The Interim Measures for the Administration of Online Games, which were deliberated and adopted at the executive meeting of the Ministry of Culture on March 17, 2010, are hereby promulgated and shall come into force on August 1, 2010.
 
《网络游戏管理暂行办法》已经2010年3月17日文化部部务会议审议通过,现予发布,自2010年8月1日起施行。

Chapter I General Provisions 

第一章 总 则


 
Article 1 In order to strengthen the administration of online games, regulate the order of online game business operations and maintain the healthy development of the online game industry, these Measures are formulated in accordance with the Decision of the Standing Committee of the National People's Congress on Maintaining Internet Security, the Administrative Measures for Internet Information Services and the relevant provisions of laws and regulations of the state.   第一条 为加强网络游戏管理,规范网络游戏经营秩序,维护网络游戏行业的健康发展,根据《全国人民代表大会常务委员会关于维护互联网安全的决定》和《互联网信息服务管理办法》以及国家法律法规有关规定,制定本办法。

 
Article 2 These Measures shall apply to the R&D and production of online games, network operation of online games, distribution of virtual currency of online games, virtual currency trading services of online games, and other forms of business operations of online games.   第二条 从事网络游戏研发生产、网络游戏上网运营、网络游戏虚拟货币发行、网络游戏虚拟货币交易服务等形式的经营活动,适用本办法。

The term “online games” as mentioned in these Measures refers to game products and services consisting of software programs and information data, which are provided via information networks such as the Internet and mobile communication networks.
 
本办法所称网络游戏是指由软件程序和信息数据构成,通过互联网、移动通信网等信息网络提供的游戏产品和服务。

The term “network operation of online games” refers to the provision of game products and services to the public via an information network by using a user system or fee system.
 
网络游戏上网运营是指通过信息网络,使用用户系统或者收费系统向公众提供游戏产品和服务的经营行为。

The term “virtual currency of online games” refers to an virtual exchange tool existing outside the game program, stored in the server in the form of electromagnetic record and represented in specific digital units, which is distributed by an online game business entity and directly or indirectly purchased by the online game users with legal tenders according to a certain proportion.
 
网络游戏虚拟货币是指由网络游戏经营单位发行,网络游戏用户使用法定货币按一定比例直接或者间接购买,存在于游戏程序之外,以电磁记录方式存储于服务器内,并以特定数字单位表现的虚拟兑换工具。

 
Article 3 The culture administrative department of the State Council shall be the department in charge of online games, and the culture administrative departments of the people's governments at and above the county level shall be responsible for the supervision and administration of online games within their respective administrative regions according to their respective functions.   第三条 国务院文化行政部门是网络游戏的主管部门,县级以上人民政府文化行政部门依照职责分工负责本行政区域内网络游戏的监督管理。

 
Article 4 Entities engaging in online game business operations shall abide by the Constitution, laws and administrative regulations, give priority to social benefits and protection of the minors, carry forward thoughts, cultures and ethics embodying developments in the current era and social advancement, follow the principles of protection of public health and moderate game play, safeguard the legitimate rights and interests of online game users pursuant to law, and promote the overall development of a person as well as social harmony.   第四条 从事网络游戏经营活动应当遵守宪法、法律、行政法规,坚持社会效益优先,保护未成年人优先,弘扬体现时代发展和社会进步的思想文化和道德规范,遵循有利于保护公众健康及适度游戏的原则,依法维护网络游戏用户的合法权益,促进人的全面发展与社会和谐。

 
Article 5 Industrial associations of online games and other social groups and organizations shall be subject to the guidance of the culture administrative departments, formulate industrial self-discipline rules in accordance with laws, administrative regulations and bylaws, strengthen education on professional ethics, direct and supervise the business operations of members, protect the legitimate rights and interests of members, and promote fair competition.   第五条 网络游戏行业协会等社团组织应当接受文化行政部门的指导,依照法律、行政法规及章程制定行业自律规范,加强职业道德教育,指导、监督成员的经营活动,维护成员的合法权益,促进公平竞争。

