The Measures for the Supervision and Administration of the Preparation of Environmental Impact Reports (Forms) on Construction Projects as deliberated and adopted by the executive meeting of the Ministry of Ecology and Environment on August 19, 2019, are hereby issued and shall come into force on November 1, 2019, upon which the Measures for the Administration of Environmental Impact Assessment on Construction Projects (Order No. 36, Ministry of Environmental Protection) issued by the former Ministry of Environmental Protection on September 28, 2015, and the Announcement on Work Requirements Subsequent and Related to the Cancellation of Matters under License of Qualification for Environmental Impact Assessment on Construction Projects issued by the Ministry of Ecology and Environment (Announcement No. 2 [2019], Ministry of Ecology and Environment) on January 19, 2019, are repealed. 《建设项目环境影响报告书(表)编制监督管理办法》已于2019年8月19日由生态环境部部务会议审议通过,现予公布,自2019年11月1日起施行。2015年9月28日原环境保护部发布的《建设项目环境影响评价资质管理办法》(环境保护部令第36号)、2019年1月19日生态环境部发布的《关于取消建设项目环境影响评价资质行政许可事项后续相关工作要求的公告(暂行)》(生态环境部公告2019年第2号)同时废止。

Measures for the Supervision and Administration of the Preparation of Environmental Impact Reports (Forms) on Construction Projects 建设项目环境影响报告书(表)编制监督管理办法
Chapter I General Provisions 

第一章 总 则

Article 1 For the purposes of regulating the preparation of environmental impact reports and environmental impact reporting forms for construction projects (hereinafter referred to as the “environmental impact reports (forms)”), strengthening supervision and administration, guaranteeing the quality of environmental impact assessment work, and maintaining the order of the environmental impact assessment technical service market, these Measures are developed in accordance with the Law of the People's Republic of China on Environmental Impact Assessment, the Regulation on the Administration of Construction Project Environmental Protection, and other relevant laws and regulations.   第一条 为规范建设项目环境影响报告书和环境影响报告表(以下简称环境影响报告书(表))编制行为,加强监督管理,保障环境影响评价工作质量,维护环境影响评价技术服务市场秩序,根据《中华人民共和国环境影响评价法》《建设项目环境保护管理条例》等有关法律法规,制定本办法。
Article 2 A construction employer may assess the environmental impact of its construction project and prepare an environmental impact report (form) through a commissioned technical entity, or by itself, if it has capabilities for environmental impact assessment.   第二条 建设单位可以委托技术单位对其建设项目开展环境影响评价,编制环境影响报告书(表);建设单位具备环境影响评价技术能力的,可以自行对其建设项目开展环境影响评价,编制环境影响报告书(表)。
A technical entity shall not be in any relationship of interest with an ecology and environment authority responsible for approving environmental impact reports (forms) or any other relevant approval authority. No entity or individual may designate a technical entity to prepare an environmental impact report (form) for any construction employer. 技术单位不得与负责审批环境影响报告书(表)的生态环境主管部门或者其他有关审批部门存在任何利益关系。任何单位和个人不得为建设单位指定编制环境影响报告书(表)的技术单位。
For the purpose of these Measures, "technical entity" means an entity technically capable for environmental impact assessment, from which, as commissioned by a construction employer, prepares an environmental impact report (form). 本办法所称技术单位,是指具备环境影响评价技术能力、接受委托为建设单位编制环境影响报告书(表)的单位。
Article 3 A construction employer shall be responsible for the contents and conclusions of its environmental impact report (form); and a technical entity shall be correspondingly responsible for any environmental impact report (form) it has prepared.   第三条 建设单位应当对环境影响报告书(表)的内容和结论负责;技术单位对其编制的环境影响报告书(表)承担相应责任。
Article 4 A preparation entity shall strengthen the building of technical capabilities for environmental impact assessment and improve its professional and technical level. Guidelines for building capabilities for the preparation of environmental impact reports (forms) shall be separately developed by the Ministry of Ecology and Environment.   第四条 编制单位应当加强环境影响评价技术能力建设,提高专业技术水平。环境影响报告书(表)编制能力建设指南由生态环境部另行制定。
