| Provisions on Disciplinary Actions for Overseas Travel with Public Money and Other Relevant Violations of Disciplines | | 用公款出国（境）旅游及相关违纪行为处分规定 |
| Article 1 In order to regulate the order of administration on overseas travel, define the limits of relevant policies, and punish the act of traveling overseas with public money and other relevant violations of disciplines, these Provisions are formulated in accordance with the Administrative Supervision Law of the People's Republic of China, the Civil Servant Law of the People's Republic of China, the Regulation on the Punishment of Civil Servants of Administrative Organs, and other relevant laws and administrative regulations. | | 第一条 为规范因公出国（境）管理秩序，明确相关政策界限，惩处用公款出国（境）旅游及相关违纪行为，根据《中华人民共和国行政监察法》、《中华人民共和国公务员法》和《行政机关公务员处分条例》等有关法律、行政法规，制定本规定。 |
| Article 2 These Provisions shall apply to the following persons: | | 第二条 本规定适用于下列人员： |
| (a) civil servants of administrative organs; | | （一）行政机关公务员； |
| (b) staff members from an organization with public affairs management functions that is authorized by any law or regulation or from an organization conducting public affairs management activities that is legally entrusted by an administrative organ, except for logistic personnel; and | | （二）法律、法规授权的具有管理公共事务职能的组织以及国家行政机关依法委托的组织中除工勤人员以外的工作人员； |
| (c) personnel of an enterprise, public institution, or social organization that is appointed by an administrative organ. | | （三）企业、事业单位、社会团体中由行政机关任命的人员。 |
Article 3 For the purpose of these Provisions, “the act of traveling overseas with public money” means that any person, without official activities out of China, organizes or participates in the overseas visit, tour or other activities by using public money to pay all or part of the costs, particularly including the act of traveling overseas without actual official business but using public money in a disguised form and in the name of an investigation, study, training, conference or invitation to investment, or participating in an exhibition or attending a meeting.