 
Chapter II Business Entities 

第二章 经 营 单 位


 
Article 6 An entity engaging in online game business operations, including but not limited to the network operation of online games, distribution of virtual currency of online games and virtual currency trading services of online games, shall meet the following requirements and obtain an Internet Culture Business Permit:   第六条 从事网络游戏上网运营、网络游戏虚拟货币发行和网络游戏虚拟货币交易服务等网络游戏经营活动的单位,应当具备以下条件,并取得《网络文化经营许可证》:

 
1. having a name, domicile, organizational structure and articles of association of the entity; (一)单位的名称、住所、组织机构和章程;

 
2. having a fixed business scope of online games; (二)确定的网络游戏经营范围;

 
3. having personnel who meet the relevant provisions of the state; (三)符合国家规定的从业人员;

 
4. having registered capital of not less than 10 million yuan; and (四)不低于1000万元的注册资金;

 
5. meeting the conditions as prescribed by laws, administrative regulations and the relevant provisions of the state. (五)符合法律、行政法规和国家有关规定的条件。

 
Article 7 An entity shall apply to the culture administrative department of a province, autonomous region or municipality directly under the Central Government for an Internet Culture Business Permit. The culture administrative department of the province, autonomous region or municipality directly under the Central Government shall make a decision on approval or disapproval within 20 days after receiving the application. In case of approval, it shall issue an Internet Culture Business Permit to the applicant and announce it to the public; or in case of disapproval, it shall notify the applicant in writing of the disapproval and reasons for the disapproval.   第七条 申请《网络文化经营许可证》,应当向省、自治区、直辖市文化行政部门提出申请。省、自治区、直辖市文化行政部门自收到申请之日起20日内做出批准或者不批准的决定。批准的,核发《网络文化经营许可证》,并向社会公告;不批准的,应当书面通知申请人并说明理由。

An Internet Culture Business Permit shall be valid for three years. An entity which needs to continue its online game business operations after its Internet Culture Business Permit expires shall apply for a renewal at least 30 days before its Internet Culture Business Permit expires.
 
《网络文化经营许可证》有效期为3年。有效期届满,需继续从事经营的,应当于有效期届满30日前申请续办。

 
Article 8 Where an online game business entity which has obtained an Internet Culture Business Permit modifies its website name, website domain name, legal representative, registered address, business premises, registered capital, equity structure or licensed business scope, it shall go through the modification formalities at the original permit-issuing organ within 20 days after the date of modification.   第八条 获得《网络文化经营许可证》的网络游戏经营单位变更网站名称、网站域名或者法定代表人、注册地址、经营地址、注册资金、股权结构以及许可经营范围的,应当自变更之日起20日内向原发证机关办理变更手续。

An online game business entity shall publish its Internet Culture Business Permit and other information in a conspicuous position of its enterprise website, client software of products, customer service center, etc.; and the domain name of its website in actual operation shall be consistent with the information declared by it.
 
网络游戏经营单位应当在企业网站、产品客户端、用户服务中心等显著位置标示《网络文化经营许可证》等信息;实际经营的网站域名应当与申报信息一致。

 
Chapter III Content Rules 

第三章 内 容 准 则


 
Article 9 No online game shall contain anything:   第九条 网络游戏不得含有以下内容:

 
1. violating the basic principles determined in the Constitution; (一)违反宪法确定的基本原则的;

 
2. compromising the unity, sovereignty or territorial integrity of the state; (二)危害国家统一、主权和领土完整的;

 
3. divulging a national secret, jeopardizing the national security or damaging the honor and interests of the state; (三)泄露国家秘密、危害国家安全或者损害国家荣誉和利益的;

 
4. instigating hatred or discrimination among ethnic groups, undermining the solidarity among ethnic groups, or disrespecting ethnic customs and practices; (四)煽动民族仇恨、民族歧视,破坏民族团结,或者侵害民族风俗、习惯的;

 
5. advocating cult or superstition; (五)宣扬邪教、迷信的;

