The Measures for the Administration of Guns for Shooting Competitive Sports, which were deliberated and adopted at the director's executive meeting of the General Administration of Sport of China on June 11, 2010 and approved by the Ministry of Public Security, are hereby promulgated and shall come into force on January 1, 2011. | |
《射击竞技体育运动枪支管理办法》已于2010年6月11日经国家体育总局局长办公会议审议通过，并经公安部同意，现予公布，自2011年1月1日起施行。 |

| Chapter I General Provisions | | 第一章 总 则 |
| |
|
| Article 1 To strengthen the administration of guns for shooting competitive sports and promote the healthy development of the shooting sport, these Measures are formulated in accordance with the Law of the People's Republic of China on the Control of Guns and the Law of the People's Republic of China on Physical Culture and Sports. | | 第一条 为了加强射击竞技体育运动枪支的管理工作，促进射击运动健康发展，根据《中华人民共和国枪支管理法》和《中华人民共和国体育法》，制定本办法。 |

| Article 2 These Measures shall apply to the administration of guns for shooting competitive sports within the territory of the People's Republic of China. | | 第二条 中华人民共和国境内的射击竞技体育运动枪支管理，适用本办法。 |
| |
|
| Article 3 The term “guns for shooting competitive sports” (hereinafter referred to as the “sports guns”) as mentioned in these Measures shall refer to the guns used in the training for shooting competitions and shooting matches. | | 第三条 本办法所称射击竞技体育运动枪支（以下简称运动枪支），是指开展射击竞技训练、比赛所使用的枪支。 |
The specific varieties and models of sports guns shall be determined and promulgated by the General Administration of Sport of China jointly with the Ministry of Public Security. | |
运动枪支的具体品种和型号由国家体育总局会同公安部确定、发布。 |

| Article 4 The term “shooting competitive sports entities” as mentioned in these Measures shall refer to the enterprises, public institutions and social organizations approved to engage in shooting competitive sports. | | 第四条 本办法所称射击竞技体育运动单位，是指经批准从事开展射击竞技体育运动的企事业单位和社会团体。 |

| Article 5 The Ministry of Public Security shall be in charge of the administration of sports guns in the whole country and the General Administration of Sport of China shall direct and coordinate the administration of sports guns in the whole country. | | 第五条 公安部主管全国运动枪支的管理工作，国家体育总局指导、协调全国运动枪支的管理工作。 |
The local public security organ at or above the county level shall be in charge of the administration of sports guns within its administrative region. The local sport administrative department at or above the county level shall organize and coordinate the supervision and administration of sports guns within its administrative region. | |
县级以上地方各级公安机关主管本行政区域内运动枪支的管理工作。县级以上地方各级体育行政部门组织协调本行政区域内运动枪支的监督管理工作。 |
A shooting competitive sports entity shall be responsible for the daily management of sports guns and its main person in charge is the principal responsible person in its administration of sports guns. | |
射击竞技体育运动单位负责运动枪支的日常管理工作，其主要负责人是本单位运动枪支管理的第一责任人。 |

| Chapter II Examination and Approval of Entities Engaging in Shooting Competitive Sports | | 第二章 从事射击竞技体育运动单位审批 |
| |
|
| Article 6 To apply for engaging in shooting competitive sports, an entity shall meet the following conditions: | | 第六条 申请从事射击竞技体育运动的单位，应当符合下列条件： |
| |
|
| 1. having the legal person status; | | （一）具有法人资格； |
| |
|
| 2. having coaches and the relevant employees with the corresponding qualifications; | | （二）具有相应资质的教练员及相关从业人员； |
| |
|
| 3. having the shooting range meeting the relevant provisions of the state; | | （三）拥有符合国家有关规定的射击场地； |
| |
|
| 4. having facilities for the safe custody of sports guns, which meet the relevant provisions of the state; | | （四）拥有符合国家有关规定的运动枪支安全保管设施； |
| |
|
| 5. having rules on the safety management of sports guns; and | | （五）具备运动枪支安全管理制度； |
| |
|
| 6. meeting other conditions as provided for by laws and regulations. | | （六）符合法律、法规规定的其他条件。 |
| |
|
| Article 7 To apply for engaging in shooting competitive sports, an entity shall submit the following materials to the provincial sport administrative department: | | 第七条 申请从事射击竞技体育运动的单位，应当向省级体育行政部门提交以下材料： |
| |
|
| 1. an application report, which shall include the name and nature of the applicant, the objective of engaging in the shooting sport and the projects to be carried out, fund sources, places (including shooting range and gun and ammunition warehouse), information on the employees, etc.; | | （一）申请报告，内容应当包括申请单位名称和性质、开展射击运动的目的及拟开展项目、经费来源、场地情况（含靶场和枪弹库）、从业人员情况等； |
| |
|
| 2. examination opinions of the organ in charge of its business; | | （二）业务主管单位审核意见； |
| |
|
| 3. legal person registration certificate and the identity certificate of the legal representative and the photocopies thereof; | | （三）法人登记证书和法定代表人身份证明及复印件； |
| |
|
| 4. provisions on the safety management of usage of guns and ammunition, provisions on the safety management of gun and ammunition warehouse, the gun and ammunition safety management responsibility system, etc.; | | （四）枪弹使用安全管理规定、枪弹库安全管理规定和枪弹安全管理责任制等； |
| |
|
| 5. coach qualification certificate and its photocopy; | | （五）教练员资格证明及其复印件； |
| |
|
| 6. certificate on the ownership of or right to use the shooting range and its photocopy; | | （六）射击场地所有权或者使用权证明及其复印件； |
| |
|
| 7. the shooting range qualification issued by the local sport administrative department at or above the county level; | | （七）所在地县级以上体育行政部门出具的射击场地合格证明； |
| |
|
| 8. the certificate on the acceptance of sports gun custody facilities issued by the local public security organ at or above the county level; and | | （八）所在地县级以上公安机关出具的运动枪支保管设施验收合格证明； |
| |
|
| 9. other certificates that shall be submitted as provided for by laws and regulations. | | （九）法律、法规规定需要提交的其他证明文件。 |
| |
|
| Article 8 The provincial sport administrative department shall make a decision on approval or disapproval within 20 working days after receiving the application materials. In case of approval, it shall submit the approval document to the General Administration of Sport of China for archival purposes and send a copy to the local provincial public security organ. | | 第八条 省级体育行政部门应当自收到申请材料之日起二十个工作日内做出是否批准的决定。决定批准的，将批准文件报国家体育总局备案，并抄送所在地省级公安机关。 |

