, maintaining order of auction and protecting the lawful rights and interests of all the parties in activities of auction.   第一条 为了规范拍卖行为,维护拍卖秩序,保护拍卖活动各方当事人的合法权益,制定本法。

 
Article 2 This Law applies to auction activities conducted by auction enterprises within the territory of the People's Republic of China.   第二条 本法适用于中华人民共和国境内拍卖企业进行的拍卖活动。

 
Article 3 Auction refers to the means of selling and buying by which specific articles or goods or property rights are transferred through public bidding to the bidder that offers the highest price.   第三条 拍卖是指以公开竞价的形式,将特定物品或者财产权利转让给最高应价者的买卖方式。

 
Article 4 The parties in activities of auction shall abide by the relevant laws and administrative rules and regulations and adhere to the principles of openness, fairness, justice and good faith.   第四条 拍卖活动应当遵守有关法律、行政法规,遵循公开、公平、公正、诚实信用的原则。

 
Article 5 The department in charge of administration of the auction trade under the State Council shall exercise supervision over and administration of the auction trade throughout the country.   第五条 国务院负责管理拍卖业的部门对全国拍卖业实施监督管理。

The departments in charge of administration of the auction trade under the people's governments of provinces, autonomous regions, municipalities directly under the Central Government, or cities divided into districts shall exercise supervision over and administration of the auction trade in their respective administrative regions.
 
省、自治区、直辖市的人民政府和设区的市的人民政府负责管理拍卖业的部门对本行政区域内的拍卖业实施监督管理。

The public security organ shall exercise public order control over the auction trade in the same way as they deal with special trades.
 
公安机关对拍卖业按照特种行业实施治安管理。

 

CHAPTER II OBJECTS OF AUCTION 

第二章 拍卖标的


 
Article 6 Objects of auction shall be the articles or goods or property rights which are owned by the client or which the client may dispose of according to law.   第六条 拍卖标的应当是委托人所有或者依法可以处分的物品或者财产权利。

 
Article 7 Articles or goods or property rights prohibited for sale by laws or administrative rules and regulations shall not be made objects of auction.   第七条 法律、行政法规禁止买卖的物品或者财产权利,不得作为拍卖标的。

 
Article 8 With respect to the articles or goods or property rights whose transference is subject to examination and approval as provided for by laws or regulations of the State Council, the parties concerned shall, prior to their auction, go through the formalities for the examination and approval according to law.   第八条 依照法律或者按照国务院规定需经审批才能转让的物品或者财产权利,在拍卖前,应当依法办理审批手续。

With respect to the cultural relics under authorization for auction, they shall, prior to their auction, be subject to appraisal and permission given according to law by the administrative department for cultural relics in the place where the auctioneer's residence is located.
 
委托拍卖的文物,在拍卖前,应当经拍卖人住所地的文物行政管理部门依法鉴定、许可。

 
Article 9 With respect to articles or goods confiscated or used to offset tax money or fines by the administrative organs of the State in accordance with law and other articles or goods, all of which should be auctioned through authorization as prescribed by regulations of the State Council, the auction shall be conducted by auctioneers designated by the people's governments of the provinces, autonomous regions or municipalities directly under the Central Government or of the cities divided into districts, where such property is located.   第九条 国家行政机关依法没收的物品,充抵税款、罚款的物品和其他物品,按照国务院规定应当委托拍卖的,由财产所在地的省、自治区、直辖市的人民政府和设区的市的人民政府指定的拍卖人进行拍卖。

Auction of articles or goods confiscated or used to offset tax money or fines by the People's Courts in accordance with law and other articles or goods that are retrieved but cannot be returned to their owners shall be governed by the provisions of the preceding paragraph.
 
