| The State Council has decided to amend the Provisions on the Transfer of Suspected Criminal Cases by Administrative Law Enforcement Organs as follows: | | 国务院决定对《行政执法机关移送涉嫌犯罪案件的规定》作如下修改： |
I. One paragraph is added in Article 3 as paragraph 2: “Where, as for a case in the field of intellectual property rights, an administrative law enforcement organ deems based on the evidence collected upon investigation and the case facts ascertained that there is a reasonable suspicion of a crime and it is necessary for a public security organ to take measures to obtain further evidence so as to determine whether the circumstance meets the standards for filing a criminal case for investigation and prosecution, the case shall be transferred to the public security organ.”