 
6. spreading rumors to disrupt the public order and social stability; (六)散布谣言,扰乱社会秩序,破坏社会稳定的;

 
7. advocating obscenity, pornography, gambling or violence, or abetting the commission of a crime; (七)宣扬淫秽、色情、赌博、暴力,或者教唆犯罪的;

 
8. insulting or defaming others and injuring the legitimate rights and interests of others; (八)侮辱、诽谤他人,侵害他人合法权益的;

 
9. breaching social morality; or (九)违背社会公德的;

 
10. otherwise prohibited by any law, administrative regulation or provision of the state. (十)有法律、行政法规和国家规定禁止的其他内容的。

 
Article 10 The culture administrative department of the State Council shall be responsible for the content examination of online games, and retain relevant experts to carry out the relevant consulting and routine work on the examination, filing and authentication of contents of online games.   第十条 国务院文化行政部门负责网络游戏内容审查,并聘请有关专家承担网络游戏内容审查、备案与鉴定的有关咨询和事务性工作。

The culture administrative department of the State Council shall not examine again any online game publication pre-approved by the relevant department, and shall permit the network operation of such a publication.
 
经有关部门前置审批的网络游戏出版物,国务院文化行政部门不再进行重复审查,允许其上网运营。

 
Article 11 The culture administrative department of the State Council shall examine the contents of imported online games pursuant to law. An imported online game may be put into network operation only upon a content approval of the culture administrative department of the State Council. An applicant for content examination shall submit the following materials:   第十一条 国务院文化行政部门依法对进口网络游戏进行内容审查。进口网络游戏应当在获得国务院文化行政部门内容审查批准后,方可上网运营。申请进行内容审查需提交下列材料:

 
1. an application form for the content examination of an imported online game; (一)进口网络游戏内容审查申报表;

 
2. the content description of an imported online game; (二)进口网络游戏内容说明书;

 
3. the Chinese and foreign versions of a copyright trade or operation agency agreement, and the duplicates or photocopies of the original copyright certification and power of attorney; (三)中、外文文本的版权贸易或者运营代理协议、原始著作权证明书和授权书的副本或者复印件;

 
4. photocopies of the Internet Culture Business Permit and the Business License of the applicant; and (四)申请单位的《网络文化经营许可证》和《营业执照》复印件;

 
5. other documents required for content examination. (五)内容审查所需的其他文件。

 
Article 12 An applicant for the content examination of an imported online game shall be an online game operating enterprise which has obtained an exclusive authorization pursuant to law.   第十二条 申报进口网络游戏内容审查的,应当为依法获得独占性授权的网络游戏运营企业。

Where the operating enterprise of an approved imported online game is changed, the new operating enterprise after change shall apply anew to the culture administrative department of the State Council in accordance with Article 11 of these Measures.
 
批准进口的网络游戏变更运营企业的,由变更后的运营企业,按照本办法第十一条的规定,向国务院文化行政部门重新申报。

The approval document number of an approved imported online game shall be indicated in the designated position of its website operated for the game and in a conspicuous position in the game.
 
经批准的进口网络游戏应当在其运营网站指定位置及游戏内显著位置标明批准文号。

 
Article 13 The filing formalities shall be gone through according to the relevant provisions for a domestic online game at the culture administrative department of the State Council within 30 days after such a game is put into network operation.   第十三条 国产网络游戏在上网运营之日起30日内应当按规定向国务院文化行政部门履行备案手续。

The filing number of a domestic online game which has gone through the filing formalities shall be indicated in the designated position of its website operated for the game and in a conspicuous position in the game.
 
已备案的国产网络游戏应当在其运营网站指定位置及游戏内显著位置标明备案编号。

 
Article 14 Where the contents of an imported online game need to undergo any substantial change after the game is put into network operation, the online game operating enterprise shall report the proposed change to the culture administrative department of the State Council for content examination.   第十四条 进口网络游戏内容上网运营后需要进行实质性变动的,网络游戏运营企业应当将拟变更的内容报国务院文化行政部门进行内容审查。

Where there is any substantial change of the contents of a domestic online game, the online game operating enterprise shall go through the filing formalities at the culture administrative department of the State Council within 30 days after the date of change.
 