A construction employer shall be encouraged to select any technical entity with good credit standing and in compliance with the requirements of the guidelines for building capabilities to prepare its environmental impact report (form). 鼓励建设单位优先选择信用良好和符合能力建设指南要求的技术单位为其编制环境影响报告书(表)。
For the purpose of these Measures, “preparation entity” means an entity that presides over the preparation of any environmental impact report (form), which may be either a technical entity or a construction employer. 本办法所称编制单位,是指主持编制环境影响报告书(表)的单位,包括主持编制环境影响报告书(表)的技术单位和自行主持编制环境影响报告书(表)的建设单位。
Article 5 A preparer shall have technical expertise and continually improve their business capabilities.   第五条 编制人员应当具备专业技术知识,不断提高业务能力。
For the purpose of these Measures, "preparer” means the presiding preparer or any main preparer of an environmental impact report (form). The presiding preparer is the person in charge of the preparation of the environmental impact report (form). Main preparers include the authors of the various chapters and sections of the environmental impact report and the authors of main contents of the environmental impact form. 本办法所称编制人员,是指环境影响报告书(表)的编制主持人和主要编制人员。编制主持人是环境影响报告书(表)的编制负责人。主要编制人员包括环境影响报告书各章节的编写人员和环境影响报告表主要内容的编写人员。
Article 6 Ecology and environment authorities at districted city level or above (hereinafter referred to as the “ecology and environment authority at municipal level or above”) shall strengthen the supervision, administration, and quality evaluation of preparation entities, conduct supervisory inspection of the preparation of environmental impact reports (forms) and the investigation and punishment of preparation quality problems, and place preparation entities and preparers under credit administration.   第六条 设区的市级以上生态环境主管部门(以下简称市级以上生态环境主管部门)应当加强对编制单位的监督管理和质量考核,开展环境影响报告书(表)编制行为监督检查和编制质量问题查处,并对编制单位和编制人员实施信用管理。
Article 7 The Ministry of Ecology and Environment shall be responsible for constructing a national unified environmental impact assessment credit platform (hereinafter referred to as the “credit platform”) and organizing the establishment of an honesty record management system for preparation entities and preparers. The credit platform shall be included in national credit information platforms in the ecology and environment field for unified management.   第七条 生态环境部负责建设全国统一的环境影响评价信用平台(以下简称信用平台),组织建立编制单位和编制人员诚信档案管理体系。信用平台纳入全国生态环境领域信用信息平台统一管理。
Relevant information such as the basic information of preparation entities and preparers shall be disclosed to the public through the credit platform. Specific measures shall be separately developed by the Ministry of Ecology and Environment. 编制单位和编制人员的基础信息等相关信息应当通过信用平台公开。具体办法由生态环境部另行制定。
Chapter II Requirements for Preparation 

第二章 编制要求

Article 8 Preparation entities and preparers shall adhere to the principles of fairness, science, and honesty, abide by the laws, regulations, standards, technical specifications, and other provisions related to environmental impact assessment, and ensure that environmental impact reports (forms) are authentic, objective, comprehensive, and conforming.   第八条 编制单位和编制人员应当坚持公正、科学、诚信的原则,遵守有关环境影响评价法律法规、标准和技术规范等规定,确保环境影响报告书(表)内容真实、客观、全面和规范。
Article 9 A preparation entity shall be an entity capable of independently assuming legal liability according to the law.   第九条 编制单位应当是能够依法独立承担法律责任的单位。
If the entity as referred to in the preceding paragraph is any of the following entities, it shall not prepare an environmental impact report (form) as technical entity: 前款规定的单位中,下列单位不得作为技术单位编制环境影响报告书(表):
(1) A public institution established by an ecology and environment authority, or by any other approval authority responsible for approving environmental impact reports (forms). (一)生态环境主管部门或者其他负责审批环境影响报告书(表)的审批部门设立的事业单位;
(2) A social organization of which an ecology and environment authority, or any other approval authority responsible for approving environmental impact reports (forms), is the entity having jurisdiction over the business, or is the superior entity. (二)由生态环境主管部门作为业务主管单位或者挂靠单位的社会组织,或者由其他负责审批环境影响报告书(表)的审批部门作为业务主管单位或者挂靠单位的社会组织;
