To guarantee the smooth implementation of the foreign exchange system reform and realize RMB's convertibility under current accounts, you are hereby notified of the relevant issues on the administration of foreign exchange settlement, sale and payment under the non-trade account in the Provisions on the Administration of Foreign Exchange Settlement, Sale and Payment (No. 210 [1996] of the People's Bank of China, June 20, 1996) as follows: | |
为保证外汇体制改革的顺利进行，实现经常项目下人民币可兑换，现将中国人民银行一九九六年六月二十日银发[1996]210号《结汇、售汇及付汇管理规定》中有关非贸易项下结汇、售汇及付汇管理有关问题通知如下： |

| I. Where a domestic institution (excluding foreign-funded enterprises) handles foreign exchange settlement formalities in accordance with Article 7 of the Provisions on the Administration of Foreign Exchange Settlement, Sale and Payment, it shall comply with the following provisions: | | 一、境内机构（不含外商投资企业）按照《结汇、售汇及付汇管理规定》第七条的规定办理结汇时，应当按照下列规定办理： |

| 1. The net income of foreign exchange received by a company engaging in contracted overseas work, provision of labor services, technical cooperation or any other service business overseas from the business transactions conducted during the course of the aforesaid projects shall be settled on a yearly basis; | | （一）经营境外承包工程、向境外提供劳务、技术合作及其他服务业务的公司在上述项目进行过程中收到的业务往来外汇净收入按年结汇； |

| 2. The net income of foreign exchange paid and received by an institution engaging in the agency business for international transactions or overseas business on behalf of others shall be settled on a quarterly basis; | | （二）从事代理对外或者境外业务的机构代收代付的外汇，净收入按季结汇； |

3. The net income of foreign exchange to be paid or settled in a short time, excluding the foreign exchange received by a domestic first-class travel agency and prepaid by a foreign travel agency, shall be settled on a quarterly basis;