国产网络游戏内容发生实质性变动的,网络游戏运营企业应当自变更之日起30日内向国务院文化行政部门进行备案。

A substantial change of the contents of an online game refers to any significant change of the background story, plot languages, place names, task design, economic system, trading system, production and construction system, social interaction system, confrontation functions, role images, sound effects, map and properties, action presentation, team system, etc. of the online game.
 
网络游戏内容的实质性变动是指在网络游戏故事背景、情节语言、地名设置、任务设计、经济系统、交易系统、生产建设系统、社交系统、对抗功能、角色形象、声音效果、地图道具、动作呈现、团队系统等方面发生显著变化。

 
Article 15 An online game operating enterprise shall establish a self-check system, and designate a special department and professional personnel to be responsible for the self-check and management of the contents of online games and its business operations, to ensure the legality of the contents of online games and its business operations.   第十五条 网络游戏运营企业应当建立自审制度,明确专门部门,配备专业人员负责网络游戏内容和经营行为的自查与管理,保障网络游戏内容和经营行为的合法性。

 
Chapter IV Business Operations 

第四章 经 营 活 动


 
Article 16 An online game business entity shall, based on the contents, functions and user scope of an online game, formulate the user guide and warning information about the online game, and indicate them in a conspicuous position of its website and online game.   第十六条 网络游戏经营单位应当根据网络游戏的内容、功能和适用人群,制定网络游戏用户指引和警示说明,并在网站和网络游戏的显著位置予以标明。

An online game orientated to minors shall not contain anything that may induce minors to mimic any violation of social ethics or law or any criminal act, or contain any horrible, cruel or other thing that may harm the mental and physical health of minors.
 
以未成年人为对象的网络游戏不得含有诱发未成年人模仿违反社会公德的行为和违法犯罪的行为的内容,以及恐怖、残酷等妨害未成年人身心健康的内容。

An online game business entity shall, according to the relevant provisions of the state, take technical measures to prohibit minors from access to improper games or game functions, restrict the playtime of minors and prevent minors from indulging in network.
 
网络游戏经营单位应当按照国家规定,采取技术措施,禁止未成年人接触不适宜的游戏或者游戏功能,限制未成年人的游戏时间,预防未成年人沉迷网络。

 
Article 17 An online game business entity shall not authorize any entity unqualified for operating online games to operate any online game.   第十七条 网络游戏经营单位不得授权无网络游戏运营资质的单位运营网络游戏。

 
Article 18 An online game business entity shall comply with the following provisions:   第十八条 网络游戏经营单位应当遵守以下规定:

 
1. No compulsory confrontation shall be set in any online game without the consent of the users of the online game; (一)不得在网络游戏中设置未经网络游戏用户同意的强制对战;

 
2. Anything prohibited by Article 9 of these Measures shall not be present in the promotion and publicity of an online game; and (二)网络游戏的推广和宣传不得含有本办法第九条禁止内容;

 
3. It shall be prohibited to induce any online game user to obtain any online game product or service with legal tenders or virtual currency of online games by a random draw or any other accidental means. (三)不得以随机抽取等偶然方式,诱导网络游戏用户采取投入法定货币或者网络游戏虚拟货币方式获取网络游戏产品和服务。

 
Article 19 An online game business entity distributing virtual currency of online games shall comply with the following provisions:   第十九条 网络游戏运营企业发行网络游戏虚拟货币的,应当遵守以下规定:

 
1. The virtual currency of online games shall be only used for the exchange for online game products and services provided by the entity, and shall not be used for the payment for or purchase of real objects or exchange for products and services provided by any other entity; (一)网络游戏虚拟货币的使用范围仅限于兑换自身提供的网络游戏产品和服务,不得用于支付、购买实物或者兑换其它单位的产品和服务;