(3) An entity to which any public institution or social organization under the preceding two subparagraphs of this paragraph contributes capital, or another entity to which the entity contributes capital. (三)由本款前两项中的事业单位、社会组织出资的单位及其再出资的单位;
(4) An entity commissioned by an ecology and environment authority or any other approval authority responsible for approving environmental impact reports (forms) to conduct technical assessment of environmental impact reports (forms). (四)受生态环境主管部门或者其他负责审批环境影响报告书(表)的审批部门委托,开展环境影响报告书(表)技术评估的单位;
(5) An entity to which any technical assessment entity under subparagraph (4) of this paragraph contributes capital, or another entity to which the entity contributes capital. (五)本款第四项中的技术评估单位出资的单位及其再出资的单位;
(6) An entity contributing capital to any technical assessment entity under subparagraph (4) of this paragraph, or an entity to which the capital contributor of a technical assessment entity under subparagraph (4) of this paragraph contributes capital, or an entity to which the legal representative of a technical assessment entity technical under subparagraph (4) of this paragraph contributes capital. (六)本款第四项中的技术评估单位的出资单位,或者由本款第四项中的技术评估单位出资人出资的其他单位,或者由本款第四项中的技术评估单位法定代表人出资的单位。
An individual industrial and commercial household, a rural usufructuary household, or any agency, branch office, or ad hoc institution of an entity specified in the first paragraph of this Article shall not preside over the preparation of an environmental impact report (form). 个体工商户、农村承包经营户以及本条第一款规定单位的内设机构、分支机构或者临时机构,不得主持编制环境影响报告书(表)。
Article 10 A preparation entity shall have the technical capability for environmental impact assessment. A presiding preparer or main preparer of any environmental impact report (form) shall be a full-time employee of the preparation entity, and the presiding preparer of the environmental impact report (form) shall also be in possession of a professional qualification certificate as environmental impact assessment engineer.   第十条 编制单位应当具备环境影响评价技术能力。环境影响报告书(表)的编制主持人和主要编制人员应当为编制单位中的全职人员,环境影响报告书(表)的编制主持人还应当为取得环境影响评价工程师职业资格证书的人员。
Article 11 A preparation entity or preparer shall submit its, his, or her basic information through the credit platform.   第十一条 编制单位和编制人员应当通过信用平台提交本单位和本人的基本情况信息。
The Ministry of Ecology and Environment shall create honesty records of preparation entities and preparers on the credit platform, generate preparer credit numbers, and publicly disclose the basic information of preparation entities such as names and unified social credit codes and that of preparers such as names and employers. 生态环境部在信用平台建立编制单位和编制人员的诚信档案,并生成编制人员信用编号,公开编制单位名称、统一社会信用代码等基础信息以及编制人员姓名、从业单位等基础信息。
A preparation entity or preparer shall be responsible for the authenticity, accuracy, and completeness of information submitted. If the relevant information changes, modification shall be made on the credit platform within 20 working days from the date of the change. 编制单位和编制人员应当对提交信息的真实性、准确性和完整性负责。相关信息发生变化的,应当自发生变化之日起二十个工作日内在信用平台变更。
Article 12 An environmental impact report (form) shall be prepared by a single entity, with a preparer of the entity being the presiding preparer.   第十二条 环境影响报告书(表)应当由一个单位主持编制,并由该单位中的一名编制人员作为编制主持人。
If a construction employer commissions a technical entity to prepare an environmental impact report (form), the construction employer shall conclude a commission contract with the technical entity presiding over the preparation, stipulating the rights and obligations of both parties and fees. 建设单位委托技术单位编制环境影响报告书(表)的,应当与主持编制的技术单位签订委托合同,约定双方的权利、义务和费用。
