To accurately hear the civil cases with objection to subject matter jurisdiction, maintain the order of litigation and protect the legitimate rights and interests of the parties concerned pursuant to law, these Provisions are formulated in accordance with the provisions of the Civil Procedure Law of the People's Republic of China and in light of the trial practice. | |
为正确审理民事级别管辖异议案件，依法维护诉讼秩序和当事人的合法权益，根据《中华人民共和国民事诉讼法》的规定，结合审判实践，制定本规定。 |

| Article 1 If the defendant raises an objection to subject matter jurisdiction during the period for filing an answer and believes that the people's court which accepts the case violates the provisions on subject matter jurisdiction, holding that the case should be under the jurisdiction of a people's court at a higher or lower level, the people's court which accepts the case shall examine such objection and make a ruling within 15 days after accepting the objection. | | 第一条 被告在提交答辩状期间提出管辖权异议，认为受诉人民法院违反级别管辖规定，案件应当由上级人民法院或者下级人民法院管辖的，受诉人民法院应当审查，并在受理异议之日起十五日内作出裁定： |

| 1. If the objection is untenable, the people's court shall overrule the objection; and | | （一）异议不成立的，裁定驳回； |

| 2. If the objection is tenable, the people's court shall rule to transfer the case to the people's court having jurisdiction. | | （二）异议成立的，裁定移送有管辖权的人民法院。 |

Article 2 If the plaintiff applies for withdrawing the litigation before a ruling on the objection to the jurisdiction is made, and the people's court which accepts the case makes a ruling on approving the withdrawal of the litigation, the objection to the jurisdiction shall not be examined and it shall be specified in the said ruling.