拍卖由人民法院依法没收的物品,充抵罚金、罚款的物品以及无法返还的追回物品,适用前款规定。

 

CHAPTER III PARTIES TO AUCTION 

第三章 拍卖当事人


 
SECTION 1 AUCTIONEER 

第一节 拍卖人


 
Article 10 An auctioneer refers to an enterprise legal person that is established in accordance with this Law and the Company Law of the People's Republic of China and engaged in activities of auction.   第十条 拍卖人是指依照本法和《中华人民共和国公司法》设立的从事拍卖活动的企业法人。

 
Article 11 Auction enterprises may be established in cities divided into districts. Establishment of an auction enterprise shall be subject to examination, verification and permission by the department in charge of the auction trade under the people's government of the province, autonomous region, or municipality directly under the Central Government in the place where the enterprise is to be established and shall be registered with the administrative department for industry and commerce for obtaining of a business license.   第十一条 拍卖企业可以在设区的市设立。设立拍卖企业必须经所在地的省、自治区、直辖市人民政府负责管理拍卖业的部门审核许可,并向工商行政管理部门申请登记,领取营业执照。

 
Article 12 To establish an auction enterprise, the following conditions shall be satisfied:   第十二条 设立拍卖企业,应当具备下列条件:

 
(1) having a registered capital of RMB one million yuan or more; (一)有一百万元人民币以上的注册资本;

 
(2) having its own name, organizational structure, premises and Articles of Association; (二)有自己的名称、组织机构、住所和章程;

 
(3) having auction masters and other employees commensurate to the trade; (三)有与从事拍卖业务相适应的拍卖师和其他工作人员;

 
(4) having rules for the auction trade that comform to the provisions of this Law and other relevant laws; (四)有符合本法和其他有关法律规定的拍卖业务规则;

 
(5) having the permit for special trade issued by the public security organ; (五)有公安机关颁发的特种行业许可证;

 
(6) complying with the regulations of the State Council regarding development of the auction trade; and (六)符合国务院有关拍卖业发展的规定;

 
(7) other conditions as provided for by laws or administrative rules and regulations. (七)法律、行政法规规定的其他条件。

 
Article 13 An auction enterprise engaged in the auction of cultural relics shall have a registered capital of RMB 10 million yuan or more and employees equipped with the professional knowledge about auction of cultural relics.   第十三条 拍卖企业经营文物拍卖的,应当有一千万元人民币以上的注册资本,有具有文物拍卖专业知识的人员。

 
Article 14 Auction activities shall be presided over by auction masters.   第十四条 拍卖活动应当由拍卖师主持。

 
Article 15 An auction master shall satisfy the following requirements:   第十五条 拍卖师应当具备下列条件:

 
(1) having acquired a 3-year college education or a higher education and professional knowledge about auction; (一)具有高等院校专科以上学历和拍卖专业知识;

 
(2) having worked two years at least in an auction enterprise; and (二)在拍卖企业工作两年以上;

 
(3) being a person of good conduct. (三)品行良好。

If a person has been discharged from public employment or his qualification certificate of auction master rescinded for less than five years or has been subjected to criminal punishment for intentional offense, he shall not be employed as an auction master.
 
被开除公职或者吊销拍卖师资格证书未满五年的,或者因故意犯罪受过刑事处罚的,不得担任拍卖师。

 
Article 16 Examination for qualification of auction masters shall be arranged exclusively by the Auction Trade Association. Persons who pass the examination shall be issued qualification certificates for auction masters by the said association.   第十六条 拍卖师资格考核,由拍卖行业协会统一组织。经考核合格的,由拍卖行业协会发给拍卖师资格证书。

 
Article 17 The Auction Trade Association is a public organization legal person established in accordance with law and a self-disciplined organization for the trade of auction. The Auction Trade Association shall, in accordance with this Law and its own Articles of Association, exercise supervision over auction enterprises and masters.   第十七条 拍卖行业协会是依法成立的社会团体法人,是拍卖业的自律性组织。拍卖行业协会依照本法并根据章程,对拍卖企业和拍卖师进行监督。

 
Article 18 An auctioneer shall have the right to request his clients to make clear the origins and defects of the objects of auction.   第十八条 拍卖人有权要求委托人说明拍卖标的的来源和瑕疵。

An auctioneer shall make defects of the objects of auction known to bidders.
 