| Article 9 The provincial sport administrative department shall review the qualification of the entities engaging in shooting competitive sports every two years, submit the review result to the General Administration of Sport of China for archival purposes and send a copy to the local provincial public security organ. | | 第九条 省级体育行政部门对从事射击竞技体育运动的单位每两年进行一次资格复审，将复审结果报国家体育总局备案，并抄送所在地省级公安机关。 |

| Chapter III Allocation and Purchase of Sports Guns | | 第三章 运动枪支的配置与购置 |
| |
|
| Article 10 The categories of and quota for the allocation of sports guns shall be determined by the General Administration of Sport of China jointly with the Ministry of Public Security. | | 第十条 运动枪支的配置种类及限额由国家体育总局会同公安部确定。 |
| |
|
| Article 11 The purchase of sports guns shall be uniformly organized by the entities designated by the General Administration of Sport of China jointly with the Ministry of Public Security. | | 第十一条 运动枪支的购置由国家体育总局与公安部共同指定的单位统一组织实施。 |
| |
|
| Article 12 The entities engaging in shooting competitive sports shall submit its annual sports gun purchase plan and additional purchase plan to the local sport administrative department at or above the level of city divided into districts. | | 第十二条 从事射击竞技体育运动的单位应当向所在地设区的市级以上体育行政部门提出运动枪支年度购置计划和增补购置计划。 |
The provincial sport administrative department shall be responsible for collecting and examining the annual sports gun purchase plans and additional purchase plans within its administrative region and submit them to the General Administration of Sport of China upon the examination of the public security organ at the same level. The General Administration of Sport of China shall implement the annual national sports gun purchase plan after it is reported to, examined and approved by the Ministry of Public Security. | |
省级体育行政部门负责汇总和审核本行政区域内运动枪支年度购置计划和增补购置计划，经同级公安机关审核后报国家体育总局。国家体育总局将全国运动枪支购置计划报公安部审批后执行。 |

| Article 13 The designated sports gun purchase entities shall sign purchase contracts with sports gun manufacturing enterprises (including guns importing enterprises) according to the relevant provisions of the state and allocate and transport sports guns according to the allocation plan approved by the Ministry of Public Security. | | 第十三条 运动枪支购置指定单位应当按国家有关规定与运动枪支制造企业（包括进口枪支企业）签订采购合同，并按照公安部批准的分配计划调拨、运输运动枪支。 |

| Article 14 Where a shooting competitive sports entity or any of its athletes is to receive any awarded, sponsored or donated sports gun, the local provincial sport administrative department shall report it to the Ministry of Public Security for examination and approval upon the examination and approval of the General Administration of Sport of China, and send a copy to the local provincial public security organ to include it in its allocation quota for management. | | 第十四条 射击竞技体育运动单位或者所属运动员接受奖励、赞助或者赠送运动枪支时，应当由其所在地省级体育行政部门提出，经国家体育总局审核同意后，报公安部审批并抄送所在地省级公安机关，纳入该单位配置限额管理。 |

Article 15 Where a shooting competitive sports entity needs to transfer any sports gun for usage within its administrative region, it shall report it to the General Administration of Sport of China for archival purposes upon the approval of the provincial sport administrative department, and send a copy to the public security organ at the same level to include it in the sports gun allocation plan of the entity which receives and uses the gun for management.
