The Law of the People's Republic of China on Diplomatic Personnel Stationed Abroad, which was adopted at the 11th session of the 11th NPC Standing Committee of the People's Republic of China on October 31, 2009, is hereby promulgated and shall come into force on January 1, 2010.
 
《中华人民共和国驻外外交人员法》已由中华人民共和国第十一届全国人民代表大会常务委员会第十一次会议于2009年10月31日通过,现予公布,自2010年1月1日起施行。

Chapter I General Provisions 第一章 总  则


 
Article 1 These Measures are formulated in accordance with the Constitution and the Civil Servant Law in order to build a team of high quality diplomatic personnel stationed abroad, ensure that the diplomatic institutions stationed abroad perform their duties in accordance with law, regulate the administration of diplomatic personnel stationed abroad, and protect the legitimate rights and interests of the diplomatic personnel stationed abroad.   第一条 为了建设高素质的驻外外交人员队伍,保证驻外外交机构依法履行职责,规范驻外外交人员的管理,保障驻外外交人员的合法权益,根据宪法公务员法,制定本法。

 
Article 2 The term “diplomatic personnel stationed abroad” as mentioned in these Measures refers to the personnel who perform the diplomatic and consular work in the diplomatic institutions of the People's Republic of China stationed abroad, use the administrative staffing quotas for personnel stationed abroad, and possess diplomatic ranks.   第二条 本法所称驻外外交人员,是指在中华人民共和国驻外外交机构中从事外交、领事等工作,使用驻外行政编制,具有外交衔级的人员。

The term “diplomatic institutions stationed abroad” as mentioned in these Measures refers to the embassies and consulates of the People's Republic of China in foreign countries, the permanent missions to the United Nations and other inter-governmental organizations, and other representative institutions.
 
本法所称驻外外交机构,是指中华人民共和国驻外国的使馆、领馆以及常驻联合国等政府间国际组织的代表团等代表机构。

These Measures shall apply to the obligations, rights and administration of diplomatic personnel stationed abroad. What is not provided for in these Measures shall be governed by the Civil Servant Law.
 
驻外外交人员的义务、权利和管理,适用本法。本法未作规定的,适用公务员法的规定。

 
Article 3 The diplomatic personnel stationed abroad shall be protected by law in performing their duties according to law.   第三条 驻外外交人员依法履行职责,受法律保护。

 
Article 4 The Ministry of Foreign Affairs shall play a leading role in the work of the diplomatic institutions stationed abroad, and administer the diplomatic personnel stationed abroad jointly with other dispatching departments.   第四条 外交部统一领导驻外外交机构的工作,会同其他派出部门对驻外外交人员实施管理。

 

Chapter II Duties, Conditions, Obligations and Rights 第二章 职责、条件、义务和权利


 
Article 5 Diplomatic personnel stationed abroad shall, in accordance with their posts and division of work, perform the following duties:   第五条 驻外外交人员应当根据职务和工作分工,履行下列职责:

 
(1) safeguarding national sovereignty, security, honor and interests; (一)维护国家主权、安全、荣誉和利益;

 
(2) implementing the national diplomatic guidelines and policies; (二)贯彻执行国家外交方针政策;

 
(3) making diplomatic representations on behalf of the state; (三)代表国家提出外交交涉;

 
(4) furthering the relations between China and the countries of residence, participating in the activities of international organizations, and promoting bilateral and multilateral friendly exchanges and cooperation; (四)发展中国与驻在国之间的关系,参与国际组织活动,促进双边和多边友好交流与合作;

 
(5) protecting the legitimate rights and interests of Chinese citizens and legal persons in foreign countries; (五)维护中国公民和法人在国外的正当权益;

 
(6) reporting the happenings of the countries of residence and the relevant regional and international situation; (六)报告驻在国情况和有关地区、国际形势;

 
(7) introducing China as well as its domestic and foreign policies of China, and promoting the understanding of the countries of residence to China; and (七)介绍中国情况和内外政策,增进驻在国和世界对中国的了解;

 
(8) performing other diplomatic or consular duties. (八)履行其他外交或者领事职责。

Ambassadors extraordinary and plenipotentiary are the representatives of the People's Republic of China in the countries of residence.
 
