The Several Provisions on Patent Applications of Taiwan Compatriots, as deliberated and adopted at the executive meeting of the State Intellectual Property Office, are hereby promulgated and shall come into force on November 22, 2010.
 
《关于台湾同胞专利申请的若干规定》已经局务会议审议通过,现予公布,自2010年11月22日起施行。

Several Provisions on Patent Applications of Taiwan Compatriots
 
关于台湾同胞专利申请的若干规定

 
Article 1 These Provisions are formulated to facilitate Taiwan compatriots' filing applications for patents with the State Intellectual Property Office.   第一条 为了方便台湾同胞向国家知识产权局申请专利,制定本规定。

 
Article 2 Where, within twelve months from the date on which an applicant in Taiwan region (hereinafter referred to as an “applicant”) files with the competent authority for patent in Taiwan region an application for patenting an invention or utility model for the first time, or within six months from the date on which an applicant files an application for patenting a design for the first time, he/it files with the State Intellectual Property Office an application for patenting the same, he/it may claim the priority of the earlier application in Taiwan region (hereinafter referred to as the “priority in Taiwan region).   第二条 台湾地区申请人(以下简称申请人)在台湾地区专利主管机构第一次提出发明或者实用新型专利申请之日起十二个月内,或者第一次提出外观设计专利申请之日起六个月内,又在国家知识产权局就相同主题提出专利申请的,可以要求享有其台湾地区在先申请的优先权(以下简称台湾地区优先权)。

Where an applicant claims the priority in Taiwan region in accordance with the preceding Paragraph, the application date of the prior application shall be on and after September 12, 2010.
 
申请人根据前款规定要求台湾地区优先权的,其在先申请的申请日应当在2010年9月12日(含当日)以后。

 
Article 3 An applicant may claim one or multiple priorities in Taiwan region in the same application; if he/it claims multiple priorities in Taiwan region, the time limit of the priorities of this application in Taiwan region shall be calculated from the date of the earliest application.   第三条 申请人可以在一件申请中要求一项或者多项台湾地区优先权;要求多项台湾地区优先权的,该申请的台湾地区优先权期限从最早的在先申请的申请日起计算。

 
Article 4 Where an applicant claims the priority in Taiwan region, he/it shall make a declaration in the request when the patent application is filed with the State Intellectual Property Office, and submit, within three months, the duplicate of the prior application document issued by the competent authority for patent in Taiwan region. If the applicant fails to make a declaration in the request or to submit the duplicate of the prior application document within the time limit, the priority in Taiwan region shall be deemed as having not been claimed.   第四条 申请人要求台湾地区优先权的,应当在向国家知识产权局提出专利申请的同时在请求书中声明,并且在三个月内提交由台湾地区专利主管机构出具的在先申请文件的副本;未在请求书中声明或者期满未提交在先申请文件副本的,视为未要求台湾地区优先权。

Where an applicant makes a declaration in the request for claiming the priority in Taiwan region, he/it shall specify the date and sequence number of the prior application, and specify the acceptance authority of the prior application as “Taiwan region”.
 
申请人在请求书中声明要求台湾地区优先权的,应当写明在先申请的申请日和申请号,并写明原受理机构为“台湾地区”。

 
Article 5 Where an applicant claims one or multiple priorities in Taiwan region but fails to specify them in the declaration of the request, or one or two items of the issues of date, sequence number or acceptance authority of a certain prior application are omitted or miswritten in the request, but the applicant submits the duplicate of the prior application document within the prescribed time limit, the State Intellectual Property Office shall notify the applicant to make supplements or correction; if the applicant fails to reply within the time limit or it still does not meet the provisions after supplements or corrections, it shall be deemed that no claim has been made for this priority in Taiwan region.   第五条 申请人要求一项或者多项台湾地区优先权而在请求书的声明中未写明或者错写其中某件在先申请的申请日、申请号和原受理机构名称中的一项或者两项内容,但申请人已在规定的期限内提交了在先申请文件副本的,国家知识产权局应当通知申请人补正;申请人期满未答复或者补正后仍不符合规定的,视为未要求该项台湾地区优先权。

 
Article 6 Where an applicant claims multiple priorities in Taiwan region, he/it shall submit the duplicates of all prior applications documents.   第六条 申请人要求多项台湾地区优先权的,应当提交全部在先申请文件副本。

The duplicate of the prior application document shall at least indicate clearly the acceptance authority of the prior application, the applicant, the date and sequence number of the application. Where the duplicate of the prior application document does not meet the provisions, the State Intellectual Property Office shall notify the applicant to make supplements or correction; if the applicant fails to reply within the time limit or it still does not meet the provisions after supplements or corrections, he/it shall be deemed as having not submitted the duplicate of this prior application document.

在先申请文件副本至少应当表明原受理机构、申请人、申请日、申请号。在先申请文件副本不符合规定的,国家知识产权局应当通知申请人补正;申请人期满未答复或者补正后仍不符合规定的,视为未提交该在先申请文件副本。
