The Interpretation of the Supreme People's Court and the Supreme People's Procuratorate of Several Issues on the Specific Application of Law in the Handling of Criminal Cases about Illegal Production and Sale of Tobacco Monopoly Commodities and Other Offences, which was adopted at the 1,481st session of the Judicial Committee of the Supreme People's Court on December 28, 2009 and the 29th meeting of the eleventh Procuratorial Committee of the Supreme People's Procuratorate on February 4, 2010, is hereby promulgated and shall come into force on March 26, 2010. | |
最高人民法院、最高人民检察院《关于办理非法生产、销售烟草专卖品等刑事案件具体应用法律若干问题的解释》已于2009年12月28日由最高人民法院审判委员会第1481次会议、2010年2月4日由最高人民检察院第十一届检察委员会第29次会议通过，现予公布，自2010年3月26日起施行。 |

To maintain the order of the socialist market economy and legally punish crimes such as crime of illegal production or sale of tobacco monopoly commodities, in accordance with the relevant provisions of the Criminal Law, several issues on the specific application of law in the handling of such criminal cases are hereby interpreted as follows: | |
为维护社会主义市场经济秩序，依法惩治非法生产、销售烟草专卖品等犯罪，根据刑法有关规定，现就办理这类刑事案件具体应用法律的若干问题解释如下： |

| Article 1 Whoever produces or sells fake or substandard cigarettes, cigars and/or other tobacco monopoly commodities with a sales amount of not less than 50,000 yuan shall be convicted of and punished for the crime of production or sale of fake or substandard products in accordance with Article 140 of the Criminal Law. | | 第一条 生产、销售伪劣卷烟、雪茄烟等烟草专卖品，销售金额在五万元以上的，依照刑法第一百四十条的规定，以生产、销售伪劣产品罪定罪处罚。 |
Whoever, without the permission of the owner of a registered trademark on such tobacco monopoly commodities as cigarettes or cigars, uses a trademark identical with the registered trademark on such tobacco monopoly commodities as cigarettes or cigars shall, if the circumstances are serious, be convicted of and punished for the crime of counterfeiting a registered trademark in accordance with Article 213 of the Criminal Law. | |
未经卷烟、雪茄烟等烟草专卖品注册商标所有人许可，在卷烟、雪茄烟等烟草专卖品上使用与其注册商标相同的商标，情节严重的，依照刑法第二百一十三条的规定，以假冒注册商标罪定罪处罚。 |
Whoever knowingly sells such tobacco monopoly commodities as cigarettes or cigars with a counterfeited registered trademark with a relatively large sales amount shall be convicted of and punished for the crime of selling commodities with a counterfeited registered trademark in accordance with Article 214 of the Criminal Law. | |
销售明知是假冒他人注册商标的卷烟、雪茄烟等烟草专卖品，销售金额较大的，依照刑法第二百一十四条的规定，以销售假冒注册商标的商品罪定罪处罚。 |
Whoever forges or illegally produces labels of another person's registered trademark on cigarettes or cigars or sells forged or illegally produced labels of a registered trademark on cigarettes or cigars shall, if the circumstances are serious, be convicted of and punished for the crime of illegal production of labels of a registered trademark or sale of illegally produced labels of a registered trademark in accordance with Article 215 of the Criminal Law. | |
伪造、擅自制造他人卷烟、雪茄烟注册商标标识或者销售伪造、擅自制造的卷烟、雪茄烟注册商标标识，情节严重的，依照刑法第二百一十五条的规定，以非法制造、销售非法制造的注册商标标识罪定罪处罚。 |
Whoever, in violation of any law or regulation of the state on tobacco monopoly administration and without the licensing by the administrative department of tobacco monopoly, illegally deals in tobacco monopoly commodities without a license for tobacco monopoly manufacturing enterprises, a license for tobacco monopoly wholesale enterprises, a license for special tobacco trading enterprises, a license for tobacco monopoly retail sale enterprises or any other license or certificate shall, if the circumstances are serious, be convicted of and punished for the crime of illegal business operation in accordance with Article 225 of the Criminal Law.

违反国家烟草专卖管理法律法规，未经烟草专卖行政主管部门许可，无烟草专卖生产企业许可证、烟草专卖批发企业许可证、特种烟草专卖经营企业许可证、烟草专卖零售许可证等许可证明，非法经营烟草专卖品，情节严重的，依照刑法第二百二十五条的规定，以非法经营罪定罪处罚。