拍卖人应当向竞买人说明拍卖标的的瑕疵。

 
Article 19 An auctioneer shall have the obligation of taking care of the articles or goods delivered by his clients to him for auction sale.   第十九条 拍卖人对委托人交付拍卖的物品负有保管义务。

 
Article 20 After accepting authorization, the auctioneer may not authorize another auctioneer to perform the auction without prior consent of his client.   第二十条 拍卖人接受委托后,未经委托人同意,不得委托其他拍卖人拍卖。

 
Article 21 An auctioneer shall keep the identity of his client or vendee confidential if so requested.   第二十一条 委托人、买受人要求对其身份保密的,拍卖人应当为其保密。

 
Article 22 An auctioneer and his employees may not get involved as bidders in the auction sale which is arranged by themselves and may not authorize another to act as a bidder on their behalf.   第二十二条 拍卖人及其工作人员不得以竞买人的身份参加与自己组织的拍卖活动,并不得委托他人代为竞买。

 
Article 23 An auctioneer may not put his own articles or goods or property rights on an auction sale which is arranged by himself.   第二十三条 拍卖人不得在自己组织的拍卖活动中拍卖自己的物品或者财产权利。

 
Article 24 When an auction transaction is concluded, the auctioneer shall deliver the money paid for the objects of auction to the clients as agreed and transfer the objects of auction to the vendees as agreed.   第二十四条 拍卖成交后,拍卖人应当按照约定向委托人交付拍卖标的的价款,并按照约定将拍卖标的移交给买受人。

 

SECTION 2 CLIENT 

第二节 委托人


 
Article 25 A client refers to a citizen, legal person or other organization that authorizes an auctioneer to auction his or its articles, goods or property rights.   第二十五条 委托人是指委托拍卖人拍卖物品或者财产权利的公民、法人或者其他组织。

 
Article 26 A client may go through the formalities for authorization of auction by himself or through his agent.   第二十六条 委托人可以自行办理委托拍卖手续,也可以由其代理人代为办理委托拍卖手续。

 
Article 27 A client shall make clear the origins and defects of the objects of auction to the auctioneer.   第二十七条 委托人应当向拍卖人说明拍卖标的的来源和瑕疵。

 
Article 28 A client shall have the right to determine the reservation price for the objects of auction and require the auctioneer to keep it confidential.   第二十八条 委托人有权确定拍卖标的的保留价并要求拍卖人保密。

With respect to auction of State assets, assessment of which is required by law or regulations of the State Council, assessment shall be made by the appraisal institution established according to law, and reservation prices for the objects of auction shall be determined on the basis of the assessment made.
 
拍卖国有资产,依照法律或者按照国务院规定需要评估的,应当经依法设立的评估机构评估,并根据评估结果确定拍卖标的的保留价。

 
Article 29 A client may withdraw the objects of auction before the auction sale commences. In such a case, the client shall pay to the auctioneer the expenses as agreed; in the absence of such an agreement, the client shall pay to the auctioneer a reasonable amount of expenses.   第二十九条 委托人在拍卖开始前可以撤回拍卖标的。委托人撤回拍卖标的的,应当向拍卖人支付约定的费用;未作约定的,应当向拍卖人支付为拍卖支出的合理费用。

 
Article 30 A client may not participate in bidding and may not authorize another to bid on his behalf.   第三十条 委托人不得参与竞买,也不得委托人他代为竞买。

 
Article 31 Where it is agreed that the objects of auction shall be transferred by the client, after the auction transaction is concluded, the client shall transfer the objects of auction to the vendees.   第三十一条 按照约定由委托人移交拍卖标的的,拍卖成交后,委托人应当将拍卖标的移交给买受人。

 

SECTION 3 BIDDER 

第三节 竞买人


 
Article 32 A bidder refers to a citizen, legal person or other organization that participates in the bidding for objects of auction.   第三十二条 竞买人是指参加竞购拍卖标的的公民、法人或者其他组织。

 
Article 33 Where requirements for selling and buying of objects of auction are prescribed in law or administrative rules and regulations, a bidder shall meet those requirements.   第三十三条 法律、行政法规对拍卖标的的买卖条件有规定的,竞买人应当具备规定的条件。

 
Article 34 A bidder may take part in bidding by himself or authorize his agent to participate in it.   第三十四条 竞买人可以自行参加竞买,也可以委托其代理人参加竞买。

 
Article 35 A bidder shall have the right to be informed of defects of the objects of auction and the right to inspect them and to have access to information pertaining to them.   第三十五条 竞买人有权了解拍卖标的的瑕疵,有权查验拍卖标的和查阅有关拍卖资料。

 
Article 36 Once a bidder bids for a price, it shall be irrevocable, and it shall lose its binding force as soon as another bidder offers a higher price.   第三十六条 竞买人一经应价,不得撤回,当其他竞买人有更高应价时,其应价即丧失约束力。