 
2. The virtual currency of online games shall not be distributed for the purpose of maliciously occupying the prepayment of users; (二)发行网络游戏虚拟货币不得以恶意占用用户预付资金为目的;

 
3. The purchase record of an online game user shall be kept. Such a record shall be kept for at least 180 days from the date of last service received by the user; and (三)保存网络游戏用户的购买记录。保存期限自用户最后一次接受服务之日起,不得少于180日;

 
4. The categories, price, total amount, etc. of the distributed virtual currency of an online game shall be reported to the provincial culture administrative department at the registration place of the entity for filing purposes according to the relevant provisions. (四)将网络游戏虚拟货币发行种类、价格、总量等情况按规定报送注册地省级文化行政部门备案。

 
Article 20 An enterprise providing virtual currency trading services of online games shall comply with the following provisions:   第二十条 网络游戏虚拟货币交易服务企业应当遵守以下规定:

 
1. It shall not provide trading services for minors; (一)不得为未成年人提供交易服务;

 
2. It shall not provide trading services for any online game which has not been examined or has not gone through the filing formalities; (二)不得为未经审查或者备案的网络游戏提供交易服务;

 
3. When providing services, it shall guarantee that a user makes registration with a valid ID certificate, and perform linkage to a bank account consistent with the registration information of the user; (三)提供服务时,应保证用户使用有效身份证件进行注册,并绑定与该用户注册信息相一致的银行账户;

 
4. It shall assist in checking the legality of a transaction after receiving a notice from any party of interest, government department or judicial organ; and if the transaction is illegal upon verification, it shall immediately take measures to terminate services for the transaction and keep the relevant records; and (四)接到利害关系人、政府部门、司法机关通知后,应当协助核实交易行为的合法性。经核实属于违法交易的,应当立即采取措施终止交易服务并保存有关纪录;

 
5. The inter-user trading records, account records and other information shall be kept for at least 180 days. (五)保存用户间的交易记录和账务记录等信息不得少于180日。

 
Article 21 An online game operating enterprise shall require an online game user to make real name registration with a valid ID certificate, and keep the registration information of the user.   第二十一条 网络游戏运营企业应当要求网络游戏用户使用有效身份证件进行实名注册,并保存用户注册信息。

 
Article 22 If an online game operating enterprise terminates the operation of an online game, or assigns its right to operate an online game, it shall make an announcement 60 days in advance. For the virtual currency of online games which has not been used by an online game user and the game services which remain effective, a refund shall be made to the user in the form of legal tenders or in any other form acceptable to the user according to the proportion at the time of purchase.   第二十二条 网络游戏运营企业终止运营网络游戏,或者网络游戏运营权发生转移的,应当提前60日予以公告。网络游戏用户尚未使用的网络游戏虚拟货币及尚未失效的游戏服务,应当按用户购买时的比例,以法定货币退还用户或者用户接受的其他方式进行退换。

Where the services of an online game are suspended for a continuous period of 30 days or more for the reasons of the online game operating enterprise, including but not limited to discontinuation of service access and technical failures, the operation of the online game shall be deemed to have terminated.
 
网络游戏因停止服务接入、技术故障等网络游戏运营企业自身原因连续中断服务超过30日的,视为终止。

 
Article 23 An online game business entity shall protect the legitimate rights and interests of users of online games, and publish the dispute settlement methods in a conspicuous position of its service website.   第二十三条 网络游戏经营单位应当保障网络游戏用户的合法权益,并在提供服务网站的显著位置公布纠纷处理方式。

The culture administrative department of the State Council shall be responsible for formulating the Essential Clauses of a Standard Agreement on Online Game Services. The service agreement entered into between an online game operating enterprise and a user shall include all contents of the Essential Clauses of a Standard Agreement on Online Game Services, and other clauses of the service agreement shall not contravene the Essential Clauses of a Standard Agreement on Online Game Services.
 