Article 13 A preparation entity shall establish and implement a quality control system covering the whole process of environmental impact assessment, comply with the working procedures for environmental impact assessment, and establish a traceable quality management mechanism covering links including site visits, status monitoring, collection of data and information, and environmental impact forecasts and the preparing and reviewing phases of environmental impact reports (forms). If another entity participates or cooperates in the preparation, the preparation entity shall review any technical report, data, or information provided by the participating or cooperating entity.   第十三条 编制单位应当建立和实施覆盖环境影响评价全过程的质量控制制度,落实环境影响评价工作程序,并在现场踏勘、现状监测、数据资料收集、环境影响预测等环节以及环境影响报告书(表)编制审核阶段形成可追溯的质量管理机制。有其他单位参与编制或者协作的,编制单位应当对参与编制单位或者协作单位提供的技术报告、数据资料等进行审核。
A presiding preparer shall organize and participate in the preparation of the environmental impact report (form) in the whole process and strengthen overall coordination. 编制主持人应当全过程组织参与环境影响报告书(表)编制工作,并加强统筹协调。
A construction employer that commissions a technical entity to prepare an environmental impact report (form) shall truthfully provide relevant basic information, arrange inputs in environmental protection and source of funds, strengthen the management of environmental impact assessment process, and review the contents and conclusions of the environmental impact report (form). 委托技术单位编制环境影响报告书(表)的建设单位,应当如实提供相关基础资料,落实环境保护投入和资金来源,加强环境影响评价过程管理,并对环境影响报告书(表)的内容和结论进行审核。
Article 14 Unless a construction project is related to any state secret, the preparation entity and preparers shall, before the construction employer submits the environmental impact report (form) for approval, submit the basic information of the completed environmental report (form) through the credit platform, and be responsible for the authenticity, accuracy, and completeness of the submitted information. The credit platform shall generate a project number and publicly disclose the basic information of the construction project related to the environmental impact report (form) including its name and category, construction employer, preparation entity, and preparers.   第十四条 除涉及国家秘密的建设项目外,编制单位和编制人员应当在建设单位报批环境影响报告书(表)前,通过信用平台提交编制完成的环境影响报告书(表)基本情况信息,并对提交信息的真实性、准确性和完整性负责。信用平台生成项目编号,并公开环境影响报告书(表)相关建设项目名称、类别以及建设单位、编制单位和编制人员等基础信息。
The environmental impact report (form) submitted for approval shall be accompanied by an Information Form for Preparation Entity and Preparers (see Annex for its layout). The construction employer, preparation entity, and relevant personnel shall affix their seals or signatures in the corresponding places in the information form. Except for a construction project related to any state secret, the Information Form for Preparation Entity and Preparers shall be exported from the credit platform. 报批的环境影响报告书(表)应当附具编制单位和编制人员情况表(格式附后)。建设单位、编制单位和相关人员应当在情况表相应位置盖章或者签字。除涉及国家秘密的建设项目外,编制单位和编制人员情况表应当由信用平台导出。
Article 15 A construction employer shall retain its environmental impact report (form) and approval documents related thereto.   第十五条 建设单位应当将环境影响报告书(表)及其审批文件存档。
A preparation entity shall create complete records of the preparation of any environmental impact report (form). The records shall include the basic information of the project, records and visual recordings of site visits, quality control records, the environmental impact report (form), and other relevant information. For the monitoring and investigation of environmental quality status, environmental impact forecasts, or scientific tests, if any, a report, data, and information on the monitoring, pre-forecast document, or test report shall also be retained together. 编制单位应当建立环境影响报告书(表)编制工作完整档案。档案中应当包括项目基础资料、现场踏勘记录和影像资料、质量控制记录、环境影响报告书(表)以及其他相关资料。开展环境质量现状监测和调查、环境影响预测或者科学试验的,还应当将相关监测报告和数据资料、预测过程文件或者试验报告等一并存档。
If a construction employer commissions a technical entity to preside over the preparation of an environmental impact report (form), the construction employer and the technical entity commissioned shall retain their commission contracts respectively. 建设单位委托技术单位主持编制环境影响报告书(表)的,建设单位和受委托的技术单位应当分别将委托合同存档。
Any information retained shall be original. 存档材料应当为原件。