 
Article 37 Bidders or bidders and auctioneers may not collude with each other out of ill intention to harm the interests of another.   第三十七条 竞买人之间、竞买人与拍卖人之间不得恶意串通,损害他人利益。

 

SECTION 4 VENDEE 

第四节 买受人


 
Article 38 A vendee refers to a bidder who purchases an object of auction at the highest price offered by him.   第三十八条 买受人是指以最高应价购得拍卖标的的竞买人。

 
Article 39 A vendee shall pay for the object of auction at the price agreed, failing that, he shall bear liabilities for default or, with the consent of the client, the auctioneer may put the object of auction up at auction again.   第三十九条 买受人应当按照约定支付拍卖标的的价款,未按照约定支付价款的,应当承担违约责任,或者由拍卖人征得委托人的同意,将拍卖标的再行拍卖。

Where the object of auction is auctioned again, the former vendee shall pay the commission he himself and the client should pay for the first auction sale. Where the price for the second auction sale is lower than that for the first one, the former vendee shall make up the difference.
 
拍卖标的再行拍卖的,原买受人应当支付第一次拍卖中本人及委托人应当支付的佣金。再行拍卖的价款低于原拍卖价款的,原买受人应当补足差额。

 
Article 40 Where a vendee fails to obtain the object of auction as agreed, he shall have the right to request the auctioneer or client to bear liabilities for default.   第四十条 买受人未能按照约定取得拍卖标的的,有权要求拍卖人或者委托人承担违约责任。

Where a vendee fails to collect the object of auction as agreed, he shall pay the storage charge incurred thereby.
 
买受人未按照约定受领拍卖标的的,应当支付由此产生的保管费用。

 

CHAPTER IV AUCTION PROCEDURES 

第四章 拍卖程序


 
SECTION 1 AUTHORIZATION OF AUCTION 

第一节 拍卖委托


 
Article 41 When a client authorizes auction of articles or goods or property rights, he shall provide his identity certificate and, as required by the auctioneer, the ownership certificate for the objects of auction, or certificates and any other materials testifying that he may dispose of the objects of auction according to law.   第四十一条 委托人委托拍卖物品或者财产权利,应当提供身份证明和拍卖人要求提供的拍卖标的的所有权证明或者依法可以处分拍卖标的的证明及其他资料。

 
Article 42 The auctioneer shall verify the relevant certificates and materials provided by the client. When an auctioneer accepts authorization, he shall sign a contract for authorization of auction with the client.   第四十二条 拍卖人应当对委托人提供的有关文件、资料进行核实。拍卖人接受委托的,应当与委托人签订书面委托拍卖合同。

 
Article 43 The auctioneer may have the objects of auction evaluated, if he deems it necessary.   第四十三条 拍卖人认为需要对拍卖标的进行鉴定的,可以进行鉴定。

Where the conclusion of the expert evaluation does not conform to the descriptions of the objects of auction as specified in the contract for authorization of auction, the auctioneer shall have the right to demand modification or cancellation of the contract.
 
鉴定结论与委托拍卖合同载明的拍卖标的状况不相符的,拍卖人有权要求变更或者解除合同。

 
Article 44 In a contract for authorization of auction, the following particulars shall be specified:   第四十四条 委托拍卖合同应当载明以下事项:

 
(1) name or title and address of the client and auctioneer; (一)委托人、拍卖人的姓名或者名称、住所;

 
(2) title, specifications, quantity and quality of the object of auction; (二)拍卖标的的名称、规格、数量、质量;

 
(3) reservation price offered by the client; (三)委托人提出的保留价;

 
(4) time and place of the auction; (四)拍卖的时间、地点;

 
(5) time and manner of delivery or transference of the object of auction; (五)拍卖标的交付或者转移的时间、方式;

 
(6) commission, manner and time limit for its payment; (六)佣金及其支付的方式、期限;

 
(7) manner and time limit for payment of the purchase; (七)价款的支付方式、期限;

 
(8) liabilities for default; and (八)违约责任;

 
(9) other matters as agreed upon between both parties. (九)双方约定的其他事项。

 

SECTION 2 ANNOUNCEMENT OF AUCTION AND DISPLAY OF OBJECTS OF AUCTION 

第二节 拍卖公告与展示


 
Article 45 The auctioneer shall announce the opening of an auction seven days prior to the date of auction.   第四十五条 拍卖人应当于拍卖日七日前发布拍卖公告。

