(Adopted at the 1174th session of the Judicial Committee of the Supreme People's Court on May 10, 2001, amended in accordance with the Decision of the Supreme People's Court on Amending the Interpretation of the Supreme People's Court of Several Issues on the Specific Application of Law in the Trial of Criminal Cases about the Illegal Manufacture, Trading and Transport of Guns, Ammunition and Explosives and Other Offences, Interpretation No.18 [2009] of the Supreme People's Court, which was adopted at the 1476th session of the Judicial Committee of the Supreme People's Court on November 9, 2009 and promulgated on November 16, 2009). | |

To severely punish the criminal activities of illegally manufacturing, trading and transporting guns, ammunition and explosives and other offences pursuant to law, in accordance with the relevant provisions of the Criminal Law, several issues on the specific application of law in the trial of such cases are hereby interpreted as follows: | |
为依法严惩非法制造、买卖、运输枪支、弹药、爆炸物等犯罪活动，根据刑法有关规定，现就审理这类案件具体应用法律的若干问题解释如下： |

| Article 1 Where any individual or entity illegally manufactures, trades, transports, mails or stores any gun, ammunition or explosive under any of the following circumstances, it/he shall be convicted of and punished for the crime of illegally manufacturing, trading, transporting, mailing or storing guns, ammunition or explosives in accordance with paragraph 1 of Article 125 of the Criminal Law. | | 第一条 个人或者单位非法制造、买卖、运输、邮寄、储存枪支、弹药、爆炸物，具有下列情形之一的，依照刑法第一百二十五条第一款的规定，以非法制造、买卖、运输、邮寄、储存枪支、弹药、爆炸物罪定罪处罚： |

| 1. illegally manufacturing, trading, transporting, mailing or storing 1 or more military guns; | | （一）非法制造、买卖、运输、邮寄、储存军用枪支一支以上的； |
| |
|
| 2. illegally manufacturing, trading, transporting, mailing or storing 1 non-military guns which shoot bullets with gun powder as the driving force, or 2 other non-military guns which take compressed gas, etc. as the driving force, or more; | | （二）非法制造、买卖、运输、邮寄、储存以火药为动力发射枪弹的非军用枪支一支以上或者以压缩气体等为动力的其他非军用枪支二支以上的； |

| 3. illegally manufacturing, trading, transporting, mailing or storing 10 military bullets, or 500 air rifle pellets, or 100 other non-military bullets, or more; | | （三）非法制造、买卖、运输、邮寄、储存军用子弹十发以上、气枪铅弹五百发以上或者其他非军用子弹一百发以上的； |

| 4. illegally manufacturing, trading, transporting, mailing or storing 1 hand grenade or more; | | （四）非法制造、买卖、运输、邮寄、储存手榴弹一枚以上的； |
| |
|
| 5. illegally manufacturing, trading, transporting, mailing or storing any explosive assembly; | | （五）非法制造、买卖、运输、邮寄、储存爆炸装置的； |
| |
|
| 6. illegally manufacturing, trading, transporting, mailing or storing 1 kilogram of explosives, propellants or black power, or 3 kilograms of pyrotechnic composition, or 30 detonators, or 30 meters of blasting fuses or detonating cords, or more; | | （六）非法制造、买卖、运输、邮寄、储存炸药、发射药、黑火药一千克以上或者烟火药三千克以上、雷管三十枚以上或者导火索、导爆索三十米以上的； |
| |
|
| 7. Any entity qualified for producing explosives fails to manufacture explosives under the prescribed varieties, or any entity qualified for selling or using explosives trades, as beyond quota, 10 kilograms of explosives, propellants or black power, or 30 kilograms of pyrotechnic composition, or 300 detonators, or 300 meters of blasting fuses or detonating cords, or more; | | （七）具有生产爆炸物品资格的单位不按照规定的品种制造，或者具有销售、使用爆炸物品资格的单位超过限额买卖炸药、发射药、黑火药十千克以上或者烟火药三十千克以上、雷管三百枚以上或者导火索、导爆索三百米以上的； |

| 8. illegally manufacturing, trading, transporting, mailing or storing ammunition or explosives for 2 or more times; or | | （八）多次非法制造、买卖、运输、邮寄、储存弹药、爆炸物的； |
| |
|
| 9. there is any other vicious circumstance with serious consequences, though the aforesaid minimum quantity is not reached. | | （九）虽未达到上述最低数量标准，但具有造成严重后果等其他恶劣情节的。 |
Anyone who refers a buyer or seller of guns, ammunition or explosives shall be punished as an accomplice in the crime of trading of guns, ammunition or explosives. | |
介绍买卖枪支、弹药、爆炸物的，以买卖枪支、弹药、爆炸物罪的共犯论处。 |

|
| Article 2 Any of the following circumstances of illegally manufacturing, trading, transporting, mailing or storing guns, ammunition or explosives shall be deemed as a “serious circumstance” as mentioned in paragraph 1 of Article 125 of the Criminal Law: | | 第二条 非法制造、买卖、运输、邮寄、储存枪支、弹药、爆炸物，具有下列情形之一的，属于刑法第一百二十五条第一款规定的“情节严重”： |
| |
|
| 1. the amount of guns, ammunition or explosives which are illegally manufactured, traded, transported, mailed or stored reaches 5 times the minimum quantity as prescribed in paragraph 1, 2, 3, 6 or 7 of Article 1 of this Interpretation, or more; | | （一）非法制造、买卖、运输、邮寄、储存枪支、弹药、爆炸物的数量达到本解释第一条第（一）、（二）、（三）、（六）、（七）项规定的最低数量标准五倍以上的； |
| |
|
| 2. illegally manufacturing, trading, transporting, mailing or storing 3 or more hand grenades; | | （二）非法制造、买卖、运输、邮寄、储存手榴弹三枚以上的； |
| |
|
| 3. illegally manufacturing, trading, transporting, mailing or storing any explosive assembly, which has caused serious consequences; or | | （三）非法制造、买卖、运输、邮寄、储存爆炸装置，危害严重的； |
| |
|
| 4. reaching the minimum quantity as prescribed in Article 1 of this Interpretation, and there is any other vicious circumstance with serious consequences. | | （四）达到本解释第一条规定的最低数量标准，并具有造成严重后果等其他恶劣情节的。 |
| |
|
| Article 3 Where any entity which is legally designated or determined to manufacture or sell guns commits any act mentioned in Article 126 of the Criminal Law under any of the following circumstances, it shall be convicted of and punished for the crime of illegal manufacture or sale of guns. | | 第三条 依法被指定或者确定的枪支制造、销售企业，实施刑法第一百二十六条规定的行为，具有下列情形之一的，以违规制造、销售枪支罪定罪处罚： |

| 1. illegally manufacturing 5 guns or more; | | （一）违规制造枪支五支以上的； |
| |
|
| 2. illegally selling 2 or more guns; or | | （二）违规销售枪支二支以上的； |
| |
|
| 3. there is any other vicious circumstance with serious consequences, though the aforesaid minimum quantity is not reached. | | （三）虽未达到上述最低数量标准，但具有造成严重后果等其他恶劣情节的。 |
Any of the following circumstances shall be deemed as a “serious circumstance” as mentioned in Article 126 of the Criminal Law:
