关于人民法院预防和处理执行突发事件的若干规定（试行） |
For purposes of preventing and reducing the occurrence of enforcement emergencies, controlling, mitigating and eliminating social damages resulted from enforcement emergencies, regulating the enforcement emergency response and handling, protecting the personal and property safety of the enforcement personnel and other persons, and maintaining social stability, these Provisions are formulated in accordance with the Civil Procedure Law of the People's Republic of China, Emergency Response Law of the People's Republic of China and other relevant laws, and by taking into account the actualities in the enforcement work. | |
为预防和减少执行突发事件的发生，控制、减轻和消除执行突发事件引起的社会危害，规范执行突发事件应急处理工作，保护执行人员及其他人员的人身财产安全，维护社会稳定，根据《中华人民共和国民事诉讼法》、《中华人民共和国突发事件应对法》等有关法律规定，结合执行工作实际，制定本规定。 |

| Article 1 The term “enforcement emergency” as used in these Provisions refers to the incidents which break out during the enforcement work, such as the mass petition, self-injury by a party concerned, besiegement of the enforcement site by the mass, and obstruction of enforcement by force or by threat of force, and which endanger or may endanger the personal and property safety of the enforcement personnel and other persons, which seriously hamper the enforcement work order and to which emergency measures should be taken to respond. | | 第一条 本规定所称执行突发事件，是指在执行工作中突然发生，造成或可能危及执行人员及其他人员人身财产安全，严重干扰执行工作秩序，需要采取应急处理措施予以应对的群体上访、当事人自残、群众围堵执行现场、以暴力或暴力相威胁抗拒执行等事件。 |

| Article 2 On the basis of the seriousness of damages, range of impact and other factors, the enforcement emergencies are classified into 4 levels, extremely serious, very serious, serious and ordinary. | | 第二条 按照危害程度、影响范围等因素，执行突发事件分为特别重大、重大、较大和一般四级。 |
The term “extremely serious enforcement emergency” refers to an incident which has a serious impact on the social stability and causes the death of person (s) or injuries and disabilities of 3 or more persons. | |

Except for the extremely serious enforcement emergencies, the classification standards shall be formulated by each higher people's court in light of the actualities within its jurisdiction. | |

| Article 3 A higher people's court shall intensify the guidance on the enforcement emergency response and handling work of the courts within its jurisdiction. | | 第三条 高级人民法院应当加强对辖区法院执行突发事件应急处理工作的指导。 |
The enforcing court or the handling court shall be responsible for the enforcement emergency response and handling work. The people's court at each level shall establish an emergency response and handling work department for which its leader shall be responsible, and establish relevant work mechanisms. | |
执行突发事件的应急处理工作由执行法院或办理法院负责。各级人民法院应当成立由院领导负责的应急处理工作机构，并建立相关工作机制。 |
At the occurrence of an emergency during the enforcement in a different jurisdiction, the court of the place where the emergency occurs shall help the enforcing court to do well in the on-site emergency response and handling work. | |
异地执行发生突发事件时，发生地法院必须协助执行法院做好现场应急处理工作。 |

| Article 4 The principle of giving priority to prevention and combining the prevention with the emergency response and handling shall be observed in the enforcement emergency response work. The principle of giving top priority to the personal safety and stressing the social stability shall be always followed in the enforcement emergency response and handling work. | | 第四条 执行突发事件应对工作实行预防为主、预防与应急处理相结合的原则。执行突发事件应急处理坚持人身安全至上、社会稳定为重的原则。 |

| Article 5 The people's courts at all levels shall work out an enforcement emergency response and handling plan, which shall include the organization and commanding, handling principles and procedures, prevention and elimination, emergency response and handling measures, follow-up investigation and report, equipment and personnel guarantee, etc. | | 第五条 各级人民法院应当制定执行突发事件应急处理预案。执行应急处理预案包括组织与指挥、处理原则与程序、预防和化解、应急处理措施、事后调查与报告、装备及人员保障等内容。 |

Article 6 A system of whole-process reporting (including the relevant information prior to, during and after an enforcement emergency) shall be adopted for the enforcement emergencies. The enforcement personnel shall timely report the relevant information to the enforcement emergency response and handling work department of the court for which they work.