 
Article 46 In the announcement of auction, the following particulars shall be specified:   第四十六条 拍卖公告应当载明下列事项:

 
(1) time and place of auction; (一)拍卖的时间、地点;

 
(2) objects of auction; (二)拍卖标的;

 
(3) time and place for display of the objects of auction; (三)拍卖标的展示时间、地点;

 
(4) formalities to go through for participating in bidding; and (四)参与竞买应当办理的手续;

 
(5) other matters that need be announced. (五)需要公告的其他事项。

 
Article 47 Announcement of an auction shall be released through newspapers or other media.   第四十七条 拍卖公告应当通过报纸或者其他新闻媒介发布。

 
Article 48 The auctioneer shall display the objects of auction prior to the auction sale and provide relevant information and conditions for bidders to check the objects of auction.   第四十八条 拍卖人应当在拍卖前展示拍卖标的,并提供查看拍卖标的的条件及有关资料。

The duration of display shall be not less than two days.
 
拍卖标的展示时间不得少于两日。

 

SECTION 3 EXECUTION OF AUCTION 

第三节 拍卖的实施


 
Article 49 The auction master shall announce the auction rules and points for attention before the auction sale takes place.   第四十九条 拍卖师应当于拍卖前宣布拍卖规则和注意事项。

 
Article 50 Where there is no reservation price for an object of auction, the auction master shall make it clear before the auction sale.   第五十条 拍卖标的无保留价的,拍卖师应当在拍卖前予以说明。

Where there is a reservation price for an object of auction and the highest price offered by a bidder does not reach the reservation price, the offer shall be non-binding and the auction master shall suspend the auction sale of the said object.
 
拍卖标的有保留价的,竞买人的最高应价未达到保留价时,该应价不发生效力,拍卖师应当停止拍卖标的的拍卖。

 
Article 51 When the highest offer is confirmed by the auction master by knocking the gavel or any other way of public confirmation, the auction transaction is concluded.   第五十一条 竞买人的最高应价经拍卖师落槌或者以其他公开表示买定的方式确认后,拍卖成交。

 
Article 52 After a transaction is concluded, the vendee and the auctioneer shall execute a written confirmation.   第五十二条 拍卖成交后,买受人和拍卖人应当签署成交确认书。

 
Article 53 When an auction sale is under way, minutes of auction shall be made and signed by the auction master and the recorder, as well as the vendee if a transaction is concluded.   第五十三条 拍卖人进行拍卖时,应当制作拍卖笔录。拍卖笔录应当由拍卖师、记录人签名;拍卖成交的,还应当由买受人签名。

 
Article 54 The auctioneer shall properly keep the complete set of account books relating to business operation, the auction minutes and any other relevant materials.   第五十四条 拍卖人应当妥善保管有关业务经营活动的完整帐簿、拍卖笔录和其他有关资料。

The period for maintaining the account books, auction minutes and other relevant materials as specified in the preceding paragraph shall be not less than five years, counting from the date of expiration of the contract for authorization of auction.
 
前款规定的帐簿、拍卖笔录和其他有关资料的保管期限,自委托拍卖合同终止之日起计算,不得少于五年。

 
Article 55 Where it is necessary to make changes in certificates or licenses or to transfer ownership of property rights, in accordance with law, with regard to the objects of auction, the client and vendee shall go through the formalities with the relevant administrative organ by producing the transaction certificate prepared by the auctioneer and relevant materials.   第五十五条 拍卖标的需要依法办理证照变更、产权过户手续的,委托人、买受人应当持拍卖人出具的成交证明和有关材料,向有关行政管理机关办理手续。

 

SECTION 4 COMMISSION 

第四节 佣金


 
Article 56 The client and vendee may reach an agreement with the auctioneer on the proportion of commission.   第五十六条 委托人、买受人可以与拍卖人约定佣金的比例。

Where a transaction is concluded in the absence of such an agreement, the auctioneer may charge a commission of not more than five percent of the transaction price from the client and the vendee respectively. The proportion of commission to be charged shall be determined according to the principle that it is in inverse proportion to the transaction price.
 