国务院文化行政部门负责制定《网络游戏服务格式化协议必备条款》。网络游戏运营企业与用户的服务协议应当包括《网络游戏服务格式化协议必备条款》的全部内容,服务协议其他条款不得与《网络游戏服务格式化协议必备条款》相抵触。

 
Article 24 Where an online game business entity stops providing services for the users of an online game in accordance with a law, regulation or service agreement, it shall notify the users in advance of the stop and reasons for the stop.   第二十四条 网络游戏经营单位根据法律法规或者服务协议停止为网络游戏用户提供服务的,应当提前告知用户并说明理由。

 
Article 25 Where an online game business entity finds that an online game user publishes any illegal information, it shall immediately stop providing services for the user according to legal provisions or a service agreement, keep the relevant records, and report it to the relevant department.   第二十五条 网络游戏经营单位发现网络游戏用户发布违法信息的,应当依照法律规定或者服务协议立即停止为其提供服务,保存有关记录并向有关部门报告。

 
Article 26 An online game business entity may, in the case of any infringement upon the legitimate rights and interests of an online game user or in the case of any dispute with an online game user, require the user to show his/her valid ID certificate consistent with the registered ID information. If the information is true upon examination, it shall assist the user in taking evidence. After the real name registration of a user is verified to be true, the online game business entity shall be responsible for adducing evidence to such a user pursuant to law.   第二十六条 网络游戏经营单位在网络游戏用户合法权益受到侵害或者与网络游戏用户发生纠纷时,可以要求网络游戏用户出示与所注册的身份信息相一致的个人有效身份证件。审核真实的,应当协助网络游戏用户进行取证。对经审核真实的实名注册用户,网络游戏经营单位负有向其依法举证的责任。

Where both parties fail to settle a dispute by consultations, either party may apply for arbitration or bring an action in the people's court pursuant to law.
 
双方出现争议经协商未能解决的,可依法申请仲裁或者向人民法院提起诉讼。

 
Article 27 No entity shall provide online payment services for illegal online game business operations. The culture administrative department or the general law enforcement organ of the cultural market shall notify the relevant department to legally deal with an entity which provides online payment services for illegal online game business operations.   第二十七条 任何单位不得为违法网络游戏经营活动提供网上支付服务。为违法网络游戏经营活动提供网上支付服务的,由文化行政部门或者文化市场综合执法机构通报有关部门依法处理。

 
Article 28 An online game operating enterprise shall, according to the relevant provisions of the state, take technical and managerial measures to ensure the safety of online information, including preventing computer virus invasion, attack or damage, backing up important databases and saving user registration information, operating information, maintenance logs and other information, and protect national secrets, trade secrets and users' personal information pursuant to law.   第二十八条 网络游戏运营企业应当按照国家规定采取技术和管理措施保证网络信息安全,包括防范计算机病毒入侵和攻击破坏,备份重要数据库,保存用户注册信息、运营信息、维护日志等信息,依法保护国家秘密、商业秘密和用户个人信息。

 
Chapter V Legal Liabilities 

第五章 法 律 责 任


 
Article 29 Whoever, in violation of Article 6 of these Measures, engages in online game business operations without approval, including but not limited to the network operation of an online game, distribution of virtual currency of online games or provision of virtual currency trading services for an online game, the culture administrative department at or above the county level or the general law enforcement organ of the cultural market shall investigate and punish it in accordance with the provisions of the Measures for Investigating, Punishing and Banning Unlicensed Business Operations.   第二十九条 违反本办法第六条的规定,未经批准,擅自从事网络游戏上网运营、网络游戏虚拟货币发行或者网络游戏虚拟货币交易服务等网络游戏经营活动的,由县级以上文化行政部门或者文化市场综合执法机构依据《无照经营查处取缔办法》的规定予以查处。