特命全权大使是中华人民共和国在驻在国的代表。

 
Article 6 Diplomatic personnel stationed abroad shall:   第六条 驻外外交人员应当具备下列条件:

 
(1) be a citizen of the People's Republic of China; (一)具有中华人民共和国国籍;

 
(2) be more than 23 years old; (二)年满二十三周岁;

 
(3) uphold the Constitution of the People's Republic of China; (三)拥护中华人民共和国宪法

 
(4) have good political awareness and ethics; (四)具有良好的政治素质和品行;

 
(5) have the expertise, working capability and language skills necessary for the work; (五)具有胜任工作所需的专业知识、工作能力和语言能力;

 
(6) have the physical conditions, psychological qualifications and adaptability required for permanently residing abroad; and (六)具有常驻国外所要求的身体条件、心理素质和适应能力;

 
(7) meet other requirements as prescribed by law. (七)法律规定的其他条件。

 
Article 7 Whoever falls under any of the following circumstances may not be appointed as a diplomat stationed abroad:   第七条 有下列情形之一的,不得任用为驻外外交人员:

 
(1) having been given a criminal punishment for a crime; (一)曾因犯罪受过刑事处罚的;

 
(2) having been discharged from public employment; (二)曾被开除公职的;

 
(3) having been dismissed by a state organ; (三)曾被国家机关辞退的;

 
(4) holding a foreign long-term or permanent residence permit; (四)持有外国长期或者永久居留许可的;

 
(5) his spouse has a foreign nationality, or holds a foreign long-term or permanent residence permit; or (五)配偶具有外国国籍、持有外国长期或者永久居留许可的;

 
(6) other circumstances under which he may not be appointed as a diplomat stationed abroad. (六)不得任用为驻外外交人员的其他情形。

 
Article 8 Diplomatic personnel stationed abroad shall perform the following obligations:   第八条 驻外外交人员应当履行下列义务:

 
(1) keeping loyal to the motherland and the people, and safeguarding national dignity; (一)忠于祖国和人民,维护国家尊严;

 
(2) complying with the Constitution and laws of the People's Republic of China and respecting the laws and customs of the countries of residence; (二)忠于中华人民共和国宪法和法律,尊重驻在国的法律和风俗习惯;

 
(3) being dedicated, performing their duties with due diligence, and completing all kinds of tasks; (三)忠于职守,勤勉尽责,完成各项工作任务;

 
(4) obeying the dispatch of the dispatching departments, and complying with the regulations, rules and work disciplines of the diplomatic institutions stationed abroad; (四)服从派出部门的调遣,遵守驻外外交机构规章制度和工作纪律;

 
(5) strictly keeping confidential the state secrets and work-related secrets; (五)严守国家秘密和工作秘密;

 
(6) not resigning during the period of working abroad; (六)不得在驻外工作期间辞职;

 
(7) reporting major personal issues to the diplomatic institutions stationed abroad and the dispatching departments in accordance with the relevant provisions; and (七)按照规定向驻外外交机构和派出部门报告个人重大事项;

 
(8) other obligations as prescribed by law. (八)法律规定的其他义务。

 
Article 9 Diplomatic personnel stationed abroad shall enjoy the following rights:   第九条 驻外外交人员享有下列权利:

 
(1) having the working conditions necessary for performing their duties; (一)获得履行职责应当具有的工作条件;

 
(2) obtaining the wages, benefits, insurance and treatment appropriate for their work and living in the countries of residence; (二)获得与常驻国外工作、生活相适应的工资福利保险待遇;

 
(3) refraining from being dismissed during the period of working abroad; (三)在驻外工作期间不被辞退;

 
(4) participating in training before dispatch and during their working abroad; and (四)派遣前和驻外工作期间参加培训;

 
(5) other rights as prescribed by law. (五)法律规定的其他权利。

 
Article 10 Diplomatic personnel stationed abroad shall enjoy corresponding privileges and immunities during their working abroad according to the international treaties concluded or acceded to by the People's Republic of China.   第十条 驻外外交人员依照中华人民共和国缔结或者参加的国际条约,在驻外工作期间享有相应的特权和豁免。

Diplomatic personnel stationed abroad shall not abuse their privileges and immunities, and shall not give up privileges and immunities without approval.
 
驻外外交人员不得滥用特权和豁免,未经批准不得放弃特权和豁免。
