The Provisions on the Administrative Procedures for Law Enforcement against Price Fixing, as formulated in accordance with the Anti-Monopoly Law of the People's Republic of China and deliberated and adopted at the Director's Executive Meeting of the National Development and Reform Commission, are hereby issued and shall come into force on February 1, 2011. | |
根据《中华人民共和国反垄断法》，特制定《反价格垄断行政执法程序规定》，经国家发展和改革委员会主任办公会议讨论通过，现予公布，自2011年2月1日起施行。 |

| Article 1 To regulate and safeguard the legal performance of the anti-price fixing functions of the competent price department of the government and protect the legitimate rights and interests of citizens, legal persons and other organizations, these Provisions are formulated in accordance with the Anti-Monopoly Law of the People's Republic of China (hereinafter referred to as the “Anti-Monopoly Law”). | | 第一条 为规范和保障政府价格主管部门依法履行反价格垄断职责，保护公民、法人和其他组织的合法权益，根据《中华人民共和国反垄断法》（以下简称反垄断法），制定本规定。 |

| Article 2 These Provisions shall apply to the law enforcement of the competent price department of the government against price fixing. | | 第二条 政府价格主管部门实施反价格垄断执法，适用本规定。 |

| Article 3 The competent price department of the State Council shall be responsible for the law enforcement against price fixing across the country. | | 第三条 国务院价格主管部门负责全国反价格垄断执法工作。 |
The competent price department of the people's government of a province, autonomous region or municipality directly under the Central Government as authorized by the competent price department of the State Council shall be responsible for the law enforcement against price fixing within its administrative region. | |
国务院价格主管部门授权的省、自治区、直辖市人民政府价格主管部门，负责本行政区域内的反价格垄断执法工作。 |
A price fixing case which occurs across provinces, autonomous regions and/or municipalities directly under the Central Government shall be investigated and handled by the competent price department of the people's government of the relevant province, autonomous region or municipality directly under the Central Government designated by the competent price department of the State Council, and the competent price department of the State Council shall directly investigate and handle a significant case. | |
对跨省、自治区、直辖市发生的价格垄断案件，由国务院价格主管部门指定有关省、自治区、直辖市人民政府价格主管部门进行查处，重大案件由国务院价格主管部门直接组织查处。 |

| Article 4 The competent price department of the State Council or the people's government of a province, autonomous region or municipality directly under the Central Government may, within its statutory powers, authorize the competent price department of the government at the next lower level to investigate suspected price fixing acts. | | 第四条 对涉嫌价格垄断行为，国务院和省、自治区、直辖市人民政府价格主管部门可以在其法定权限内委托下一级政府价格主管部门实施调查。 |
The authorized competent price department of the government shall, within the scope of authorization, conduct investigation in the name of the authorizing organ, but shall not authorize again any other administrative organ, organization or individual to conduct investigation. | |
受委托的政府价格主管部门在委托范围内，以委托机关的名义实施调查，不得再委托其他行政机关、组织或者个人实施调查。 |

| Article 5 Any entity or individual shall have the right to report a suspected price fixing act to the competent price department of the government. The competent price department of the government shall keep confidential the identity of the informant. | | 第五条 对涉嫌价格垄断行为，任何单位和个人有权向政府价格主管部门举报。政府价格主管部门应当为举报人保密。 |
The competent price department of the government shall conduct necessary investigation on a written report with relevant facts and evidence. The investigation shall cover: | |
举报采用书面形式并提供相关事实和证据的，政府价格主管部门应当进行必要的调查。调查事项包括： |

| 1. whether the informant has reported the same matter to any other administrative organ or brought an action in the people's court; | | （一）举报人是否就同一事项已向其他行政机关举报或者向人民法院提起诉讼； |
| |
|
| 2. the basic information on the accused person; | | （二）被举报人的基本情况； |
| |
|
| 3. the relevant facts and evidence provided by the informant; and | | （三）举报人提供的相关事实和证据； |
| |
|
| 4. other matters that need investigation. | | （四）需要调查的其他事项。 |
| |

| Article 6 When investigating suspected price fixing acts, the competent price department of the government may take the following measures: | | 第六条 政府价格主管部门调查涉嫌价格垄断行为，可以采取下列措施： |
| |
|
| 1. entering the business premises of the business operator under investigation or other relevant places to conduct investigation; | | （一）进入被调查的经营者的营业场所或者其他有关场所进行检查； |
| |
|
| 2. questioning the business operator under investigation, the parties of interest or other relevant entities or individuals (hereinafter referred to as the “persons under investigation”) and requiring them to explain the relevant situations; | | （二）询问被调查的经营者、利害关系人或者其他有关单位或者个人（以下统称被调查人），要求其说明有关情况； |
| |
|
| 3. consulting and copying the relevant bills, agreements, accounting books, business correspondence, electronic data and other documents and materials of the persons under investigation; | | （三）查阅、复制被调查人的有关单证、协议、会计账簿、业务函电、电子数据等文件、资料； |
| |
|
| 4. seizing or impounding the relevant evidence; and | | （四）查封、扣押相关证据； |
| |
|
| 5. inquiring about the bank accounts of the business operator. | | （五）查询经营者的银行账户。 |
Before taking any measure above, a written report shall be submitted to the principal of the competent price department of the government for approval. | |
采取前款规定的措施，应当向政府价格主管部门主要负责人书面报告，并经批准。 |

Article 7 The law enforcement officers may question the persons under investigation by interview, over telephone or in writing.