 
Article 30 Where an online game business entity falls under any of the following circumstances, the culture administrative department at or above the county level or the general law enforcement organ of the cultural market shall order it to make correction, confiscate its illegal gains and impose a fine of not less than 10,000 yuan but not more than 30,000 yuan on it, and if the circumstances are serious, order it to cease business operation for rectification or revoke its Internet Culture Business Permit; and if a crime is constituted, the entity shall be subject to criminal liability pursuant to law:   第三十条 网络游戏经营单位有下列情形之一的,由县级以上文化行政部门或者文化市场综合执法机构责令改正,没收违法所得,并处10000元以上30000元以下罚款;情节严重的,责令停业整顿直至吊销《网络文化经营许可证》;构成犯罪的,依法追究刑事责任:

 
1. providing any online game product or service which contains anything prohibited by Article 9 of these Measures; (一)提供含有本办法第九条禁止内容的网络游戏产品和服务的;

 
2. violating paragraph 1 of Article 8 of these Measures; (二)违反本办法第八条第一款规定的;

 
3. in violation of Article 11 of these Measures, putting into network operation any imported online game which has not been approved by the Ministry of Culture upon content examination; (三)违反本办法第十一条的规定,上网运营未获得文化部内容审查批准的进口网络游戏的;

 
4. in violation of paragraph 2 of Article 12 of these Measures, failing to apply anew as required when the operating enterprise of an imported online game is changed; or (四)违反本办法第十二条第二款的规定,进口网络游戏变更运营企业未按照要求重新申报的;

Article 31 Where an online game business entity violates Article 16, Article 17 or Article 18 of these Measures, the culture administrative department at or above the county level or the general law enforcement organ of the cultural market shall order it to make correction, confiscate its illegal gains and impose a fine of not less than 10,000 yuan but not more than 30,000 yuan.   第三十一条 网络游戏经营单位违反本办法第十六条、第十七条、第十八条规定的,由县级以上文化行政部门或者文化市场综合执法机构责令改正,没收违法所得,并处10000元以上30000元以下罚款。

 
Article 32 Where an online game operating enterprise distributing virtual currency of online games violates subparagraph 1 or 2 of Article 19 of these Measures, the culture administrative department at or above the county level or the general law enforcement organ of the cultural market shall order it to make correction and impose a fine of not more than 30,000 yuan according to the seriousness of circumstances; or where it violates subparagraph 3 or 4 of Article 19 of these Measures, the culture administrative department at or above the county level or the general law enforcement organ of the cultural market shall order it to make correction and impose a fine of not more than 20,000 yuan according to the seriousness of circumstances.   第三十二条 网络游戏运营企业发行网络游戏虚拟货币违反本办法第十九条第一、二项规定的,由县级以上文化行政部门或者文化市场综合执法机构责令改正,并可根据情节轻重处30000元以下罚款;违反本办法第十九条第三、四项规定的,由县级以上文化行政部门或者文化市场综合执法机构责令改正,并可根据情节轻重处20000元以下罚款。

 
Article 33 Where an enterprise providing virtual currency trading services for online games violates subparagraph 1 of Article 20 of these Measures, the culture administrative department at or above the county level or the general law enforcement organ of the cultural market shall order it to make correction and impose a fine of not more than 30,000 yuan; where it violates subparagraph 2 or 3 of Article 20 of these Measures, the culture administrative department at or above the county level or the general law enforcement organ of the cultural market shall order it to make correction and impose a fine of not more than 30,000 yuan according to the seriousness of circumstances; or where it violates subparagraph 4 or 5 of Article 20 of these Measures, the culture administrative department at or above the county level or the general law enforcement organ of the cultural market shall order it to make correction and impose a fine of not more than 20,000 yuan according to the seriousness of circumstances.   第三十三条 网络游戏虚拟货币交易服务企业违反本办法第二十条第一项规定的,由县级以上文化行政部门或者文化市场综合执法机构责令改正,并处30000元以下罚款;违反本办法第二十条第二、三项规定的,由县级以上文化行政部门或者文化市场综合执法机构责令改正,并可根据情节轻重处30000元以下罚款;违反本办法第二十条第四、五项规定的,由县级以上文化行政部门或者文化市场综合执法机构责令改正,并可根据情节轻重处20000元以下罚款。