委托人、买受人与拍卖人对佣金比例未作约定,拍卖成交的,拍卖人可以向委托人、买受人各收取不超过拍卖成交价百分之五的佣金。收取佣金的比例按照同拍卖成交价成反比的原则确定。

Where no transaction is concluded, the auctioneer may charge the client the expenses as agreed. In the absence of an agreement, the auctioneer may charge the client a reasonable amount for the expenses of auction.
 
拍卖未成交的,拍卖人可以向委托人收取约定的费用;未作约定的,可以向委托人收取为拍卖支出的合理费用。

 
Article 57 For the auction of articles or goods specified in Article 9 of this Law, where a transaction is concluded, the auctioneer may charge the vendee a commission of not more than five percent of the transaction price. The proportion of commission to be charged shall be determined according to the principle that it is in inverse proportion to the transaction price.   第五十七条 拍卖本法第九条规定的物品成交的,拍卖人可以向买受人收取不超过拍卖成交价百分之五的佣金。收取佣金的比例按照同拍卖成交价成反比的原则确定。

In case no transaction is concluded, the provisions of Paragraph 3, Article 56 of this Law shall apply.
 
拍卖未成交的,适用本法第五十六条第三款的规定。

 

CHAPTER V LEGAL LIABILITY 

第五章 法律责任


 
Article 58 Where a client, in violation of the provisions of Article 6 of this Law, authorizes auction of articles or goods or property rights that he does not own or he has no right to dispose of according to law, he shall bear liability according to law. Where the auctioneer knowingly auctions articles or goods or property rights that the client does not own or has no right to dispose of according to law, he shall bear joint and several liability.   第五十八条 委托人违反本法第六条的规定,委托拍卖其没有所有权或者依法不得处分的物品或者财产权利的,应当依法承担责任。拍卖人明知委托人对拍卖的物品或者财产权利没有所有权或者依法不得处分的,应当承担连带责任。

 
Article 59 Where a State organ, in violation of the provisions of Article 9 of this Law and without permission, disposes of articles or goods for the auction of which it should authorize the auctioneer designated by the people's government of the province, autonomous region, municipality directly under the Central Government or of the city divided into districts where such property is located, the persons who are directly in charge and other persons who are directly responsible for the offense shall be given administrative sanctions according to law, where losses have been caused to the State, they shall be liable for compensation.   第五十九条 国家机关违反本法第九条的规定,将应当委托财产所在地的省、自治区、直辖市的人民政府或者设区的市的人民政府指定的拍卖人拍卖的物品擅自处理的,对负有直接责任的主管人员和其他直接责任人员依法给予行政处分,给国家造成损失的,还应当承担赔偿责任。

 
Article 60 If anyone, in violation of the provisions of Article 11 of this Law, establishes an auction enterprise without permission and registration, the enterprise shall be banned by the administrative department for industry and commerce, the illegal gains shall be confiscated and he may also be fined not less than one time and not more than five times the amount of the illegal gains.   第六十条 违反本法第十一条的规定,未经许可登记设立拍卖企业的,由工商行政管理部门予以取缔,没收违法所得,并可以处违法所得一倍以上五倍以下的罚款。

 
Article 61 Where an auctioneer or client, in violation of the provisions of Paragraph 2, Article 18, or Article 27 of this Law, fails to make clear defects of the objects of auction and thus causes losses to the vendee, the vendee shall have the right to claim compensation from the auctioneer; where the client is responsible for the loss, the auctioneer shall have the right of recourse against the client.   第六十一条 拍卖人、委托人违反本法第十八条第二款、第二十七条的规定,未说明拍卖标的的瑕疵,给买受人造成损害的,买受人有权向拍卖人要求赔偿;属于委托人责任的,拍卖人有权向委托人追偿。

Where an auctioneer and client declare, prior to the auction sale, that they cannot guarantee the genuineness or quality of an object of auction, they shall not be liable for the guaranty of the object.
 
拍卖人、委托人在拍卖前声明不能保证拍卖标的的真伪或者品质的,不承担瑕疵担保责任。

In the absence of such declaration, the period for limitation of action for claim of compensation shall be one year, counted from the day the party concerned came to know or should have known that his rights were encroached upon.
 