 
Article 34 Where an online game operating enterprise violates paragraph 1 of Article 13, paragraph 2 of Article 14, Article 15, Article 21, Article 22 or paragraph 2 of Article 23 of these Measures, the culture administrative department at or above the county level or the general law enforcement organ of the cultural market shall order it to make correction and impose a fine of not more than 20,000 yuan according to the seriousness of circumstances.   第三十四条 网络游戏运营企业违反本办法第十三条第一款、第十四条第二款、第十五条、第二十一条、第二十二条、第二十三条第二款规定的,由县级以上文化行政部门或者文化市场综合执法机构责令改正,并可根据情节轻重处20000元以下罚款。

 
Article 35 Where an online game business entity violates paragraph 2 of Article 8, paragraph 3 of Article 12, paragraph 2 of Article 13, paragraph 1 of Article 23 or Article 25 of these Measures, the culture administrative department at or above the county level or the general law enforcement organ of the cultural market shall order it to make correction and impose a fine of not more than 10,000 yuan according to the seriousness of circumstances.   第三十五条 网络游戏经营单位违反本办法第八条第二款、第十二条第三款、第十三条第二款、第二十三条第一款、第二十五条规定的,由县级以上文化行政部门或者文化市场综合执法机构责令改正,并可根据情节轻重处10000元以下罚款。

 
Chapter VI Supplementary Provisions 

第六章 附 则


 
Article 36 The term “general law enforcement organ of the cultural market” refers to an administrative organ of law enforcement which, in accordance with the provisions of the relevant laws, regulations and rules of the state, exercises the administrative punishment power and the related supervision and inspection power and administrative enforcement power in a relatively centralized manner in the cultural sector.   第三十六条 本办法所称文化市场综合执法机构是指依照国家有关法律、法规和规章的规定,相对集中地行使文化领域行政处罚权以及相关监督检查权、行政强制权的行政执法机构。

 
Article 37 In the investigation and punishment of illegal business operations, the culture administrative department or the general law enforcement organ of the cultural market shall exercise its jurisdiction according to the registration place or the actual business place of an enterprise engaging in illegal business operations. If the registration place or the actual business place cannot be determined, the jurisdiction shall be determined according to the information service licensing or filing place of the website engaging in illegal business operations; or in the absence of licensing or filing, the jurisdiction shall be determined according to the place of location of the server of the website. If the server of the website is located overseas, the jurisdiction shall be determined according to the place of occurrence of the illegal activities.   第三十七条 文化行政部门或者文化市场综合执法机构查处违法经营活动,依照实施违法经营行为的企业注册地或者企业实际经营地进行管辖;企业注册地和实际经营地无法确定的,由从事违法经营活动网站的信息服务许可地或者备案地进行管辖;没有许可或者备案的,由该网站服务器所在地管辖;网站服务器设置在境外的,由违法行为发生地进行管辖。

 
Article 38 In accordance with the provisions of the Interpretation of the State Commission Office for Public Sector Reform of Some Provisions concerning Cartoons, Online Games and General Law Enforcement in the Cultural Market of the “Three-Determination” Provisions on the Ministry of Culture, the State Administration of Radio, Film and Television and the General Administration of Press and Publication (No.35 [2009] of the State Commission Office for Public Sector Reform), the pre-approval of online publication of online games and the examination and approval of publication of Internet game titles authorized by overseas copyright owners shall be administered by the relevant departments according to the relevant laws and regulations.   第三十八条 网络游戏的网上出版前置审批和出版境外著作权人授权的互联网游戏作品的审批,按照《中央编办对文化部、广电总局、新闻出版总署〈“三定”规定〉中有关动漫、网络游戏和文化市场综合执法的部分条文的解释》(中央编办发〔2009〕35号)的规定,由有关部门依据相关法律法规管理。

 
Article 39 These Measures shall come into force on August 1, 2010.   第三十九条 本办法自二〇一〇年八月一日起施行。