因拍卖标的存在瑕疵未声明的,请求赔偿的诉讼时效期间为一年,自当事人知道或者应当知道权利受到损害之日起计算。

The period for limitation of action for claim of compensation for personal or property damage occasioned by defects in an object of auction shall be governed by the relevant provisions of the Law of the People's Republic of China on Product Quality and other laws.
 
因拍卖标的存在缺陷造成人身、财产损害请求赔偿的诉讼时效期间,适用《中华人民共和国产品质量法》和其他法律的有关规定。

 
Article 62 Where an auctioneer or any of his employees, in violation of the provisions of Article 22 of this Law, participates in bidding or authorizes another to bid on his behalf, the administrative department for industry and commerce shall give the auctioneer a disciplinary warning, and may impose on him a fine of not less than one time and not more than five times the commission for auction. If the violation is serious, his business license shall be revoked.   第六十二条 拍卖人及其工作人员违反本法第二十二条的规定,参与竞买或者委托他人代为竞买的,由工商行政管理部门对拍卖人给予警告,可以处拍卖佣金一倍以上五倍以下的罚款;情节严重的,吊销营业执照。

 
Article 63 Where, in violation of the provisions of Article 23 of this Law, an auctioneer puts his own articles or goods or property rights up at auction that is arranged by himself, the administrative department for industry and commerce shall confiscate his earnings from the auction sale.   第六十三条 违反本法第二十三条的规定,拍卖人在自己组织的拍卖活动中拍卖自己的物品或者财产权利的,由工商行政管理部门没收拍卖所得。

 
Article 64 Where, in violation of the provisions of Article 30 of this Law, a client participates in bidding or authorizes another to bid on his behalf, the administrative department for industry and commerce may impose on him a fine of not more than 30% of the transaction price.   第六十四条 违反本法第三十条的规定,委托人参与竞买或者委托他人代为竞买的,工商行政管理部门可以对委托人处拍卖成交价百分之三十以下的罚款。

 
Article 65 Where, in violation of the provisions of Article 37 of this Law, bidders or bidders and auctioneers collude with each other out of ill intention and thus cause losses to another, the auction shall be invalid and they shall be liable for compensation according to law. The administrative department for industry and commerce shall impose on the bidders that participate in such collusion a fine of not less than 10% and not more than 30% of the highest price offered; it shall impose on the auctioneers that participate in such collusion a fine of not less than 10% and not more than 50% of the highest price offered.   第六十五条 违反本法第三十七条的规定,竞买人之间、竞买人与拍卖人之间恶意串通,给他人造成损害的,拍卖无效,应当依法承担赔偿责任。由工商行政管理部门对参与恶意串通的竞买人处最高应价百分之十以上百分之三十以下的罚款;对参与恶意串通的拍卖人处最高应价百分之十以上百分之五十以下的罚款。

 
Article 66 Where an auctioneer collects commission in violation of the provisions in Section 4 of Chapter IV of this Law regarding the proportion of commission, he shall return the part that exceeds the prescribed proportion to the client and vendee. The price control authorities may impose on the auctioneer a fine of not less than one time and not more than five times the commission for auction.   第六十六条 违反本法第四章第四节关于佣金比例的规定收取佣金的,拍卖人应当将超收部分返还委托人、买受人。物价管理部门可以对拍卖人处拍卖佣金一倍以上五倍以下的罚款。

 

CHAPTER VI SUPPLEMENTARY PROVISIONS 

第六章 附则


 
Article 67 This Law shall apply to foreign nationals, foreign enterprises and organizations that authorize auction or participate in bidding within the territory of the People's Republic of China.   第六十七条 外国人、外国企业和组织在中华人民共和国境内委托拍卖或者参加竞买的,适用本法。

 
Article 68 Auction enterprises, established prior to implementation of this Law, that do not meet the conditions provided for in this Law shall, within the prescribed time limit, meet such conditions; with regard to those that fail to meet the said conditions within the time limit, the administrative department for industry and commerce shall cancel their registration and rescind their business licenses. Specific measures in this regard shall be formulated separately by the State Council.   第六十八条 本法施行前设立的拍卖企业,不具备本法规定的条件的,应当在规定的期限内达到本法规定的条件;逾期未达到本法规定的条件的,由工商行政管理部门注销登记,收缴营业执照。具体实施办法由国务院另行规定。

 
Article 69 This Law shall come into effect as of January 1, 1997.   第六十九条 本法自1997年1月1日起施行。
